
Bombay HC seeks Centre's response to plea for inclusion of same sex couples as ‘spouses' in I-T Act
A bench of Justices Burgess P Colabawalla and Firdosh P Pooniwalla on August 14 passed an order on plea by the couple in a 'long-term, stable same sex relationship.'
'Since the constitutional validity is challenged, we issue notice to the Attorney General of India returnable on 18th September 2025. We also direct the Registry to issue notice to Respondent No. 2 (Department of Income Tax),' the bench noted.
The court also issued notice to the I-T Department seeking its response to the plea during the next hearing.
The petition claimed that Section 56(2)(x) was unconstitutional as it excludes the petitioners from the scope and definition of the term 'spouse', which appears in the explanation to the fifth proviso of the concerned section of the IT Act.
Section 56(2)(x) of the IT Act relates to taxing any money, property, or any other assets received of value exceeding Rs 50,000 and receipts or gifts under the law are considered 'income from other sources'. The fifth proviso of the said provision stipulates exemption from tax on gifts received from certain relatives, including 'spouse'.
The couple sought direction that same sex couples be added in the proviso to the section.
The petitioners claimed that the term 'spouse' in present form under the law was 'discriminatory' against same sex couples, as it did not specify whether the exemption would apply to such couples, as they are not recognised as 'spouses'. They claimed that the term 'spouse' in the concerned provision should include 'same sex couples' like them, who are 'in exactly the same position as heterosexual couples, which would be presumed to be in a marriage.'
The bench posted a further hearing for September 18.

Govt nod to 93 additional LCA Mk 1 jets for IAF
THE CABINET Committee on Security Tuesday cleared the procurement of 97 LCA Mk 1 A light combat aircraft for the Indian Air Force, sources confirmed to The Indian Express. When inducted, the additional indigenous jets will be a boost to the dwindling fighter squadrons of the IAF. The order was already in the pipeline. Their procurement was cleared by the Defence Acquisition Council headed by Defence Minister Rajnath Singh in 2023. Earlier, the IAF had placed an order for 83 LCA Mk 1 A jets in February 2021. Subsequently, in August 2021, the state-owned Hindustan Aeronautics Limited placed an order worth Rs 5,375 crore for 99 F404 engines with GE Aerospace to power the indigenously made Tejas Mk-1A. The first of these jet engines was delivered to HAL after a delay of nearly a year and a half, in April this year. The second engine was delivered last month. The engine deliveries were delayed due to COVID-19 pandemic and supply chain issues. Twelve Light Combat Aircraft Tejas will be ready to be rolled out by December this year, of which six aircraft have already been lined up, government officials had said. The timely induction of the indigenous fighter jets, including Tejas Mk 1A, is crucial to holding the IAF's dwindling squadron strength. The IAF has phased out most of its MiG-21 squadrons, and early next decade, it is likely to begin phasing out other ageing fighter squadrons. According to officials, HAL plans to produce 16 fighter jets next year provided the engine deliveries from the US are on schedule. The original plans were to produce 16 aircraft every year and complete deliveries of all jets by 2030.

Government to bring bills to oust ministers held for over 30 days
Union home minister Amit Shah is set to introduce three major bills in the Lok Sabha on Wednesday, proposing that a sitting minister, chief minister or even the prime minister can lose their position within a month if they are arrested or detained for 30 consecutive days over an offence that carries a jail term of five years or more. Lok Sabha(Sansad TV) The list of government business in the Lok Sabha showed that the Centre will introduce three bills – The Constitution (130th Amendment) Bill, The Jammu & Kashmir Reorganization (Amendment) Bill and The Government of Union Territories (Amendment) Bill – in the Lower House on Wednesday. The list of government business also mentioned the consideration of a motion to send the three bills to a joint parliamentary committee after introduction. The three bills propose an entirely new legal framework that will be applicable to ministers and CMs in states and Union territories such as Jammu and Kashmir, and Union ministers and the PM at the Centre. To be sure, the bills suggest that a dismissed minister, CM or PM can be appointed again after their release from custody. A copy of the constitution amendment bill, reviewed by HT, proposed a new 5(A) clause in Article 75 of the Constitution that says, 'A minister, who for any period of thirty consecutive days during holding the office as such, is arrested and detained in custody, on allegation of committing an offence under any law for the time being in force, which is punishable with imprisonment for a term which may extend to five years or more, shall be removed from his office by the President on the advice of the Prime Minister to be tendered by the thirty-first day, after being taken in such custody.' It says that even if the PM's advice 'for the removal of such minister is not tendered to the President by the thirty-first day, he shall cease to be a Minister, with effect from the day falling thereafter.' Under the new amendment, the law for a PM has also been tightened. 'Provided further that in case of the Prime Minister, who for any period of thirty consecutive days during holding the office as such, is arrested and detained in custody, on allegation of committing an offence under any law for the time being in force, which is punishable with imprisonment for a term which may extend to five years or more, shall tender his resignation by the thirty-first day after such arrest and detention, and if he does not tender his resignation, he shall cease to be the Prime Minister with effect from the day falling thereafter,' the legislation said. It added that a Prime Minister or a minister can be 'subsequently appointed as the Prime Minister or a Minister, by the President, on his release from custody, as per clause (1).' The same provision shall be applicable in the case of CMs and ministers in different states and Union Territories. There are two days left in the monsoon session, which is set to close on August 21. The Opposition has boycotted proceedings on several occasions in this session and protests have marred proceedings. There is currently no provision to remove a sitting minister if they are accused of a crime. Only a member of Parliament or legislative assembly can lose their seat (and if they're a minister, effectively their ministership) if they are convicted for a crime that carries a punishment of two years imprisonment or more. 'The elected representatives represent hopes and aspirations of the people of India. It is expected that they rise above political interests and act only in the public interest and for the welfare of people. It is expected that the character and conduct of ministers holding the office should be beyond any ray of suspicion,' the statement of object and reasons said. 'A minister, who is facing allegation of serious criminal offences, arrested and detained in custody, may thwart or hinder the canons of constitutional morality and principles of good governance and eventually diminish the constitutional trust reposed by people in him,' the statement added. 'There is however, no provision under the Constitution for removal of a minister who is arrested and detained in custody on account of serious criminal charges,' it further said. The constitution amendment bill sought to amend Articles 75, 164 and 239AA of the Constitution. The union territories bill sought to amend section 45 of the Government of Union Territories Act, 1963. The J&K reorganisation bill sought to amend section 54 of the Jammu and Kashmir Reorganisation Act, 2019. In the past, many ministers have continued in their position even after central agencies have arrested them. While the detention or arrest of a sitting PM is unlikely to happen, the Opposition may argue that the law can be misused to remove important ministers or even CMs by detaining or arresting them. Over the past five years, sitting chief ministers such as former Delhi CM Arvind Kejriwal or Jharkhand CM Hemant Soren have been arrested by central agencies, with the Opposition alleging that the charges were politically motivated. Reacting to the development, Congress MP Abhishek Manu Singhvi said, 'Wht a vicious circle! No guildelines for arrest followed! Arrests of opposition leaders rampant and disproportionate. New proposed law removes incumbent #CM etc immly on arrest. Best way to destabilise opposition is to unleash biased central agencies to arrest oppo CMs and despite being unable to defeat them electorally, remove them by arbitrary arrests!! And no ruling party incumbent CM ever touched!!'

Cabinet Approves Airport At Kota-Bundi In Rajasthan For Rs 1,507 Crore
New Delhi: The Union Cabinet on Tuesday cleared a proposal to set up a new airport at Kota-Bundi in Rajasthan at an estimated cost of Rs 1,507 crore. The airport, to be completed in two years, will have an annual passenger handling capacity of 2 million and 1,089 acres (around 440.06 hectares) of land is being provided free of cost by the Rajasthan government for the project. Briefing the media after the Cabinet meeting, Information & Broadcasting Minister Ashwini Vaishnaw said the greenfield airport project at Kota-Bundi will be funded by the Airports Authority of India (AAI) through its internal accruals. Kota-Bundi constituency is represented by Lok Sabha Speaker Om Birla. The Cabinet Committee on Economic Affairs, chaired by Prime Minister Shri Narendra Modi, has approved the proposal for developing a green field airport at Kota-Bundi at an estimated cost of Rs 1,507 crore, according to an official release. The state government has transferred 440.06 hectares of land to AAI for the airport, which will be suitable for the operation of narrow-body Airbus A321-type aircraft. "The project includes construction of a terminal building spanning an area of 20,000 sqm capable of handling 1,000 Peak Hour Passengers (PHP) with annual capacity of 2 Million Passengers Per Annum (MPPA), Runway 11/29 of dimensions 3200m x 45m, Apron with 07 parking bays for A321 type aircraft, two Link Taxiways, ATC cum Technical Block, Fire Station, car park and allied works," the release said. Vaishnaw said the airport will significantly improve regional connectivity and promote the local economy. AAI will fund the project through its internal accruals and is expected to be completed in 24 months. The new airport will be coming up around 23 kilometres away from the existing airport, Vaishnaw said. According to the release, the existing Kota airport is owned by AAI but cannot be developed for commercial operations due to inadequate land availability and urbanisation around the airport. The existing airport has a "runway (08/26) of dimensions 1220 m x 38 m, suitable for Code 'B' aircraft (such as DO-228), and an apron capable of accommodating two such aircraft. The terminal building spans an area of 400 sqm and is capable of handling 50 passengers during peak hours," it added. Kota, situated on the banks of the Chambal River, is recognised as Rajasthan's industrial capital and is also known as the educational coaching hub of the country. "Kota's prominence in educational and industrial sectors makes the Greenfield Airport a critical infrastructure project, aimed at addressing the anticipated traffic growth in the region," the release said. In the last 11 years, Vaishnaw said the number of operational airports in the country has more than doubled to 162 in 2025 from 74 in 2014. Also, the number of air passengers has increased to 41.2 crore this year from 16.8 crore in 2014, he added.
