
What Maharashtra's ‘urban Maoism' Bill says
The MSPS Bill has been debated widely ever since it was first introduced in the monsoon session of the state legislature last year by Chief Minister Devendra Fadnavis, who was Deputy Chief Minister at the time. The Opposition has raised concerns over the definition and interpretation of some of the terms and clauses in the Bill.
The Bill will now be introduced in the Legislative Council where it is expected to pass as well. It will then be sent to the Governor for his assent, following which it will become law.
The statement of objects and reasons of the Bill says the 'menace of Naxalism is not only limited to remote areas of the Naxal affected states, but its presence is increasing in the urban areas also through the Naxal front organisations'.
According to the government, these 'frontal organisations' provide logistics and safe refuge to armed Naxal cadres, and 'existing laws are ineffective and inadequate to tackle this menace of Naxalism'.
To address this situation, Chhattisgarh, Telangana, Andhra Pradesh, and Odisha have enacted Public Security Acts and banned 48 Naxal frontal organisations, the Bill says.
The Bill gives the government the power to declare any suspect 'organisation' as an 'unlawful organisation'. It prescribes four offences for which an individual can be punished: (i) for being a member of an unlawful organisation, (ii) when not a member, for raising funds for an unlawful organisation, (iii) for managing or assisting in managing an unlawful organisation and, (iv) for committing an 'unlawful activity'.
These offences carry jail terms of two years to seven years, along with fines ranging from Rs 2 lakh to Rs 5 lakh. The offence relating to committing an unlawful activity carries the toughest punishment: imprisonment of seven years and a fine of Rs 5 lakh.
Offences under the proposed law are cognizable, which means arrests can be made without a warrant, and are non-bailable.
The Bill defines 'unlawful activity' as any action taken by an individual or organization whether by committing an act or by words either spoken or written or by sign or by visible representation or otherwise, which constitute a danger or menace to public order, peace and tranquility; or interferes with the maintenance of public order; or interferes with the administration of law or its established institutions and personnel; or is designed to overawe by criminal force or show of criminal force to any public servant, etc.
Indulging in or propagating, acts of violence, vandalism or other acts generating fear and apprehension in the public; encouraging or preaching disobedience to established law and its institutions; or collecting money or goods to carry out any of these unlawful activities are also included.
The Bill was first brought at the fag end of the 2024 Monsoon Session of the Assembly. The day after the Bill was tabled, the Assembly was prorogued and the Bill was not passed.
After the Assembly elections, following which Fadnavis became Chief Minister, the Bill was introduced in December last year. Fadnavis said that since many organisations had expressed apprehensions, the Bill would be sent to the joint select committee, and taken up again after all views and opinions had been considered.
The Joint Select Committee, comprising 25 members from both houses of the legislature, was headed by BJP leader and state Revenue Minister Chandrashekhar Bawankule. The Committee held five meetings between March 4 and June 26 this year.
The Committee received more than 1,200 suggestions and objections from various stakeholders including opposition parties, NGOs, and citizens until the April 15 deadline. Some objections were raised about open-ended definitions of terms like 'unlawful activity'; some like the People's Union for Civil Liberties (PUCL) asked for the Bill be withdrawn in its entirety.
Eventually, the Committee made a total of three amendments to the original Bill.
🔴 The first amendment was regarding the 'long title and preamble'. Initially the long title and preamble read: 'A Bill to provide far more effective prevention of certain unlawful activities of individuals and organisations and for matters connected….,'.
The introduction to the amended Bill says that 'since the Bill intends to destroy Urban Naxalism, the Committee opined to bring clarity on this aspect', and changed unlawful activities of individuals and organisations to 'unlawful activities of Left Wing Extremist organisations or similar organisations…'.
🔴 The second amendment was to clause 5(2) of the Bill, which says that 'the Advisory Board shall consist of three persons who are or have been or qualified to be appointed as judge of the High Court. The Government shall appoint the members and designate one of them as the Chairperson.'
The Committee suggested that the Board shall consist of a chairperson who is or has been a judge of the High Court, and two members of which one shall be retired judge and another shall be a government pleader of the High court appointed by the state government.
🔴 The third amendment was made to clause 15(2). Instead of the acts defined under the Bill being investigated by a police officer not below the rank of Sub Inspector, it was suggested that it should be entrusted to officers of the rank of Deputy Superintendent of Police.

Cyber criminals swindle Pune businessman of Rs 2.15 crore, posing as woman with marriage proposal
A 35-year-old Pune businessman lost Rs 2.15 crore to Cyber criminals posing as a woman who approached him on the pretext of marriage proposal and lured him with huge profits on currency trading. The victim was manipulated into making close to 28 transactions to mule accounts as he was made to believe that he was investing in the forex market. A First Information Report(FIR) in the case was registered at Cyber Crime police station of Pune by the victim who runs a company in the service industry. Between April and June earlier this year, the victim was defrauded of a total of Rs 2.15 crore, by cyber criminals posing as 'Aakriti Sharma', claiming she was from a business family. She said she had gotten the complainant's contact from matrimonial services and got in touch with the complainant over Whatsapp. The woman claimed her family ran a furniture business in Indore and said she was interested in taking the marriage proposal forward. She said that she and her brother were also into currency trading from which they were getting 25 per cent profit. As the man continued communicating with the woman with intent to take the proposal further, she convinced him to start investing in currency trading. She made him log onto a fraudulent trading platform and open his own profile on it. The complainant was given details of fraudulent bank accounts to send money to and each of his transfers was getting reflected on the fraudulent application along with corresponding high gains in US dollars. As the complainant continued talking to the woman he also made large transfers through the platform thinking he was getting huge profits. After transferring Rs 2.15 crore the corresponding profits as reflected on the platform were Rs four crore. As the complainant submitted a withdrawal request, he was asked to pay tax of Rs 57 lakh. At this point when he discussed the issue with his friends, the complainant was made to realise that he had been defrauded. He subsequently approached the Cyber crime police station and an FIR was registered on Tuesday following a preliminary inquiry.

Lok Sabha select committee proposes 285 changes to Income Tax Bill, 2025
Dropping of provision that denies refunds if returns are filed after the due date and reinstatement of the inter-corporate dividend deduction were among the 285 suggestions made by the select committee of Lok Sabha examining the Income Tax Bill, 2025 -- which was adopted on Wednesday. The Income Tax Bill, 2025, will replace the Income Tax Act, 1961. The government aims to implement the new Income Tax law from April 1, 2026. Overall, the committee has recommended about 285 changes, most of which involved simplifying the language of the draft legislation. The committee will present its report in the Lok Sabha on July 21, the first day of the Monsoon session. The committee, headed by Bharatiya Janata Party (BJP) Lok Sabha member Baijayant Panda, has suggested the removal of a controversial provision that denies refunds if returns are filed after the due date. The New Income Tax Bill, 2025 drafted by the finance ministry required that a person seeking refunds under chapter XX must mandatorily file income tax returns within the due date. On top of that, as per section 433 of the New IT Bill states that a refund should be sought only while filing a return, which created a contradiction. 'The Select Committee has appropriately deleted clause 263(1)(ix), so that there is no unnecessary litigation in this matter which would have impacted all the taxpayers. Taxpayers remain ever grateful for this by maintaining that there are no policy changes in the provisions related to refunds in the New IT Bill, 2025,' said Vivek Jalan, partner with Tax Connect Advisory Services. Deduction under section 80M (Clause 148 of New bill) for Inter Corporate Dividends for companies availing the benefit of special rate of tax under section 115BAA (Clause 200 of the New bill) which is available in the Current Income Tax Act, was also erroneously missed out in the New Income Tax Bill 2025. The select committee has now recommended reinstatement of the inter-corporate dividend deduction. In the IT Bill 2025, presented on February 25, in clause 395, only low TDS (Tax Deducted At Source) deduction certificate was available to the taxpayers. Now, in addition to low deduction TDS Certificate, even NIL TDS certificate can be availed by taxpayers. 'This aligns the new IT Bill with the current IT Act, 1961 and would provide consequential relief to taxpayers whose funds get blocked by deduction of TDS where no tax is applicable to them at all. This is beneficial primarily to businesses which incur losses in a tax year or tax exempt entities like charitable organisations,' Jalan added. 'The panel has suggested 285 changes to the Bill. The government, if it deems fit, will incorporate the changes in the Bill, take approval from the Cabinet before moving the bill for consideration and passage in the Lok Sabha,' a member of the select committee said, requesting anonymity.

According to state BJP president Dilip Jaiswal, Modi will address a public meeting at Gandhi Maidan in Motihari town, the headquarters of East Champaran district. 'That Bihar is high on the Prime Minister's agenda can be gauged from the fact that he will be visiting the state for the 53rd time since he assumed power. The state will be showered with development projects worth Rs 7,196 crore,' Jaiswal said. The BJP leader also said that at the function, the PM will disburse an amount of Rs 162 crore, through direct cash transfer, to 40,000 beneficiaries of Pradhan Mantri Gramin Awas Yojana while another 12,000 people will be handed over the keys to their new houses. 'In addition, financial assistance of Rs 400 crore will be extended to 61,500 self-help groups during the function. Bihar, which sees Modi as family, awaits the PM eagerly,' Jaiswal added.
