Failure To Lower Flag After Sunset 'Lapse, Not Disrespect': Kerala HC Quashes Case Against Official

A Kerala civic official's failure to lower the National Flag after sunset did not constitute a criminal offence, the Kerala High Court recently held, quashing a nine-year-old case that had snowballed into a prosecution under national honour laws. Vinu C Kunjappan, who served as Secretary of the Angamaly Municipality in Ernakulam district, was facing trial for allegedly violating the Prevention of Insults to National Honour Act, 1971 and the Flag Code of India, after the Tricolour remained hoisted on municipal premises for nearly two days following the 2015 Independence Day ceremony. The flag was hoisted on the morning of August 15 but remained flying until noon on August 17. A suo motu FIR was registered by the local police, triggering proceedings in the Judicial First Class Magistrate Court at Angamaly. The allegation was that the official's failure to lower the flag in time amounted to disrespect. But Justice Dr Kauser Edappagath of the Kerala High Court, while deciding a plea to quash the case, found no material to suggest any criminal intent. 'Mere lapse or inaction cannot be equated with insult," the court said, adding that no provision in the 1971 Act criminalised such conduct unless it was done wilfully with the intent to insult national honour. Court noted that while the Flag Code requires the National Flag to be lowered at sunset, it is not a statute and cannot attract penal action on its own. The Code, the judge observed, is a set of executive instructions, and violating it is not automatically an offence unless backed by a specific legal provision. Crucially, the court observed that none of the instances listed in the Act's definition of 'disrespect", such as burning, mutilating, or dragging the flag, applied in this case. There was no evidence that the accused intended to offend or undermine national symbols. Kunjappan's petition succeeded on the ground that the allegations, even if accepted entirely, did not establish the basic ingredients of the offence. Failure to lower National Flag after sunset not an act of gross affront: Kerala HC
Kochi: High court has held that a mere lapse or inaction in not lowering the National Flag after sunset cannot be regarded as an act of gross affront, indignity, or insult to the flag. Justice Kauser Edappagath made the ruling while allowing a petition by Vinu C Kunjappan, a former secretary of Angamaly municipality, seeking to quash a criminal case against him for allegedly dishonouring the National Flag. The allegation was that, during his tenure as secretary, he failed to lower the National Flag hoisted in the municipal office compound on Aug 15, 2015, and that it remained hoisted even two days later. Angamaly police had suo motu registered a case under Section 2(a) of the Prevention of Insults to National Honour Act, 1971, read with Part III, Section III, Rule 3.6 of the Flag Code of India, 2002. Perusing the petition, HC noted that to attract Section 2 of the Act, a person must burn, mutilate, deface, defile, disfigure, destroy, trample upon or otherwise show disrespect to or bring into contempt the Indian National Flag or the Constitution of India, in any public place or within public view. The court held that the act of not lowering the National Flag after sunset does not fall within any of the acts listed in Section 2. Further, prosecution had no case that this omission amounted to a gross affront or indignity to the National Flag. In the absence of any deliberate or intentional act, HC held that Kunjappan's conduct could not be considered a punishable offence under the law. Similarly, the Flag Code of India, 2002, contains executive instructions issued by the central govt and, therefore, does not qualify as "law" within the meaning of Article 13(3)(a) of the Constitution. It serves as a model code of conduct, which is expected to be compulsorily followed by all citizens, but penal consequences cannot be invoked unless there is a specific statutory provision providing for such punishment. Accordingly, HC quashed the case and all further proceedings against the petitioner.

"India and the Philippines are friends by choice and partners by destiny. From the Indian Ocean to the Pacific, we are united by shared values. Ours is not just a friendship of the past, it is a promise to the future," Modi said. The PM said the Philippines is an important partner in India's Act East Policy and 'MAHASAGAR' vision. "We are committed to peace, security, prosperity and a rules-based order in the Indo-Pacific region. We support freedom of navigation in accordance with international laws," Modi said. Ministry of External Affairs (MEA) spokesperson Randhir Jaiswal said that India and the Philippines share close bonds based on the foundation of civilizational connections. Earlier in the day, Marcos Jr. was accorded a ceremonial welcome at the Rashtrapati Bhavan on Tuesday during his maiden State Visit to India. He was received by President Droupadi Murmu and Prime Minister Modi. The MEA stated that Marcos Jr. was presented with a Guard of Honour as part of the ceremonial welcome. "A special welcome for a special partner! President Ferdinand Romualdez Marcos Jr of the Philippines on his maiden State Visit to India was welcomed by Guard of Honour & ceremonial welcome.
