Umzinyathi municipal manager suspended amid fraud and corruption allegations

The embattled municipal manager of the Umzinyathi district municipality in the KwaZulu-Natal Midlands, who is implicated in fraud and corruption allegations, has been suspended. The council meeting on Tuesday resolved to suspend Ntombenhle Mkhwanazi for three months pending her disciplinary hearing.
Mkhwanazi is implicated in damming corruption allegations relating to a payment of R5.7m for water projects that were never undertaken.
Council speaker Tyson Kunene confirmed that Mkhwanazi has been suspended after a council resolution. Kunene said Mkhwanazi is suspended for three months pending her disciplinary hearing.
According to a report compiled and tabled to the council by Garnet Ngubane and Partners Inc, the municipality from 2020 had a dubious relationship with a company called Bosch Projects. The company was tasked with the compilation of an operations and maintenance plan for wastewater treatment facilities. Also for pump stations, borehole and water schemes and network, which included the Mbono Bulk Water Project in Msinga.
The forensic report details how Umzinyathi officials made irregular payments and failed to properly instruct lawyers to defend lawsuits by Bosch Projects and had to pay millions as a result of undefended lawsuits. At the time, Mkhwanazi was a CFO working closely with the former municipal manager Lethu Mthembu.
The report recommended that some officials, like Sabelo Nhlebela, former contracts manager, Mthembu (Lethu) and others, be charged. Others should have their pensions withheld and money recouped.
'Mr Nhlebela must be charged for gross negligence in carrying out duties as he failed to manage the entire contract life cycle, including executing and ensuring compliance of the contract.
This while minimising risks and maximising the value for the municipality. This resulted in a fruitless and wasteful expenditure of R2,550,263.09. 'Civil action must be instituted against Mthembu for authorising payment to an amount of R5,798,502.08. This was for services that were never rendered.
'The forensic investigation into Bosch projects found that Mr [Germany] Ndlozi (former operations manager) was a key player and willing participant to defraud the municipality through wasteful and fruitless expenditure,' reads the report. It also recommended that the R5.7m that was paid to Bosch be recovered.

Despite disappointing results in prosecuting state capture cases, the NPA boasts a remarkable 90% conviction rate in complex commercial crimes in 2024. This achievement, which also included 333 convictions in complex tax case matters, highlights the NPA's strides in prosecuting financial crimes. The NPA's Specialised Commercial Crime Unit, in collaboration with the Directorate for Priority Crime Investigation, achieved these convictions. The prosecuting body's annual report for 2023/24, also showed that over 900,000 criminal matters were finalised across the country. The report also stated that the NPA achieved a remarkable 93.4% conviction rate in prosecuting organised crime cases, although a lot needs to be done to ensure that kingpins are also held accountable. These cases include the arrest and sentencing of six people who were involved in the murder of whistleblower Babita Deokaran. This was after Deokaran reported irregularities in the spending of the Gauteng Department of Health. Two accused were sentenced to 22 years and three were imprisoned for 15 years. Vincent Mkhefa, the chief financial officer and acting municipal manager at Nketoana Municipality in the Free State, was sentenced to eight years after he appointed service providers to supply 4,000 single-phase pre-payment electrical meters and 1,000 ready boards for R2,124 million. At the time he supposedly took the delivery, the items had not even been manufactured and he created the false impression that they were delivered and received. The unit also had a freezing order of R1.4 billion against Eskom senior executive France Hlakudi who was facing charges of fraud, corruption, and money laundering against him and 10 others. The NPA also celebrated the Supreme Court of Appeal's decision to dismiss the deportation appeal of Dr Nandipha Magudumana from Tanzania on May 16. This decision ended a long legal battle over the lawfulness of her return to South Africa in April 2023 and clears the way for her trial, set for 21 July 2025, alongside her alleged partner, Thabo Bester. The NPA also made significant progress in recovering money in economic crime cases, with nearly R2 billion recovered in 129 cases. Members of Matsulu SAPS received information about the dodgy activity and responded. The accused face charges of corrupt activities and defeating the ends of justice. The arrest comes a day after a City of Cape Town Law Enforcement officer was arrested by the Hawks. The 43-year-old officer was arrested on charges of murder, kidnapping, and extortion. The provincial spokesperson for the Hawks, Lieutenant Colonel Siyabulela Vukubi, said the kidnapping is alleged to have taken place on May 16 in Kraaifontein. 'The victim was last seen by a friend who reported that the victim went to Bellville to view a vehicle he intended to purchase and never came back. Instead, another friend of the victim received a call from the victim reporting that he had been kidnapped and was being assaulted,' Vukubi said.
