HC asks Bengal migrant to appear after he returns from Bangladesh

A day after 19-year-old Bengali migrant Amir Shiekh, who was detained by the Rajasthan Police in June and later pushed into Bangladesh, returned to India on Tuesday, the Calcutta High Court on Wednesday told his family to 'bring back the son first' before it will hear the matter. Amir's father Jiyem Shiekh had moved the Calcutta High Court last week seeking judicial intervention to bring his son back. While the state government and the Centre submitted their respective reports, the High Court upon hearing that Amir was brought back, observed, 'Bring back your son first, we will hear the matter.' Amir's counsel, on Wednesday, told the Division Bench of Justice Tapabrata Chakraborty and Justice Reetobrata Kumar Mitra that a copy of Amir Sheikh's birth certificate was enclosed with the petition, maintaining that he is a citizen of India and was a resident of Kaliachak in Malda district. 'The grandparents of Amir Shiekh has Indian passport, he has school certificates and all documents. They have not seen anything but they had just pushed him into Bangladesh. Prior to that he was tortured in Rajasthan. Now we are being told that the Border Security Force (BSF) have brought him back.' Deputy Solicitor General (DSG) Rajdeep Majumder, appearing for the MEA and the BSF told the court that Amir had attempted to cross over to Indian territory from Bangladesh on August 12. As he could not produce appropriate documents as regards his identity, he was apprehended and handed over to the officer-in-charge, police station-Basirhat, by the BSF. But no formal case has yet been registered against Amir, he added. He submitted that if the petitioner approaches the police authorities, Amir would be handed over to the petitioner subject to production of all necessary records and upon execution of undertaking, if any. TMC MP Samirul Islam posted on X, 'This evening, Amir Sheikh was handed over to his family from the Basirhat police station. Nearly a month after being unlawfully pushed back to Bangladesh by the BSF, Amir is happy to be back on Indian soil — and his family is equally happy to have him home.' While he questioned the authorities' claims regarding Amir Sheikh's deportation, he posted, 'Amir Sheikh was deported to Bangladesh by the Rajasthan Police with the help of the BSF… we stood by his family.. helped Amir's father filed a Habeas Corpus petition in the Calcutta High Court. Under this pressure, the BSF has brought Amir back to West Bengal. The BSF has already handed him over to the Basirhat Police. Today, the court has asked the police to hand over Amir to his father. Yet strangely, they are now claiming that Amir was never deported! Then what happened? How did he end up in Bangladesh?' 'Don't worry—they have another explanation. They claim Amir 'inadvertently' went to Bangladesh on his own!…The same BJP leaders who scream that hordes of infiltrators are flooding India from Bangladesh now want us to believe that Amir willingly crossed… into that very country through illegal routes! Do they have no sense of shame? Or do they simply think the people of Bengal are fools? If it's the latter, let me tell you, anti-Bengal forces — Bengal's people will give you a fitting lesson. How much lower will you stoop?' he said.

Ganesh Mandals asked by CM to have ‘Operation Sindoor' as theme this year

MUMBAI: Chief Minister Devendra Fadnavis on Wednesday asked Ganesh Mandals in the state to have 'Operation Sindoor' as the theme for this year's pandals. He said the country has shown its strength to the world through this operation; hence, it needs to be showcased by the Ganesh Mandals to create awareness during the festival this year. Devotees carry an idol of Lord Ganesh for visarjan (immersion) in Mumbai. The 10-day long festival will end on Monday. (Kunal Patil/HT photo) The CM's urge comes at a time when the opposition has been blaming the PM Modi government for using 'Operation Sindoor' for their political benefit. 'The Ganesh Mandals should use this year's Ganpati Festival to create awareness about the strength India showcased to the world through 'Operation Sindoor' and the importance of using Swadeshi (indigenous) products,' Fadnavis said. 'The mandals should also display tableaux based on 'Operation Sindoor', dedicated to the soldiers.' He had called a high-level meeting on Wednesday to review security and other arrangements for Ganesh Chaturthi celebrations that begin on August 27. Fadnavis appealed to the mandals to coordinate with the administration to celebrate the festival in an atmosphere of peace and enthusiasm. He then directed the Brihanmumbai Municipal Corporation (BMC) to grant a five-year permission to the sculptors involved in making Ganesh idols. 'Though their licenses will have to be renewed every year through the single-window system BMC had started,' he stated. He further instructed the BMC to increase the number of artificial lakes for immersion of idols and to add more boats along the seashore for immersing tall idols in deep waters. The state government has given Ganesh Chaturthi the status of a state festival, the CM said. Therefore, the state is implementing extensive planning to celebrate it on a large scale. All concessions provided to the Ganesh Mandals last year will also continue this year. 'While celebrating, proper adherence to the law must be ensured. Since Eid-e-Milad will also be observed during Ganesh Chaturthi this year, care should be taken to maintain communal harmony so that law and order are not disrupted anywhere,' he stressed. He also assured he would take steps to extend the permitted days for use of loudspeakers during the festival, as per the court directives. Fadnavis also asked the Ganesh Mandals to submit a written declaration to the BMC administration stating that their offices are not used for commercial purposes. After they do so, no property tax will be levied on their offices.

Centre notifies appointment of Aarti Sathe as HC judge

MUMBAI: The central government on Wednesday notified the appointment of advocate Aarti Sathe, former spokesperson of the Maharashtra BJP, and two others, as judges of the Bombay High Court. Centre notifies appointment of Aarti Sathe as HC judge 'In exercise of the power conferred by clause (1) of Article 224 of the Constitution of India, the President is pleased to appoint (i) Shri Ajit Bhagwanrao Kadethankar, (ii) Shri Sushil Manohar Ghodeswar and (iii) Ms Aarti Arun Sathe, to be Additional Judges of the Bombay High Court, in that order of seniority, for a period of two years, with effect from the date they assume charge of their respective offices,' the notification stated. The Union Ministry of Law and Justice (Appointments Division) issued the notification on Wednesday, a fortnight after the Supreme Court Collegium on July 28 recommended Sathe's appointment, along with the other two judges. Following this, opposition leaders in Maharashtra raised objections to Sathe's appointment, calling her elevation to the judiciary 'the gravest blow to democracy'. The appointment of three new judges has taken the strength of the high court to 69, against a sanctioned strength of 94. 'The appointment of a political figure raises doubts about the entire process of delivery of justice. It also undermines the principle of separation of power ensured by the Constitution,' NCP (SP) legislator Rohit Pawar had said, and demanded that the decision be reconsidered. Sathe said she had already resigned from the party, while the Maharashtra BJP pointed out that such an appointment had taken place during the Congress regime too. 'I had resigned from all political posts long before this. So that settles it. I don't want to respond to anything else,' said Sathe. The Congress's state unit president Harshwardhan Sapkal said that if someone who held an active position in a political party was appointed as a judge, her judgments could not be impartial. 'Democracy and the Constitution have been systematically sidelined in the country since 2014,' said Sapkal. 'All autonomous institutions are operating under government directives, even the Election Commission of India. But the most serious and worrying development is within the judiciary itself.' Responding to the controversy, the BJP said Sathe had resigned as party spokesperson from the post on January 6 last year, and had posted her resignation letter on social media. Sathe's legal practice has largely been in the field of direct and indirect taxes. She is an alumna of Government Law College, Mumbai. Her father, Arun P Sathe, is a BJP worker with an RSS background. He was BJP in-charge of the eastern region of Uttar Pradesh and was also associated with the Akhil Bharatiya Vidyarthi Sena. Arun Sathe had unsuccessfully fought the Lok Sabha election as a BJP candidate in 1989, from Mumbai North-West constituency, against the Congress's Sunil Dutt. He is the elder brother of former Lok Sabha Speaker Sumitra Mahajan. A similar controversy took place when the central government appointed Arun Sathe to the board of the Securities and Exchange Board of India (SEBI) in August 2015.
