Bhubaneswar BJD Corporator Arrested In Rape Case, Suspended From Party
BJD corporator of Bhubaneswar Municipal Corporation (BMC) Amaresh Jena, was arrested from Balasore district on Sunday in connection with a rape case lodged against him in the state capital, police said.
Jena, a prominent BJD leader was booked under the BNS sections 64(2) (rape), 89 (committing miscarriage without woman's permission), 296 (obscene act), and 352 (criminal intimidation), besides section 6 of the POCSO Act, at the Laxmisagar police station, where the survivor lodged a complaint on Wednesday, the police said.
As Jena was not available at his house and possible locations in the city and remained incommunicado, the police formed a special squad and launched a manhunt for the fugitive BJD leader. "Finally, he was located at a village under Berhampur police station limit in Nilgiri area in Balasore and apprehended by the special squad," a police officer said, adding that he was being brought to Bhubaneswar.
A senior officer said that Jena was staying in a village in Nilgiri area, which is close to the forest, with the aim of escaping to the jungle if there was any police raid to apprehend him. However, he could not because the operation was carried out very secretly, the officer added.
Immediately after his arrest, the BJD issued an office order stating that: "Amaresh Jena, Corporator, Bhubaneswar Municipal Corporation, is hereby suspended from Biju Janata Dal with immediate effect."
BJD Bhubaneswar president Ashok Panda told reporters on Sunday that Jena's suspension will not affect the party. "No one is indispensable for BJD. It is party first. I reiterate that law will take its own course."
He said the BJD has acted immediately as soon as Jena was arrested by police. "The BJD stands by its pro-women ideology. Jena's arrest will in no way damage BJD. It is a huge party with thousands of workers and leaders. He is an accused and will go through the legal process," Mr Panda said.
On Saturday night, the police arrested five aides of Jena on charges of harbouring him. The police said the five persons provided conveyance and assisted Amresh Jena in evading arrest.
The five arrested individuals hail from various parts of Khurda and Jagatsinghpur districts, and were forwarded to judicial custody after their bail pleas were rejected, they said.
A 19-year-old woman in a written complaint at Laxmisagar police station had accused the BJD corporator of rape, foeticide, cheating, and criminal intimidation. Jena, while on the run, told a section of the media that he was "innocent" and "framed" by the ruling BJP.
In her complaint, the survivor alleged that the corporator sexually exploited her with the promise of marriage when she was 17 years old. She claims that Jena took her to Puri, engaged in physical relations, and in February 2024, when she was still a minor, forced her to abort a two-month pregnancy by administering pills.
The survivor also alleged that she was threatened and directed not to reveal the matter to anyone. Police have recorded the statement of the survivor, and she also underwent a medical test.
Bhubaneswar police had this week arrested the state president of NSUI, Udit Pradhan, for allegedly raping an engineering student. He has also been suspended from the party.

Shields minors: Centre defends statutory age of 18 yrs for consent in SC
New Delhi, Aug 7 (PTI) The Centre has defended in the Supreme Court the statutory age of consent of 18 years, saying the decision was a 'deliberate, well-considered, and coherent" policy choice aimed at shielding minors from sexual exploitation. The Centre, in its written submissions through Additional Solicitor General Aishwaraya Bhati, argued diluting the age of consent or introducing exceptions under the guise of adolescent romance would be not only legally unsound but also dangerous. The government said it would provide a defence mechanism even to those abusers who exploit a child's emotional dependence or silence. The Centre further said the existing statutory age of consent must be strictly and uniformly enforced. 'Any departure from this standard, even in the name of reform or adolescent autonomy, would amount to rolling back decades of progress in child protection law, and undermine the deterrent character of statutes like the POCSO (the Protection of Children from Sexual Offences) Act, 2012 and the BNS (Bharatiya Nyaya Sanhita)." Moreover, the Centre argued that the discretion on case-to-case basis must remain judicial and must not be read into the statute as a general exception or a diluted standard. 'Introducing a legislative close-in-age exception or reducing the age of consent would irrevocably dilute the statutory presumption of vulnerability that lies at the heart of child protection law. A diluted law risks opening the floodgates to trafficking and other forms of child abuse under the garb of consent," it said. Lowering the age of consent, the Centre said, would open the 'floodgates" to trafficking and other forms of child abuse under the garb of assent. The case before the top court raises the point of age in adolescent relationships. 'The legislative determination to fix the age of consent at eighteen (18) years, and to treat all sexual activities with a person below that age as an offence irrespective of purported consent, is a product of a deliberate, well-considered, and coherent statutory policy," the Centre said. The law does not treat the age limit as arbitrary and rather, it reflects a constitutional and legislative recognition of a minor's vulnerability, especially in a socio-economic context marked by deep inequalities and power imbalances, it added. A child's inability to report or resist is exacerbated when the perpetrator is a parent or close family member, it said, adding in such cases, presenting 'consent" as a defence only victimises the child, shifts the blame onto them, and undermines the very object of POCSO to protect children from exploitation regardless of whether they were 'willing". The existing age of consent ought to be retained in order to give full effect to the legislative intent, protect the bodily integrity of children, and uphold the constitutional and statutory safeguards accorded to them, it said. 'The Supreme Court along with high courts across the country have always maintained the sanctity of legal age of consent as 18 years of age. This statutory yardstick has been upheld on numerous occasions, keeping in view the legislative intent and the pre-eminent constitutional mandate of protecting young children," it said. Earlier, amicus curiae and senior advocate Indira Jaising had urged the bench to read down the statutory age of consent from 18 to 16 years. Jaising, who is assisting the top court in the case, then said the current law criminalises consensual romantic relationships among adolescents and violates their constitutional rights. Fadnavis opposes abrupt closure of 'kabutarkhanas'
Mumbai: Maharashtra chief minister Devendra Fadnavis on Tuesday said "abrupt" closure of kabutarkhanas (pigeon feeding spots) in the city was not advisable, and asked the Brihanmumbai Municipal Corporation (BMC) to ensure controlled feeding of the birds. The chief minister's statement has come amid growing demand for the closure of traditional 'kabutarkhanas' in Mumbai over health risks. Fadnavis, who chaired a meeting on the issue of 'kabutarkhanas' in Mumbai, cited the importance of protecting bird life, safeguarding the environment, and ensuring public health, while making suggestions. Any decisions concerning pigeon-feeding zones must be accompanied by alternative and compassionate solutions to prevent the starvation of birds, he said. The BMC on Tuesday said it has taken action against 142 persons for feeding pigeons at 'kabutarkhanas' across the city and recovered a fine of Rs 68,700 between July 13 and August 3. Fadnavis further said that he had also discussed the issue with former Union Minister Maneka Gandhi. Currently, a writ petition on the issue of 'kabutarkhanas' is being heard in the Bombay HC. PTI
