ICC prosecutor asks tribunal to dismiss Duterte's challenge of jurisdiction
The Office of the Prosecutor of the International Criminal Court has asked the tribunal to dismiss former President Rodrigo Duterte's challenge to the ICC's jurisdiction over his case.
Duterte is now detained in the The Hague Penitentiary on charges of crimes against humanity in connection with the killings under his war on drugs when he was mayor of Davao City and when he was president of the Philippines.
"Irrespective of the interpretation of articles 11 to 13, article 127(2) can only be correctly interpreted to preclude a withdrawing state party depriving the court of the exercise of its jurisdiction, if such a matter is already under consideration before the withdrawal becomes effective," the prosecution's submission dated June 10 and signed by deputy prosecutor Mame Mandiaye Niang.
"In this case, the prosecutor's initiation of a preliminary examination was sufficient for this purpose, both as a matter of law (given that a preliminary examination is a statutory proceeding, which is a precondition to opening an investigation) but in any event in the particular circumstances," it added.
"For all the reasons above, the challenge should be dismissed, and the court's exercise of jurisdiction over Mr Duterte should be affirmed," the prosecution said.
Article 127 (2) of the Rome Statute, which governs the ICC, reads, "A State shall not be discharged, by reason of its withdrawal, from the obligations arising from this Statute while it was a Party to the Statute, including any financial obligations which may have accrued."
"Its withdrawal shall not affect any cooperation with the Court in connection with criminal investigations and proceedings in relation to which the withdrawing State had a duty to cooperate and which were commenced prior to the date on which the withdrawal became effective, nor shall it prejudice in any way the continued consideration of any matter which was already under considerationby the Court prior to the date on which the withdrawal became effective."
According to Duterte's lawyers, the preconditions for the exercise of jurisdiction in the situation of the Philippines were not met at the time the pre-trial chamber authorized the opening of an investigation on September 15, 2021.
"The Philippines' withdrawal from the Rome Statute became effective on 17 March 2019. When the former Prosecutor filed her request, and the pre-trial chamber issued its decision, more than two years later," Duterte's camp said in its submission.
"As a consequence, all procedural steps taken in the Situation and, subsequently, in the case against Mr Rodrigo Roa Duterte, lack legal foundation and should be nullified forthwith," it added.
The prosecution said that Duterte's defense said that the Rome Statute made the ICC's jurisdiction conditional not only on the Philippines' status as a state party when the alleged crimes were committed but also when the tribunal's exercise of jurisdiction was triggered according to Article 13(c) of the Statute.
The defense added that Article 127(2) allowed the court to be deprived of jurisdiction by a withdrawal in the present circumstances.
"The chamber should reject both defense arguments, which misinterpret the relevant provisions of the statute, and find that the court lawfully exercises jurisdiction over Mr. Duterte," the prosecution said.
The ICC's Office of the Public Counsel for Victims has also asked the tribunal to dismiss former President Rodrigo Duterte's challenge regarding the tribunal's jurisdiction.

ICC Principal Counsel Paolina Massida pointed out that the Philippines' withdrawal has no legal effect as the prosecutor's preliminary examination started even before the withdrawal took effect.
'The preliminary examination conducted by the Office of the Prosecutor in the Situation in the Republic of the Philippines must be considered as 'a matter' that was 'already under the consideration of the Court' prior to the date on which the State's withdrawal became effective and thus the Court may exercise its jurisdiction over the case against Mr Duterte,' according to the 27-page document dated June 9. –NB, GMA Integrated News

Vice President Sara Duterte has asked the Supreme Court (SC) to dismiss the House of Representatives' (HOR) appeal on its ruling that declared the impeachment complaint against her unconstitutional. In her comment, Duterte said the House's arguments were 'mere diversions obsessed with trivia and blind to the decision's genuine core reasoning.' 'This fixation on peripheral details downplays the legitimate issue in this case, namely, that the HOR committed grave abuse of discretion and deliberately did away with constitutionally imposed limitations to its power to impeach,' the comment said. Three impeachment complaints were filed against Duterte in December 2024, all of which were connected to the alleged misuse of confidential funds. It was the fourth impeachment complaint that was endorsed by over one-third of lawmakers from the House of Representatives and was later transmitted to the Senate as the Articles of Impeachment. In its July 25, 2025 ruling, the SC said the first three complaints were deemed terminated or dismissed when the House endorsed the fourth complaint. It ruled that the one-year ban on multiple impeachment proceedings is reckoned from the time a complaint is dismissed or is no longer viable. As a result, the SC said the Senate did not acquire jurisdiction over the impeachment proceedings. The House filed the motion for reconsideration a day before the Senate archived the impeachment complaint in light of the SC ruling. The House argued that the archiving of the first three complaints was done after the transmittal of the fourth complaint, thus not initiating the one-year ban. Duterte said that while this is true, it is misleading to suggest that the court based its ruling on a misapprehension of the sequence. Aside from this, she said that the SC did not err when it said that the fourth impeachment complaint was transmitted to the Senate without a plenary vote. 'A perusal of its own Rules on Procedure in Impeachment Proceedings betrays the HOR's assertions. A plain reading of Rule II, Section 2 thereof, reveals that even the second mode of impeachment requires a subsequent referral to the Committee on Justice,' she said. Duterte said that it was 'more absurd' for the House to claim that the first three impeachment complaints were not dismissed even after the transmittal of the fourth complaint, as the House still had numerous session days ahead. 'This contention collapses under the weight of its own logic and the HOR's own record. The archival of the first 3 prior impeachment complaints on February 5, 2025, after it had already decided to push forward with its preferred fourth impeachment complaint, was a deliberate act of disposition by the HOR itself,' she said. 'Whether the adjournment of that session was temporal or sine die is immaterial. The fact remains that the respondent HOR, by its own doing, formally set those complaints aside.'' The vice president said the arguments presented by the House have all been thoroughly considered and resolved by the high court. Duterte also said that the argument of the House that a new ruling on impeachment cases should be applied prospectively is wrong. "Jurisprudence dictates that prospectivity shields those outside the case from what might be unfair consequences for them. It does not grant blanket amnesty to the parties whose conduct is precisely found to be constitutionally void, as in this case," she said. Sara Duterte's lawyers file comment on House impeachment MR
The defense team of Vice President Sara Duterte has submitted a comment regarding the motion for reconsideration filed by the House of Representatives before the Supreme Court (SC) to reverse its decision junking the impeachment case. This was confirmed by Atty. Michael Poa, noting that the comment or opposition of Duterte's defense team was filed before the SC on Monday afternoon. 'In deference to the sub judice rule and out of respect for the judicial process, we will not be granting media interviews or issuing further statements at this time,' Poa told reporters. GMA News Online is trying to secure a copy of the defense's comment/opposition and will update this story once available. To recall, the high court declared the articles of impeachment against Duterte unconstitutional, stressing that it is barred by the one-year rule under the Constitution and that it violates her right to due process. The SC, however, said it is not absolving Duterte from any of the charges against her and that any subsequent impeachment complaint may be filed starting February 6, 2026. The House of Representatives, through the Office of the Solicitor General, filed a motion for reconsideration seeking to reverse the SC decision. The House argued it should be allowed to perform its exclusive duty to prosecute an impeachable official, and the Senate's to try the case. Other motions for reconsideration have also been filed with the SC against its ruling. On August 6, the Senate voted 19-4-1 to transfer to the archives the articles of impeachment against Duterte. The House of Representatives impeached Duterte on February 5, with over 200 lawmakers endorsing the complaint. The Vice President was accused of betrayal of public trust, culpable violation of the constitution, graft and corruption, and other high crimes. The camp of former president Rodrigo Duterte has questioned the jurisdiction of the International Criminal Court (ICC) in handling his case, according to Vice President Sara Duterte. The Vice President made the remark during her visit to the Filipino community in Kuwait on Friday. 'Meron po silang finile yung pag-question ng jurisdiction ng korte sa kaso ni dating Pangulong Rodrigo Duterte. Simple lang ang sinasabi nila.
