
SC to examine PIL for income-based reservation system for SC, ST members

New Delhi, Aug 11 (PTI) The Supreme Court on Monday agreed to examine a PIL seeking direction to the Centre to frame policies for a more equitable system of reservation in government employment.
A bench of Justices Surya Kant and Joymalya Bagchi issued notice to the Centre and sought their response by October 10 on the PIL filed by Ramashankar Prajapati and Yamuna Prasad.
The bench asked the petitioner's counsel to be ready to face lots of opposition as the PIL might have far-reaching impact.
The PIL filed through advocate Sandeep Singh said the approach would strengthen Articles 14, 15 and 16 of the Constitution and ensure an equitable opportunity without altering existing quotas.
The plea said despite decades of reservation, the most economically deprived were often left behind with benefits captured by the relatively better-off within reserved categories and prioritisation by income would ensure help starts where it was most needed today.
'The petitioners who belong to the Scheduled Caste (SC) and Other Backward Classes (OBC) categories, by way of the present petition, seek to highlight the economic disparities within these communities, which have led to an inequitable distribution of benefits under the existing reservation policies," the PIL said.
It was argued while the reservation framework was initially introduced to uplift the historically disadvantaged communities, the current system disproportionately benefits those belonging to relatively well-off economic strata and high social status backgrounds within these groups, thereby leaving the most economically deprived members with limited access to opportunities.
'Petition calls for an urgent need to integrate economic criteria into the reservation policy to ensure that benefits are conferred upon those who genuinely require state support. This reform proposal does not seek to abolish or undermine caste-based reservations but rather to refine them to serve their intended purpose more effectively," it said.
The PIL said by introducing an income-based prioritisation mechanism within SC, ST reservations, the proposed framework aims to prioritise opportunities for the most disadvantaged persons amongst the SC-ST communities.
'The necessity of such an approach stems from the fact that over the past 75 years, reservations have disproportionately benefited a select few within the reserved categories, creating intra-community economic disparities and failing to achieve holistic upliftment," it said.
The petition added that the quota system was established as a tool for social justice, aimed at rectifying centuries of discrimination and socioeconomic deprivation faced by marginalised communities. PTI MNL MNL AMK AMK

Karnataka government tables Assembly bills for gig workers
Agency: PTI Last Updated: Bengaluru, Aug 12 (PTI) The Karnataka government on Tuesday tabled 15 bills, including one to provide social security and welfare to the gig workers. The Prohibition of Child Marriage (Karnataka Amendment) bill was also tabled. The government said the Karnataka Platform Based Gig Workers (Social Security and Welfare) Bill, 2025 is aimed to protect the rights of platform based gig workers. It also intends to place obligations on aggregator or platform in relation to social security, occupational health and safety, transparency in automated monitoring and decision-making system, to provide dispute resolution mechanisms, to establish a welfare board and create a welfare fund for platform based gig workers. The 16-member board will have Labour Minister as its ex-officio chairperson, additional chief secretary or the principal secretary of labour department as the ex-officio member. It will have four representative body of gig workers, an equal number of representative body of aggregator, two representatives from the civil society with experience in the field and a technical expert. The Prohibition of Child Marriage Amendment Bill makes 'attempt and preparation to make engagement of a child punishable by rigorous imprisonment, which may extend to two years or with fine, which may extend to Rs one lakh or with both". The Karnataka Compulsory Service by Candidates Completed Medical Courses (Amendment) Bill enables posting of MBBS graduates even in urban areas which remain surplus even after posting to rural areas, posting of post graduates to community health centres and other hospitals in rural areas and issuing conditional, No Objection certificate to pursue higher studies like PG and super specialty courses upon submitting an undertaking to fulfill the obligation of one year compulsory service. Bills that were passed include Civil Services (Regulation of Transfer of Medical Officers and Other Staff) (Amendment) Bill, Tank Conservation and Development Authority (Amendment) Bill that sets the buffer zone regulations and prevents the misuse of lakes, Fire Force (Amendment) Bill, Medical Registration Bill, and Universities (Amendment) Bill. Other bills pertain to setting up development authority or board for Banavasi, Sarvajna Kshetra, Kitturu, Kudala Sangama, Nadaprabhu Kempegowda Heritage Area, Kaginele and Basavakalyana. Yogendra Yadav appears in Supreme Court with 2 voters declared dead in Bihar SIR, ‘drama,' says Election Commission
Political activist Yogendra Yadav on Tuesday brought to the Supreme Court two people who have been declared dead in the Special Intensive Revision (SIR) of the electoral roll in poll-bound Bihar. Yadav, who addressed the Bench of Justices Surya Kant and Joymalya Bagchi in person, said that the names of these two people do not appear in the electoral rolls because they have been declared dead. "Please see them. These are declared as dead. They don't appear. But they are them," Yadav told the Court during the hearing of a batch of petitions challenging the Bihar SIR, legal news website Bar and Bench reported. Yadav is one of the petitioners in the case. Senior Advocate Rakesh Dwivedi, appearing for the Election Commission of India, termed the submission a "drama". Justice Bagchi said that this may have been an inadvertent error. "May have been an inadvertent error. Can be corrected. But your points are well taken," the judge said. Yadav, however, said that the SIR, by design, was leading to mass exclusion. "Vast exclusion has already is much more than 65 lakhs. This is not a failure of implementation of SIR, but because of the fact that wherever you implement SIR, the result will be the same," Yadav said. Yadav also said that people have never been asked to submit their forms in a revision exercise in the country's history. "If it was done in 2003, the other side should point it out," he said, adding that the SIR had not led to any additions. This was an exercise in intensive deletion, he claimed. "What was special in 2003 was that SIR was done apart from the word 'intensive' being used. This is the first exercise in the history of the country where revision has taken place with zero additions. Zero additions." Yadav called the entire process "dreadful" and said that the SIR was the largest exercise of disenfranchisement. "We also have confirmation that women have deleted more than men. 31 lakh women have been deleted...25 lakh men have been deleted," he added. Yadav also pointed to two people within the courtroom who were allegedly declared dead by the electoral authorities. "The figure is bound to cross 1 crore. This is not an issue of revision. Please see them. These are declared as dead. They don't appear. But they are them," he said. The Supreme Court, during the hearing, called the special intensive revision (SIR) row in poll-bound Bihar "largely a trust deficit issue' as the Election Commission of India (ECI) claimed roughly 6.5 crore people of the total 7.9 crore voting population didn't have to file any documents for them or their parents featured in the 2003 electoral roll. During the hearing, a bench of Justices Surya Kant and Joymalya Bagchi remarked that it "largely appears to be a case of trust deficit, nothing else' as it questioned the petitioners challenging the Election Commission's 24 June decision to conduct the SIR on the ground that it would disenfranchise one crore voters. "If out of 7.9 crore voters, 7.24 crore voters responded to the SIR, it demolishesthe theory of one crore voters missing or disenfranchised," the bench told senior advocate Kapil Sibal, appearing for petitioner and RJD Member of Parliament Manoj Jha. Sibal, during the hearing, said that while in one constituency, contrary to the poll panel's claims, 12 people declared dead were found alive, in another instance, alive persons were declared dead.
