New court likely to deal with illegal mining cases in Karnataka

Bengaluru: A cabinet sub-committee headed by Law and Parliamentary Affairs Minister HK Patil has submitted a report recommending the creation of a state-level recovery authority and a dedicated court to handle illegal mining cases in Karnataka, officials aware of the development, said. A cabinet sub-committee has suggested a dedicated court to handle illegal mining cases in Karnataka, (Shutterstock) The panel's 35-page report, containing 12 recommendations, was recently placed before chief minister Siddaramaiah. The committee was constituted on July 5 following a cabinet decision taken earlier that month to examine irregularities in mining and suggest corrective measures. Apart from Patil, it included home minister G Parameshwara, food minister KH Muniyappa, social welfare minister HC Mahadevappa, forest minister Eeshwar Khandre, and mines and geology Minister SS Mallikarjuna. According to officers aware of the developments, the proposed recovery authority will be empowered to recover 'crores of rupees lost by the state exchequer due to illegal mining.' They added that a draft bill has already been prepared jointly by the Commerce and Industry Department, the Parliamentary Affairs Department and the Law Department. 'The draft legislation has been submitted along with the committee's report for the cabinet's consideration,' an officer said. Currently, illegal mining cases are tried in existing magistrate and sessions courts, which also hear matters under the Prevention of Corruption Act, the Control of Corruption Act, and cases pursued by the Anti-Corruption Bureau and the Lokayukta. This, officials said, leads to delays in handling mining-related offences. 'The SIT has filed only a limited number of illegal mining cases in Bengaluru courts, but these involve very high financial stakes for the government. A dedicated court will allow faster recovery,' one official explained. The report also recommended forming specialised legal teams to handle mining cases both in Bengaluru and in New Delhi courts. 'Without legal officers who have expertise in mining, cases risk dragging on. The committee has suggested two such teams under the SIT,' said another officer. Beyond judicial measures, the report calls for accountability among officials and private actors. It states that government employees, intermediaries and individuals who aided illegal mining should face action, as highlighted in Lokayukta findings. To ensure follow-through, the committee has suggested forming a monitoring panel to coordinate between departments and ensure that SIT cases are vigorously defended in court. The recommendations are now with the chief minister, and a final decision will be taken by the cabinet. 'Once the cabinet clears the proposals, Karnataka will have a new legal framework to recover losses from illegal mining and expedite pending cases,' an officer added.

Madurai: on Tuesday directed the commissioner of Madurai corporation to constitute special teams to verify the correctness of the property tax assessments of all buildings in Madurai city. Tired of too many ads? go ad free now Pursuant to an earlier order, a special investigation team (SIT) headed by deputy inspector general of police, Madurai range, Abhinav Kumar, was formed, and a probe is underway into the property tax scam in Madurai corporation. On Tuesday, the state submitted that the investigation in the case was accelerated by the SIT. The SIT officials also sought the past 10 years' data from the director of municipal administration about the property tax assessment of buildings within Madurai corporation limits. The investigation is being conducted from all angles. A division bench of justice S M Subramaniam and justice G Arul Murugan observed that it was brought to the notice of the court by the petitioner that the undervaluation of buildings for assessing the property tax is also a concern, which should be investigated by the police to initiate appropriate actions for misappropriation of corporation funds. Hence, the judges directed the corporation commissioner to constitute special teams to verify the correctness of the property tax assessments of all buildings in Madurai city to ensure that correct assessments are made for all properties in accordance with the Act rules. The court then adjourned the hearing to Wednesday (Aug 20) for the commissioner to file a report regarding the constitution of special teams. The court passed the order while hearing a public interest litigation filed by T Ravi, AIADMK councillor of ward 83 of Madurai corporation. The petitioner stated that a huge scam in the assessment of property tax in the corporation came to light in 2024. He alleged that several corporation officials, in connivance with the zonal chairpersons, were involved. Tired of too many ads? go ad free now Ravi further alleged that the scam resulted in a loss of more than 200 crore revenue to the corporation. He stated that police took action only against low-profile people and have not taken action against the real culprits who have political influence. Hence, the petitioner moved court seeking a CBI probe into the scam. During the earlier hearing, the court observed that a scam of this magnitude had to be investigated by an IPS officer, which should be monitored by higher authorities to ensure there are no lapses and no higher-level people are left out from the ambit of prosecution. All responsible and accountable for causing a huge loss to the corporation should be prosecuted. Hence, the court directed the constitution of an SIT.

Three lose Rs44L in share-trading fraud

Nashik: Three people in Nashik were defrauded of a combined Rs44 lakh in an online share trading scam that occurred between June 22 and Aug 14. According to the police, the victims were added to a WhatsApp group where they were promised high returns on investing money in the stock market. Lured by these promises, they deposited over Rs44 lakh into various bank accounts provided by the suspects. After the money was transferred, the suspects, who had used the name of a woman (Ankita) to add the first victim to the group, stopped all communication. The Nashik cyber police have registered a case under Section 318 of the Bharatiya Nyaya Sanhita (BNS) and other relevant sections of the IT Act. "The suspects had sent the complainant a particular link for downloading a trading mobile application. The complainant was told that he could get good returns on the investments made in certain stocks through the app," a police officer said. "The complainant told us that he and one of his acquaintances invested a total of Rs32.6 lakh for buying stocks and Initial Public Offerings (IPO) of various companies by making deposits in different bank accounts as suggested by the suspect. However, when the complainant tried to withdraw the money, he could not. This is when he realised that they were being cheated. Similarly, one more person from the Nashik Road area was cheated of Rs7.7 lakh by online fraudsters in a similar fashion," the officer added. The cyber police are investigating the case.
