ET Online Relief for these income taxpayers who got a tax demand notice due to short deduction, collection of TDS, TCS respectively from in-operative PAN holders The Income Tax Department has given relief to those income tax payers who got an income tax demand notice due to short deduction of TDS and short collection of TCS from those deductors and collectors, who have an in-operative PAN. An PAN will be termed in-operative, if it is not linked with Aadhaar.
The income tax department said that all such tax demand notices issued due to short deduction/collection of the TDS/TCS, will be deleted, if the PAN is made operative again within a specified deadline. What did the income tax department say? In a circular dated July 21, 2025 the Income Tax Department said: "...There shall be no liability on the deductor/collector to deduct/collect the tax under section 206AA/206CC of the Act, as the case maybe, in the following cases: Where the amount is paid or credited from April 1, 2024 to July 31, 2025 and the PAN is made operative (as a result of linkage with Aadhaar) on or before September 30, 2025.
Where the amount is paid or credited on or after August 1, 2025 and the PAN is made operative (as a result of linkage with Aadhaar) within two months from the end of the month in which the amount is paid or credited. The table below shows by when the PAN-Aadhaar should be linked, so that the TDS and TCS deductor and collector, respectively can get relief from tax demand notice: Particulars Action TDS or TCS paid or credited from April 1, 2024 to July 31, 2025 PAN should be made operative (as a result of linkage with Aadhaar) on or before September 30, 2025. TDS or TCS paid or credited on or after August 1, 2025 PAN is made operative (as a result of linkage with Aadhaar) within two months from the end of the month in which the amount is paid or credited.
What does this mean? This circular says that those taxpayers who deducted TDS or collected TCS at a lower rate than otherwise prescribed for in-operative PAN cases will get relief from tax demand subject to the condition that the PAN is made operative within a specified deadline.Aarjav Jain, Executive Director, Dinesh Aarjav & Associates, says: "This circular implies that any notices for short deduction of TDS or short collection of TCS may be withdrawn or rendered non-enforceable subject to the condition that the PAN is made operable within the defined timeline. This relief ensures procedural equity for genuine deductors operating in good faith."The circular mentions two different deadlines for giving this relief from short tax deduction and collection notice.Chartered Accountant Ashish Karundia explains that numerous tax deductors and collectors have received TDS/TCS demand notices from TRACES for applying a lower tax rate on transactions involving taxpayers whose PAN was inactive at the time, often due to it not being linked with Aadhaar."This circular issued on July 21, 2025, now provides relief in such situations. If the affected taxpayer activates their PAN by linking it with Aadhaar by September 30, 2025, any related short deduction or collection demands issued to the deductor or collector will be withdrawn."Karundia adds: 'Further, for transactions occurring on or after August 1, 2025, if the taxpayer's PAN becomes active within two months following the end of the month in which the transaction took place, the TDS/TCS demand will also be dropped. This second relief is not limited by the September 30 deadline. How can property buyers get relief due to this circular? As per Section 194-IA on property sales of Rs 50 lakh and above, buyers have to deduct TDS at 1% rate before making the payment to the sellers. However if the seller's PAN is in-operative then TDS at 20% rate is required to be deducted. The problem is in cases where the buyer deducted 1% TDS instead of 20% as it should be when the seller's PAN is in-operative. In such cases the property buyer will get income tax demand notice for 19% short deduction in TDS. This circular can give relief to such buyers. Chartered Accountant Mohit Gupta, partner, PNAM & Co. LLP, a chartered accountancy firm, says: 'Inoperative PANs cannot be used for filing income tax returns (ITR) or conducting key financial transactions. This poses a challenge in cases such as property sales, where the seller's PAN is inactive due to non-linkage with Aadhaar.
In such situations, the law mandates that the buyer must deduct TDS at 20% instead of the regular 1%. However, many buyers, unaware of the PAN status, end up deducting TDS at 1%, assuming compliance. This typically leads to a tax demand notice to the property buyer from the Income Tax Department for the shortfall of 19%.' ET Wealth Online has asked many chartered accountants about how this circular can give releif to property buyers, here's what they said: Karundia explains how this relief works for those who short deducted TDS from April 1, 2024 to July 31, 2025:
'This benefit also applies to property buyers who failed to deduct TDS at the higher 20% rate from sellers with inactive PANs.
For instance, if someone purchased a property on April 2, 2024, from a seller whose PAN was inoperative, the buyer was required to deduct TDS at 20% rather than the standard 1%. If they didn't and received a demand notice, the notice will be cancelled provided the seller activates their PAN by September 30, 2025.' Gupta explains how the relief works for those who short deducted TDS on or after August 1, 2025:
The recent CBDT Circular No. 9/2025, issued on July 21, 2025, offers relief in such cases. It provides that no demand for short deduction will be raised if the deductee—i.e., the property seller—makes their PAN operative by linking it with Aadhaar within two months from the end of the month in which the payment was made.
For example, if a property is purchased on August 2, 2025, from a seller with an inoperative PAN and the buyer deducts TDS at 1%, the buyer will not be penalized, provided the seller regularizes their PAN by October 31, 2025. Which other taxpayers can avail relief under this circular? Jain explains: "The ambit of Circular No. 9/2025 extends beyond property transactions and is applicable to all deductors and collectors who have applied standard TDS or TCS rates without enforcing the enhanced rates mandated under Section 206AA or Section 206CC, due to the recipient's PAN being inoperative—provided such PAN is regularised within the stipulated timeframe. Jain explains using some illustrative scenarios: 1. Payment of Professional Fees A company remits Rs 60,000 in May 2024 to a consultant and deducts TDS at 10% under Section 194J. At the time of payment, the consultant's PAN is inoperative. However, the PAN is regularised before September 30, 2025.
Relief Granted: The TDS deduction at 10% is considered valid. There will be no liability for short deduction, no disallowance of expense and no penal consequences. 2. Payment to Contractor A business makes a payment of Rs 1.5 lakh in July 2024 to an individual contractor for construction-related services and deducts TDS at 1% under Section 194C. The contractor's PAN was inoperative at the time but was regularised by 30th September 2025.
Relief Granted: The deduction at 1% is deemed compliant. The deductor will not be considered in default, and no consequences for short deduction will apply. Why did the income tax department give this relief? The Income Tax Department said this in the circular: The Central Board of Direct Taxes vide Circular No. 03 of 2023 dated 28th March, 2023 had specified that the consequences of PAN becoming inoperative as per Rule 114AAA of the Income-tax Rules, 1962 shall take effect from 1st July, 2023 and continue till the PAN becomes operative.
Further, Circular No. 06 of 2024 dated 23.04.2024 issued by the Board, provided relief to deductors/collectors from the applicability of higher TDS/TCS rates under section 206AA/206CC of the Income-tax Act, 1961 (hereinafter 'the Act') for transactions entered into upto 31.03.2024, where the PAN becomes operative (as a result of linkage with Aadhaar) on or before 31.05.2024.
Several grievances have been received from the taxpayers that they are in receipt of notices intimating that they have committed default of 'shortdeduction/collection' of TDS/TCS while carrying out the transactions where the PANs of the deductees/collectees were inoperative.
In such cases, as the deduction/collection has not been made at a higher rate, demands have been raised by the Department against the deductors/collectors while processing of TDS/TCS statements under section 200A or under section 206CB of the Act, as the case may be. The tax department said that to redress this grievance of taxpayers they partially modified the Circular No. 3 of 2023.

India's second-largest IT company Infosys is set to announce its Q1 results for the financial year 2025-26 on Wednesday, 23 July. After mixed set of numbers from other IT majors, such as TCS and HCL Tech, focus will be on deal TCVs and pipeline, management commentary on demand outlook, hiring trends, and GenAI deal wins. According to experts, the IT major is likely to post single-digit year-on-year (YoY) growth in both revenue and profit, while its sequential performance may remain subdued. According to the estimates of brokerage firm Phillip Capital, Infosys may report a 5.9 per cent YoY rise in revenue and an 8 per cent rise in profit after tax (PAT). EBITDA may increase 6.5 per cent and EBITDA margin may climb by 13bps YoY. Phillip Capital expects Infosys to report revenue growth of 1.4 per cent QoQ in constant currency (CC) terms on a weaker base of Q4, higher billing days and $15 million contribution (nearly 30bps) from recent acquisitions. Margins, according to Phillip Capital, may remain stable. Headwinds include part wage hike, normalisation of third-party costs offset by lower visa costs, said the brokerage firm. "We expect Infosys to narrow FY26 growth guidance to 1-3 per cent YoY in CC (0-3 per cent earlier). Revised guidance will include nearly 40bps contribution from recent acquisitions. We expect EBIT margins guidance to stay intact at 20-22 per cent," said Phillip Capital. Similarly, brokerage firm Motilal Oswal Financial Services expects a 5.9 per cent YoY rise in revenue and a 4.3 per cent rise in PAT. EBITDA may rise by 5.3 per cent, but EBITDA margin may decrease by 20 bps YoY. "We expect Infosys to upgrade the lower end of its guidance by 100bp to account for inorganic impact (current guide:0-3 per cent CC for FY26, estimated inorganic contribution of 80bp)," said Motilal Oswal. Experts believe Infosys remain a long-term buy due to the company's growth outlook. "We advise investors to keenly watch for Q1FY26 result of Infosys and consider investing in Infosys for a long-term view as the future outlook is promising on account of its deal pipeline, GenAI-driven transformation deals and recent acquisitions," said Rajesh Sinha, Senior Research Analyst at Bonanza. However, some technical experts indicate weakness on charts, which suggests the downtrend may continue. Infosys share price is down about 2 per cent for the current month. Shitij Gandhi, Senior Research Analyst (Technicals) at SMC Global Securities pointed out that Infosys stock has been in a sustained downtrend, trading within a declining channel and consistently staying below its key moving averages. The bearish momentum remains dominant on both daily and weekly timeframes. However, Gandhi highlighted that over the past few weeks, the stock has attempted to hold above its crucial 200-day exponential moving average (EMA), currently positioned at ₹ 1,530 on the weekly chart. Despite this, the broader trend remains negative, with strong resistance expected in the ₹ 1,600–1,700 range. "Given the prevailing structure, we anticipate the downtrend to persist, with a potential acceleration in selling pressure if the stock breaks below the ₹ 1,530 support level," said Gandhi. Similarly, Mandar Bhojane, Senior Technical & Derivative Analyst at Choice Broking, said investors should stay cautious ahead of the results and consider entering only on a breakout above key resistance levels or if the management commentary and guidance remain strong. Technically, Bhojane underscored that Infosys is currently trading in a sideways trend near ₹ 1,574. He said a decisive close above the ₹ 1,600 mark could trigger a potential rally towards ₹ 1,700. On the downside, ₹ 1,540 acts as immediate support, and any bullish reversal from that zone could offer a buy-on-dips opportunity. According to Bhojane, the next major support lies at ₹ 1,500, below which further correction may unfold. "The stock is trading below key EMAs, and the RSI is at 42.5, trending downward—indicating weakening momentum. Despite healthy volume activity, price remains range-bound, suggesting a wait-and-watch approach until a breakout occurs on either side," Bhojane said. The Income Tax Appellate Tribunal on Monday dismissed an appeal by the Congress seeking tax exemption on an income of Rs 199 crore for the assessment year 2018-'19, Live Law reported. The tribunal rejected the party's claim under Section 13A of the 1961 Income Tax Act, observing that the Congress had filed its tax returns late and violated rules related to cash donation limits. A bench of Judicial Member Satbeer Singh Godara and Accountant Member M Balaganesh ruled: 'The assessee's return filed on [February 2, 2019] is not within the 'due' date to make it eligible for the impugned exemption.' The deadline for filing the income tax return for 2018-'19 was December 31, 2018. Its tax tiling for the year also did not provide details about contributions worth Rs 14.4 lakh out of the total donations worth Rs 142.8 crore it had received that year. Due to its non-compliance with the provisions to claim exemption, the Income Tax Department had issued notices to the Congress in September 2019, January 2020 and March 2020, demanding a tax of Rs 94.4 crore on an assessed income of Rs 199.1 crores for 2018-'19. The assessment order dated July 6, 2021, had denied the entire exemption claim, making the full receipt amount taxable. The Congress challenged the assessment order in August 2021 and applied for a stay on the recovery of the amount demanded by the Income Tax Department in October 2021. Later that month, an assessment officer disposed of the application, directing the Congress to pay 20% of its outstanding tax liability, failing which it would be treated as a defaulter. However, the Congress did not pay the 20% tax amount, leading the Income Tax Department to issue a letter in January 2023 to the Congress requiring the party to deposit and liquidate its tax liability. The Congress challenged this before the Commissioner of Income Tax (Appeals), the Income Tax Appellate Tribunal and the Delhi High Court, being denied relief at every forum. The High Court had criticised the Congress for 'badly' handling the matter and said that somebody from the Congress' office 'went off to sleep' from 2021. In April 2024, less than three weeks before polling began in the Lok Sabha elections, the Congress received tax notices for seven other assessment years. Are political parties exempt from income tax? Under Section 13A of the 1961 Income Tax Act, registered political parties will be exempt from paying tax on the income they receive provided they fulfil certain conditions. The party must maintain a book of accounts recording its income. It must maintain a record of the names and addresses of each person who contributes a sum over Rs 20,000 to it. The party's accounts must be audited by a chartered accountant. It must only accept contributions over Rs 20,000 via cheque, demand draft, electronic clearing system or other prescribed electronic modes. To claim an exemption, the treasurer of the party must submit a report listing all donations over Rs 20,000 received by the party in a financial year to the Election Commission by the due date for filing income tax returns. The provision also requires parties to file a tax return for the previous year. If any of these conditions are not satisfied, the party will not be able to claim income tax relief, according to Section 13A of the Income Tax Act and Section 29C of the 1951 Representation of the People Act.

According to the 19th installment released in February, farmers should have received the 20th installment amount by now. Union Agriculture and Farmers Welfare Minister Shivraj Singh Chouhan said that as many as 11,171 farmers in Delhi received Rs 2.59 crore between December 2024 to March 2025 as the latest instalment under the Pradhan Mantri Kisan Samman Nidhi (PM-KISAN) scheme. What did the Ministry of Agriculture say? Replying to a question by BJP's South Delhi MP Ramvir Singh Bidhuri, Union Minister Chouhan shared data in Lok Sabha showing that between August-November 2019 and March 2025, farmers in Delhi received Rs 48.79 crore under the scheme. The Minister said that across the nation, 10.06 crore beneficiaries of PM-KISAN were given Rs 23,500.83 crore in the last instalment for the period from December 2024 to March 2025. Maintaining absolute transparency in registering and verifying beneficiaries, as on July 16, the Central government has disbursed over Rs 3.69 lakh crore to farmers in 19 instalments since inception, said Chouhan. 'A farmer-centric digital infrastructure has ensured that the benefits of the scheme reach all eligible farmers across the country without involvement of any intermediaries,' he said. Through the post, the Ministry of Agriculture stated that no farmer should fall for false information or fake messages being circulated on social media in the name of the PM-KISAN scheme.
