Government announces start date for driving licence demerits
The national implementation of the long-delayed system was gazetted on Friday when President Cyril Ramaphosa signed the proclamation.
The first phase will be rolled out on December 1 in 69 municipalities, with the remaining 144 municipalities to follow on April 1 2026.
The demerit points system comes into effect countrywide on September 1 2026.
The points demerit system is not operational yet anywhere in the country, including in Johannesburg and Tshwane where Aarto has been piloted for more than 12 years.
Aarto is the government's plan to replace the existing criminal system with an administrative one. With Aarto, drivers will lose points for offences and face suspension or cancellation of their licences if they lose too many, in addition to any fine.
The controversial act, originally passed into law in 1998, has been delayed numerous times and affected by legal disputes.
In July 2023 the Constitutional Court ruled in favour of the government's plan to introduce a demerit system for traffic offenders, overturning an earlier high court ruling that had declared Aarto unconstitutional and invalid.
The challenge was brought by the Organisation Undoing Tax Abuse (Outa), an outspoken critic of Aarto which said the new system, rather than improving road safety, would impose an undue burden on motorists, especially those who rely on driving for their livelihoods.
Outa and the AA both argued that the new law would make it easier for authorities to make money from traffic fines but won't rid the roads of dangerous drivers without proper enforcement, an area where traffic authorities have failed given the country's appalling road safety record. South Africa's road deaths average more than 10,000 a year and the cost of road crashes to the economy topped R1-trillion over the past seven years.
The government maintains Aarto will be a vital tool in strengthening laws for road traffic compliance and making roads safer. It replaces the country's fragmented traffic enforcement, with different municipalities having their own bylaws.
The core of Aarto is a demerit system where points are allocated for infringements, which will lead to driver's licence suspension or cancellation if too many points are accumulated.
The act aims to streamline the process for adjudicating road traffic infringements by replacing courts with the Road Traffic Infringement Authority (RTIA), which is now responsible for managing the process. Aarto also allows for electronic service of notices and documents, establishing an appeals tribunal to hear appeals against decisions of the RTIA and removes the option of electing to be tried in court for an infringement.
RTIA spokesperson Monde Mkalipi said: 'Aarto looks at promoting a culture of voluntary compliance, [where drivers] are ... mindful there will be consequences if they fail to change their behaviour. And these consequences are going to happen faster in that your licence will be suspended or taken away, and you'll not be able to drive.'

A day before the tariffs took effect, South African President Cyril Ramaphosa and President Donald Trump held a phone conversation in a last-minute effort to address the dispute. According to a statement from the South African Presidency, the two leaders committed to 'further engagements', with respective trade negotiating teams set to continue detailed discussions in the weeks ahead. However, no immediate resolution was reached. 'The two leaders undertook to continue with further engagements, recognising the various trade negotiations the US is currently involved in,' the statement read. At the centre of the tensions are US demands that South Africa abandon certain post-apartheid economic laws aimed at redressing racial inequality. These demands have drawn a strong rebuke from the African National Congress (ANC), South Africa's ruling party. 'They want us to do away with certain policies. It is not going to be possible,' said Fikile Mbalula, the ANC's secretary-general, during a press briefing in Johannesburg. 'If it means we are going to suffer through sanctions as leaders of the ANC, let it be. We will never back imperialists to subvert our democracy, to subvert our sovereignty.' The ANC, which lost its outright parliamentary majority in 2024 for the first time in 30 years, is now governing in coalition with nine other parties. Despite this shift in political dynamics, the party remains firm in its stance against foreign pressure to alter its transformative economic policies. Relations between Pretoria and Washington have deteriorated sharply since Donald Trump's return to office in January 2025. A VIEW OF THE WEEK: When will the ground fall beneath us?
The war against illegal mining has been lost when communities are now battlegrounds that could give in at any time. Three years ago this week, President Cyril Ramaphosa told the nation his government had declared war on illegal mining – but we are still just minutes from disaster. Illegal mining had been an issue for decades prior to his promise of a new special task team to fight zama zamas, but was forced by the gang rape of eight women near a mine dump in Krugersdorp that had stoked international outrage and protest. Women, who will this weekend honour the heroes of 1956 who fought for equality and liberation, took to the streets to plead for protection from illegal miners who target them. A call that largely fell on deaf ears. There has been action by the government, like Ramaphosa deploying the military in 2023 and the police's harsher hand with miners in Stilfontein last year. However, the problem persists with reports this week that more than 1 000 miners have been arrested in Mpumalanga so far, with the police in another tense stand-off that will no doubt have human rights bodies rushing to court. Children and women at risk Many of those underground were reportedly underage, which shows the scope of the problem, especially when their activities affect those the same age as them. According to the Gauteng education department, 13 schools in the province have been placed on rehabilitation programmes in fear of their collapse. So, as a solution, children are taught environmental education and first aid to detect and then respond to a possible disaster, like the ground falling out from under them. Where math, science, and language learning should be the priority, lessons on basic survival now dominate. And the dangers go beyond the classroom, with children and women at risk of being shot at any time by warring factions of zama zamas. While formalising and regulating the practice may slow down the infection, turf wars and mass arrests show the cancer of illegal mining has already spread too far. The war against illegal mining has gone beyond political speech, army deployment, police resistance, and economic misdirection, when communities are battlegrounds that could give in at any time. No looking the other way when your neighbour is involved, no glamorising the 'jobs' they create, no putting the lives of illegal miners over law-abiding citizens, no more red tape that prevents arrests and prosecutions when a miner crosses the border. No more shielding high-profile individuals whose fingerprints are all over the illegal mining practice, and no more excuses. Central to this is political will, accountability, and a clear mutual plan across the region. A unity that is seldom, if ever, seen. Don't hold your breath waiting for this from those who are out for their own interests, but maybe do plug your nose for the impending plunge below. ‘Don't give us ridiculous conditions': EFF and MK party invited to join Government of National Unity

Earlier this week, IOL reported that as the ANC intensifies work to expand the size and reach of the GNU by adding more parties to the coalition currently governing South Africa, opposition party ActionSA insists it is not interested in joining the ruling arrangement. Leader of ActionSA, Herman Mashaba said so far, he has only heard from media reports that the ANC wants to approach ActionSA for negotiations around GNU inclusion, but his party has not heard a word from Luthuli House. One of the main political parties in the GNU, the Democratic Alliance (DA), strongly opposes expanding the ruling coalition. However, Masina said the ANC insists that, as the leader of the pact, the time has come to press the reset button. 'This GNU is led by ourselves. The DA will have to accept that we are resetting the button. We are bringing others who will be prepared to subscribe. What we will not accept are conditions, because previously we were given ridiculous conditions which we could not accept, which is why other parties are not necessarily part of the GNU,' the former mayor of Ekurhuleni spoke to broadcaster Newzroom Afrika. With the upcoming local government elections, Dlamini-Zuma stressed that the ANC should prioritise strengthening its branches and delivering services to communities. Service delivery remains a challenge in South Africa. This includes inadequate infrastructure, insufficient resources, and issues of maintenance and accountability. Dlamini-Zuma highlighted the importance of building strong branches. "Our branches must be built properly because the strength of the branch is what they do in the community… We are going to the local government elections, and we should be concentrating on that right now." In 2017, Dlamini-Zuma lost the battle to become the ANC president to Cyril Ramaphosa, who won with 2,440 votes. Dlamini-Zuma got 2,261. However, under Ramaphosa, the party lost its parliamentary majority in a historic election result that put South Africa on a new political path, in which the ANC was forced to form the Government of National Unity (GNU) with the DA and other small parties.
