Developer, 6 others ordered to return RM1.13mil to JMB

PETALING JAYA : The High Court in Ipoh has ordered a property developer and six other defendants to refund RM1.13 million to a joint management body (JMB) after the sum was paid out for improper purposes.
The developer, Haven Sdn Bhd, was also ordered to pay rental despite previously securing a 10-year rent-free concession from the JMB.
Justice Abdul Wahab Mohamed said the eight plaintiffs, comprising residents and condominium owners of Haven Lakeside Residences in Tambun, had proven their case on a balance of probabilities.
The eight filed the suit in 2020, claiming that the defendants had used the JMB's sinking fund to pay land amalgamation premiums and build a tennis court.
About RM950,000 was paid towards the premiums, while another RM180,000 was utilised to build the tennis court.
The court also found that the JMB had improperly given the developer a 10-year rent-free lease of a section of the common property, which was used to run a spa and restaurant.
The six other defendants against whom judgment was entered were the joint management council (JMC), its former chairman Megat Najmuddin Megat Khas, JMC members Peter Chan and Amy Lau, the JMB, and land owner Superboom Sdn Bhd.
Wahab ordered the defendants, except the JMB, to pay RM100,000 in costs to the plaintiffs.
He also ordered that a forensic audit be conducted, but granted the defendants an interim stay of his ruling.
Lawyer Patrick Samuel Sebastian appeared for the plaintiffs while counsel Rabinder Singh and Surindar Singh acted for the defendants.

GEORGE TOWN: A karaoke establishment in Gurney Paragon Mall, Penang was raided for music copyright infringement by the enforcement officers of the Domestic Trade and Cost of Living Ministry - Penang Northeast Branch, following a complaint made by Music Authors' Copyright Protection Bhd (MACP). MACP said in a statement today that after extensive intelligence gathering on the establishment, the raid was conducted for suspected violation of the Copyright Act 1987 on July 1. It was suspected that the karaoke establishment was, amongst others, publicly performing copyrighted music administered by MACP without a MACP licence, despite several warnings and reminders. "During the raid, 13 pieces of equipment suspected to violate the Copyright Act 1987 were seized by authorities, including televisions, speakers, microphones, amplifiers, and other audio-video gear, estimated to be worth RM18,000," said the statement. "If found guilty, the owners of the karaoke establishment will face imprisonment or a fine, or both." The statement added: "Any public performance of copyrighted music without MACP's authorisation is an offence under the Copyright Act 1987. "MACP strongly advises all businesses that play or perform copyrighted music on their premises to secure a valid MACP licence immediately, as several other establishments have been identified throughout Malaysia for similar enforcement actions. "MACP reaffirms its commitment to upholding and respecting copyright laws, protecting the livelihoods of songwriters, and combating copyright infringement against its members.

GEORGE TOWN: Penang police have dismantled a drug syndicate involved in processing methylenedioxymethamphetamine (MDMA), arresting two men and confiscating narcotics worth RM2.2 million. The raid took place in a luxury condominium in Gelugor, where authorities uncovered a drug-processing operation. Acting Penang police chief Datuk Mohd Alwi Zainal Abidin stated that the State Narcotics Criminal Investigation Department (JSJN) conducted the operation at 3 pm on Wednesday. 'We arrested a 62-year-old man and found the condominium unit was being used to process MDMA,' he said. Among the seized items were 150 instant drink sachets containing repackaged MDMA, nine plastic bottles of the same drug weighing 13,456 grammes, two ecstasy pills, one Erimin 5 pill, and various drug-processing tools. Police later detained a second suspect, a 40-year-old property agent, believed to be part of the syndicate supplying drugs to entertainment outlets in Penang. Investigations revealed that the syndicate sourced drugs through their network, repackaged them into drink sachets, and sold them at RM300 per packet. Authorities also confiscated RM1,220 in cash and two vehicles worth RM71,220. The syndicate had rented the condominium for RM3,000 monthly over the past three months and was suspected to have been active since March. Both suspects tested positive for drugs and had prior drug-related records, with the older man recently released from prison. The seized drugs could supply approximately 100,000 addicts. MACC Arrests Construction Company Personnel Linked To Johor Data Centre Project Corruption Probe

The contract manager of a prominent construction company is among four individuals arrested by the Malaysian Anti-Corruption Commission (MACC) for suspected involvement in corrupt activities related to the procurement of a tender for a data centre construction project in Johor, valued at about RM180 million. According to a source, the manager, his wife, and two others were arrested in an operation, Op Ways, in the Klang Valley yesterday. During the operation, the MACC also seized about RM7.5 million in cash found at the contract manager's residence. 'The money is believed to be bribes paid to the suspect for obtaining six tenders for the project. Initial investigations found that the suspect set a bribe payment of 2.5 per cent for each tender obtained,' said the source. Putrajaya Magistrate Irza Zulaikha Rohanuddin has issued a remand order for seven days until July 24 against the accused, who is now on remand for seven days until July 24, while the remand order for his wife was for three days. The other two suspects, both male, were ordered to be on remand for five days until July 22.
