State government says fresh proposal needed to put Savarkar Sadan on heritage list

The Maharashtra government has informed the Bombay High Court that it will need a new proposal from the Mumbai Heritage Conservation Committee (MHCC) of the Brihanmumbai Municipal Corporation (BMC) to include the Savarkar Sadan, located in Mumbai, in the Heritage List.Savarkar Sadan, the erstwhile residence of Hindutva ideologue Vinayak Damodar Savarkar, served as the venue for meetings but has been in a derelict state and needs much repair. It was being said that the building might be pulled down to give way to a new construction. However, this was opposed by followers of Savarkar.advertisementThe affidavit filed through Additional Government Pleader (AGP) Prachi Tatake, representing the state government, stated that there was a proposal for including Savarkar Sadan in the Heritage List, and it had been considered as well, where the Urban Development Department recommended the government to declare the building as a Grade-IIA structure after following due process in 2009 itself.
The affidavit filed by Deputy Director of Town Planning, Lalit Khobragade, said that, "The contribution by Swatantraveer Shri Vinayak Damodar Savarkar is held in high esteem and with a sense of pride by all the departments of the State Government and that this Respondent will take all necessary and effective steps as are required to deal with the subject of the present Petition with utmost responsibility and while following due process of law."There was much correspondence between various departments of the government on the issue, but all that was lost in June 2012, when a huge fire erupted in Mantralaya, which led to extensive damage to the building and the loss of important government records, including files related to this issue.Now, the Maharashtra government will need a fresh proposal, about which the BMC Commissioner was informed on July 9, stated the affidavit filed by Khobragade.Advocate Oorja Dhond, appearing for the BMC, said that the MHCC held a meeting on July 22 and has decided to send a proposal to the Maharashtra government for the same at the earliest.However, this was opposed by petitioner Pankaj Kumudchandra Phadnis, who is founder-president of an organisation called Abhinav Bharat Congress. The petitioner, an ardent follower and researcher of Savarkar, in his petition seeking Heritage status for the Savarkar Sadan, had sought that the state frame a special policy for compensating the living heirs of Vinayak Damodar Savarkar before including the Savarkar Sadan in the Heritage list or before declaring it as a Monument of National Importance.Phadnis insisted that the state decide the issue based on the 2010 proposal of the MHCC. However, in court, a builder to whom half the property of Savarkar Sadan has been sold by Savarkar's heirs has also approached the court, as they want to be heard before any such order is passed by the state giving Heritage status to the structure.advertisementThe bench of Chief Justice Alok Aradhe and Justice Sandeep Marne directed Phadnis to respond in an affidavit and will be hearing the issue in three weeks.- Ends

Jain monk Nileshchandra Vijay has temporarily put on hold his indefinite hunger strike, which was scheduled to begin on August 13, following initial talks with the Maharashtra Chief Minister's office regarding the recent ban on feeding pigeons at Dadar's kabutarkhana (pigeon feeding spot). Speaking to The Hindu, Mr. Vijay said he had decided to wait for a meeting with Chief Minister Devendra Fadnavis. 'We are expecting a meeting in three days. We do not believe in merely dropping a letter. We want a clear, face-to-face communication with him to present all our grievances about feeding the innocent pigeons who have been dependent on grains and water at the kabutarkhana for years,' he said. The religious leader, however, made it clear that the pause was temporary. 'Yes, I had announced that I would sit on an indefinite hunger strike from August 13 against the ban. After discussion, we decided to wait for three more days. If there is no positive response from the meeting, we will take a call accordingly. I will not stop,' he asserted. Mr. Vijay has also issued a warning to the State government that if the ban is not lifted within a week, he will resume the protest along with one lakh members of the Jain community from Mumbai. 'The government must fear that the BMC election is coming up. If they would continue their unconstitutional harassment towards innocent pigeons, none of us from the Jain community will vote. We will boycott the upcoming civic elections in protest,' he added. The Supreme Court on Monday refused to intervene in the petition challenging a Bombay High Court order directing the Brihanmumbai Municipal Corporation to register criminal cases against individuals feeding pigeons in Kabutarkhanas in the city. The apex court observed that the proceedings are pending before the High Court and the merit of the case is under consideration. In such a situation, parallel indulgence by this court is not proper. The Bombay High Court order was based on concern for public health. The court had reasoned that the public feeding of pigeons was a grave and potential health hazard to people of all ages at large. The court had previously restrained the BMC from demolishing any of the old heritage kabutarkhanas in the metropolis, but refused to allow feeding of the birds. In the meantime, community members have devised alternative ways to continue the practice without violating the ban. These include installing racks on rooftops of their cars to serve as feeding stations for the pigeons. 'Our cars are just driving around the Kabutarkhana and feeding the pigeons. There is no ban on feeding pigeons over our car roof, so no one should have a problem with that,' said Jain leader Bhagyachandra Muni. The Jains have also expressed alarm over what they describe as a mass die-off of pigeons since the feeding restrictions began. Mr. Vijay claimed that around 10,000 pigeons have died in the past 15 days. 'We have all the proof. With no water and food, they will die anyway,' he said, adding that the community intends to present this evidence to the Chief Minister and later in the court.

Nashik: Pratibha Shinde, the state vice president of Congress and a prominent leader of Lok Sangharsh morcha defending tribal rights, has resigned from the party and has decided to move to NCP less than a year after her appointment. Shinde, who joined Congress in Dec 2023, has been a key advocate for the tribal communities in Nashik, Nandurbar, Dhule, and Jalgaon districts since the 1990s. Influenced by Rahul Gandhi's Bharat Jodo Yatra, she chose to join the same party she had previously agitated against for tribal rights. "Rahul Gandhi is very committed to his ideals. Whatever you call it, we were agitating against the same Congress when it was in power for the rights of the tribals, and it is not that our fight was futile. We got our just demands sanctioned during our agitations. BJP is also out of the question given the stand of all these three parties on Hindutva. Since NCP has been walking the path of Chhatrapati Shivaji Maharaj, Shahu Maharaj, Mahatma Phule, and Dr Babasaheb Ambedkar's teachings, I decided to join the party." Addressing her transition from an organisation fighting for tribal rights to active politics, Shinde said, "I have realised that fighting alone is not the solution. We have been fighting since 1992, and though we have achieved great milestones, it is important to bring in the change by being part of the system."
