Student loan borrowers struggle to pay, get answers as debt collections begin: "We're kind of drowning"

The Department of Education says federal student loan borrowers who do not pay on time could damage their credit scores and even have their wages garnished beginning today, May 5 — causing challenges for some of the more than 5 million borrowers who are in default and struggling to get answers about their loans.
"I don't think anyone takes out a loan with the intention of not paying it back. It's how easily you can pay it back, that's the problem," said Jana Heartwood, who owes more than $40,000 in student loans from her nursing degree.
"We're kind of drowning as it is," she said.
Two years ago, Heartwood's son was born with a medical condition, and to treat it, Heartwood exhausted her savings and took out money from her 401K.
During the pandemic, student loan payments were put into forbearance, but when repayments resumed last year, Heartwood said she was never notified.
After hearing of the agency's collection decision from a news report, Heartwood checked her account and said she was shocked.
"I had no idea that my loans were delinquent at that point … I checked every email. I got statements that had a zero on it," she said.
Persis Yu, an expert in student loan law, said steep job cuts at the Education Department, and steps to dismantle it, have left the loan system in disarray.
"Borrowers cannot get answers from their servicers," said Yu. "Many of the services have hours-long call wait times in order to get just a simple answer about, 'How much do I owe? How do I pay my loan?'"
After hours on the phone, Heartwood still had no clear answer on her loans, saying she can't afford to pay anything back right now.
"It's not easy. Every week is hard," she said. "Every paycheck is immediately gone. It's gone before we even, you know, have it."
The Department of Education's Office of Federal Student Aid (FSA) is restarting collections on defaulted federal student loan on Monday, as a new analysis shows that delinquency rates are higher than ever.
Yu said there are no provisions that take into consideration when families have extraordinary circumstances, like having to pay for the medical care of a loved one.
"It's an impossible standard for so many to meet and that's why so many borrowers do fall into default," she said.
The Department of Education under President Trump blames the Biden administration. It told CBS News that because of "attempts to transfer student debt to every taxpayer, the student loan portfolio is in a dire financial state."
Student loan pause and future payments
Student loans payments and interest accruals were paused in March 2020 by President Trump during the COVID-19 pandemic. Former President Joe Biden extended the halt of payments multiple times before they resumed in October 2023.
The Biden administration sought to eliminate some student debt but faced multiple legal challenges from the courts, including a 2023 ruling from the Supreme Court. During the Biden administration, more than 5 million borrowers had their debt erased through various initiatives.
GOP lawmakers recently introduced legislation to overhaul the student loan repayment program, which includes eliminating the SAVE plan, created by the Biden administration in 2023.
"Going forward, the Department of Education, in conjunction with the Department of Treasury, will shepherd the student loan program responsibly and according to the law, which means helping borrowers return to repayment — both for the sake of their own financial health and our nation's economic outlook," Education Secretary Linda McMahon said in a statement last month, adding, "There will not be any mass loan forgiveness."

The Commerce secretary's comments come just under two weeks after President Trump called on Intel CEO Lip-Bu Tan to resign. The president accused Tan of being 'highly conflicted' following Sen. Tom Cotton's (R-Ark.) letter to the company, voicing concerns about the CEO's investments in Chinese companies and his previous role at Cadence Design Systems. The software firm recently pleaded guilty to violating export controls by selling chip design technology to a Chinese military university during Tan's tenure. However, Trump changed his tone after meeting with Tan last week, and reports began emerging that the administration was considering taking a stake in the company. 'The meeting was a very interesting one. His success and rise is an amazing story,' Trump said in a post on Truth Social. 'Mr. Tan and my Cabinet members are going to spend time together, and bring suggestions to me during the next week.' Lutnick pointed to the administration's national security concerns about chip production as he discussed the potential stake Monday. 'We cannot rely on Taiwan, which is 9,500 miles away from us and only 80 miles from China,' he said. 'So, you can't have 99 percent of leading-edge chips made in Taiwan. We want to make them here.' 'One of those pieces is it would be lovely to have Intel be capable of making a U.S. node or a U.S. transistor, driving that in America,' Lutnick added. 'That would be lovely. That's not necessary. ONE Asks Federal Maritime Commission to Dismiss QVC and Cornerstone Complaint

Ocean Network Express (ONE) has asked the Federal Maritime Commission (FMC) to dismiss a complaint brought against it by QVC and Cornerstone, filed in June. The companies alleged that ONE violated the Shipping Act of 1984 by breaching its contract with them. They alleged that despite having pre-contracted space on ONE cargo ships, the shipping company decided to allocate that space to other clients who were willing to pay higher spot rates for the cargo space, in turn causing delays in QVC and Cornerstone's ability to ship goods as promised and requiring them to pay higher rates to bring their cargo to the final destination. QVC said because of that alleged shortfall, it had to pay higher prices from alternative carriers at higher rates, which it stated cost more than $7.7 million during the 2021-2022 shipping year. For its part, Cornerstone said ONE 'carried only approximately 42.4 percent of its service commitment under the Service Contract, for a shortfall of at least 662 FEUs—57.6 percent less than committed,' which allegedly saw the company paying nearly $10.5 million to ship goods overseas with another carrier. According to the complaint, ONE allegedly sought to capitalize on higher freight prices brought on by the Covid-19 pandemic, in turn 'allocating space to the highest bidder also contributed to the inflationary spiral in container rates by artificially increasing demand.' After receiving an extension from the FMC, ONE filed its response to the complaint on Thursday. In its response, it denied any liability and asked that the FMC dismiss the complaint. In its response, ONE also asserted affirmative defenses, by saying that the FMC lacks jurisdiction over the complaint because it's a contract issue; noting that it believes QVC and Cornerstone have not made adequate claims to prove that ONE is in violation of the Shipping Act and claiming that the companies, if they ever had one, lost their right to pursue legal action against ONE because they acted with unclean hands. Those defenses are merely a few in a list of many such defenses, which also see ONE blaming others for any illegal conduct that may have occurred, though it has denied that it acted illegally at all. 'Any damages sustained by the complainants, as alleged in the complaint, were proximately, directly and solely caused by the acts or omissions of others for whom Respondent is not responsible,' attorneys for ONE wrote in the company's response. 'The complainants' damages, if any, were caused by complainants', or its agents' own acts or omissions beyond the control of [ONE].' The argument that any damages came from third parties or from QVC and Cornerstone itself are the linchpin of ONE's affirmative defenses, but the slew of such defenses taken together, ONE contended, preclude the companies' allegations from the hearing they requested in the complaint. QVC did not immediately return Sourcing Journal's request for comment on ONE asking the FMC to dismiss the initial complaint.
