Wayanad landslides: HC quashes case against two persons for comments against CMDRF donations

Kochi: Tackling people expressing dissent or criticism through criminal cases is an affront to the democratic values enshrined in the Constitution, high court has held. Justice V G Arun delivered the ruling while quashing a criminal case and further proceedings against V S Gowri Sankari of Thiruvananthapuram and U Prasant Bellulaya of Kasaragod, accused of posting negative comments in a WhatsApp group about the solicitation of contributions to the chief minister's distress relief fund (CMDRF) for the rehabilitation of Wayanad landslide victims. The Bakal police had booked the petitioners under Sections 192 (wantonly giving provocation with intent to cause a riot) and 45 (assisting or encouraging another person to commit a crime) of BNS, Section 51 of the Disaster Management Act, 2005, and Section 120(o) (causing nuisance to any person by repeated or undesirable communication) of the Kerala Police Act. HC observed that the mere fact that comments are unpalatable to some people, or even to the govt, is no reason to initiate criminal prosecution. The remarks, though critical of the govt, were within the bounds of law. Finding the comments to be fair criticism, HC held that continuing the prosecution would amount to an abuse of process of law and a violation of the freedom of speech and expression guaranteed by the Constitution. The bench further noted that the comments referred to alleged misutilisation of donated funds and criticised the political party in power. Assuming that such remarks could incite a riot or cause nuisance was "preposterous", HC said. It also observed that the govt's request for contributions could not be treated as a 'direction,' and therefore, cautioning WhatsApp group members before making donations would not amount to refusal of a direction under Section 51 of the Disaster Management Act. Vacate govt bungalow, pay Rs 46L dues, activist tells former Maharashtra minister Munde

Mumbai: Social activist Anjali Damania on Wednesday demanded that former Maharashtra minister and NCP MLA Dhananjay Munde vacate his official bungalow in Mumbai within 48 hours and claimed he owes Rs 46 lakh to the state government for using the residence. Damania warned if Munde fails to vacate the bungalow, 'Satpuda', and pay Rs 46 lakh in pending dues, she will send a legal notice to the state government. "Munde had claimed earlier that he did not own a house in Mumbai, but his 2024 election affidavit mentions a flat at Girgaum Chowpatty which is currently not in use. It is, therefore, wrong for him to continue occupying the official bungalow. He should also pay the full rent amount of Rs 46 lakh," she told reporters here. Munde's resignation in early March came in the backdrop of the arrest of his key aide in connection with the chilling murder of a village sarpanch in Beed district in December. Munde had previously said he could not leave the bungalow as he did not have another place to stay in Mumbai. However, Damania pointed out that the NCP leader's 2024 election affidavit referred to a flat in a building named 'Virbhavan', measuring 2,151 square feet, which appeared to be a four-bedroom apartment. The activist argued that as per law, Munde must vacate the government bungalow immediately as he is no longer a cabinet minister. Damania said she would send a legal notice to the state government over the issue. If Munde failed to comply within 48 hours, she said she would question the government's inaction and press for recovery of the dues along with his eviction from the bungalow. Sources close to the former state minister maintained that his current home in Mumbai is under renovation and hence he has requested the government to allow him to stay in the official bungalow till the work is completed. Minta Devi, face of Congress' T-shirt protest against ‘vote chori', fumes: ‘Who gave Rahul Gandhi the right…'

'Vote chori' row: Minta Devi, a woman from Bihar's Siwan district, hit out at Rahul Gandhi, Priyanka Gandhi, and other INDIA bloc MPs for wearing t-shirts featuring her during 'voter theft' protest at Parliament House on 12 August. She angrily asked who gave them the right to do so while dismissing the opposition's use of her name and age for political motives. "I came to know about this 2-4 days back... Who are they (Opposition MPs) to me? Who is Priyanka Gandhi or Rahul Gandhi to me? Who gave them the right to wear T-shirts featuring me?... I think there are discrepancies (in the list)... I did not get anyone's (from the administration) phone call... Why are they becoming my well-wisher over my age?... This should not be done, I do not want this..." Minta stated. She added, 'I want my details to be corrected... Whoever entered the details, did they do so with their eyes closed?... If I am 124 years old in the eyes of the government, why are they not giving me old age pension? My Aadhaar Card mentions 15-07-1990 as my date of birth." The INDIA bloc MPs wore '124 Not Out' t-shirts with her name to showcase errors in the electoral roll and alleged discrepancies in the voter list. She was named Gandhi's presentation on the alleged vote theft issue. Her alleged age is nine years more than Ethel Caterham, 115, the verified oldest person in the world. Minta, 35, further mentioned that if the government considers her age as 124-years-old, they should begin offering the benefits of an old-age pension to her. She has reportedly been registered on the state's voter list, marking her first time on the electoral roll despite being eligible to vote for several years. Minta declared her birthdate as July 15, 1990, and submitted the necessary documents to support her application for enrollment. In poll-bound Bihar, there have been widespread protests over the revision of the voter list, with parties from the INDIA bloc accusing the Election Commission of India (ECI) of working in favour of the ruling BJP by selectively deleting voters' names to benefit them. The ECI has firmly denied these accusations, asserting that the revision of the voter rolls was carried out with complete transparency.
