
Indian national charged with CBT involving over RM140,000 in company funds
KUALA LUMPUR — An Indian national pleaded not guilty in the Sessions Court here today to charges of criminal breach of trust (CBT) involving more than RM140,000 in the company's funds four years ago.
Rajinder Singh, 57, was charged as the director of Vantage Trading Partners, with committing CBT of the company's funds amounting to RM141,486.12.
The offence was allegedly committed at the company at Ilham Tower, Jalan Binjai here, on Oct 13 and Nov 26, 2021.
He was charged under Section 409 of the Penal Code, which provides a prison sentence of not less than two years and a maximum of 20 years, whipping and is liable to a fine, if convicted.
The man also pleaded not guilty to an alternative charge of using the fund without the consent or ratification of a general meeting at the same location and date.
The charge, under Section 218 (1) (a) of the Companies Act, provides imprisonment for up to five years or a fine of up to RM3 million or both upon conviction.
Judge Zulqarnain Hassan did not allow the accused bail and set June 5 for mention.
'The principle of bail is to ensure the accused appears in court. The accused and his wife are foreign nationals, and this country is not their homeland. Therefore, bail is not allowed,' he said.
Earlier, Deputy Public Prosecutor Mohamad Ikhwan Mohd Nasir did not offer bail, but said that if the court exercises its discretion to grant bail, he requested the bail amount at RM70,000 with two Malaysian guarantors.
Lawyer Daniel Annamalai, representing Rajinder Singh, requested that his client be allowed bail on the grounds that he has a wife, who is British, and two teenaged children to support.
'The accused is not at risk of fleeing because he has lived in this country for seven years and has businesses in Malaysia, India, Bangladesh and Indonesia in addition to being a 'trader' for the governments of the four countries,' he said. — BERNAMA

KLUANG: Police have arrested five men in connection with the death of an Indonesian man at an oil palm plantation here. Kluang OCPD Asst Comm Bahrin Mohd Noh said the suspects, aged between 21 and 31, were arrested at 1am yesterday. The suspect was uninjured while a 36-year-old businessman in the other car suffered injuries to his hands and had some abdominal pain. After the incident, the suspect was taken to the Kluang police headquarters' Narcotics Crime Investigation Division for a urine test. The suspect also has a criminal record. The case is being investigated under Section 44(1)(a) of the Road Transport Act 1987 for operating a vehicle while under the influence of drugs or alcohol, and Section 15(1)(a) of the Dangerous Drugs Act 1952 for self-administering dangerous drugs.

Police detain Singaporean for road rage incident in Skudai
JOHOR BAHRU: Police arrested a 40-year-old Singaporean man after he was involved in a road rage incident and alleged vandalism against another car around Tun Aminah, Skudai yesterday. Johor Bahru Utara (North) police chief ACP Balveer Singh Mahindar Singh said after a 31-year-old local man lodged a report about the incident at 3.01 pm, a team from the Criminal Investigation Division of the Johor Bahru Utara police headquarters (IPD) arrested the suspect at about 6.20 pm yesterday (June 8) and made several seizures. 'The complainant stated that while driving his BMW at 2.39pm in the Tun Aminah area, he was honked at by a Toyota Altis with a Singapore registration number, whose driver was dissatisfied because his path was blocked. An argument ensued and the suspect allegedly kicked the complainant's car, causing damage. However, the complainant did not suffer any injuries,' he said in a statement today. Balveer Singh said the suspect had no previous criminal record and tested negative for drugs. He said the suspect would be brought to the Johor Bahru Court tomorrow (June 9) for a remand application for the case to be investigated under Section 426 of the Penal Code (for mischief and damage of property) and Section 509 of the Penal Code (utterance of insult).
