HC denies bail to man for posts against PM, armed forces

The Allahabad high court on Wednesday rejected the bail application of a man accused of posting objectionable content on social media targeting the Prime Minister and the Indian Armed Forces. Rejecting the bail application of Ashraf Khan alias Nisrat, justice Arun Kumar Singh Deshwal said it has become a 'fashion among certain groups of people' to misuse social media under the guise of freedom of expression by making unfounded allegations against national leaders and circulating content that spreads hatred and division.
The accused was booked under sections 152 (acts that endanger the sovereignty, unity, and integrity of India) and 197 (imputations and assertions prejudicial to national integration) of the Bharatiya Nyaya Sanhita (BNS) at the Sasni police station of Hathras district. It was alleged that the accused uploaded edited videos to his Facebook account during the recent India-Pakistan military face-off.
According to the prosecution, one video allegedly depicted Prime Minister Narendra Modi walking alongside a donkey pulling a cart fitted with an aircraft, and later portrayed him as apologising to Pakistan. Another portion of the post allegedly showed Wing Commander Vyomika Singh of the Indian Air Force seated beside the Pakistan Army chief, with captions suggesting that the PM was running to save himself from a Pakistani missile.
Additional posts allegedly included slogans such as 'Pakistan Air Force Zindabad' and visuals of Indian aircraft being destroyed by Pakistani jets. Other objectionable content targeting defence minister Rajnath Singh and the PM was also found, according to the prosecution.
During the hearing, the applicant's counsel argued that Khan was innocent and had not forwarded the objectionable posts himself, though they were found on his mobile phone. In contrast, the state counsel opposed the bail plea, arguing that the posts created social disharmony and insulted the Indian military establishment.
In its order dated July 2 (Wednesday), the court concluded that the nature of the posts reflected disrespect not only towards the Prime Minister but also towards the Indian Armed Forces and its officers.
'Though our Constitution grants the right to freedom of speech and expression to every citizen, that freedom does not extend to posting videos and content that insult the Prime Minister, the Indian Military and its officers. Such actions not only cause social disharmony but also promote separatist sentiment and pose a threat to the sovereignty, unity, and integrity of India,' the court observed. Accordingly, the bail application was rejected.

In a post on X, Mr Jaishankar stated, "Just finished a very productive meeting of Quad Foreign Ministers in Washington DC. Discussed how to make Quad more focused and impactful on contemporary opportunities and challenges. Today's gathering will strengthen strategic stability in the Indo - Pacific and keep it free and open." Mr Jaishankar met with Rubio on the sidelines of QFFM and discussed bilateral partnership between both countries in the field of security, critical technologies, connectivity, energy and mobility. In a social media post, he said that he "shared perspectives on regional and global developments." Mr Jaishankar also held a meeting with FBI Director Kash Patel in Washington DC on Wednesday (local time) and expressed appreciation for cooperation between India and the US in countering organised crime, drug trafficking and terrorism. In his meeting with US Director of National Intelligence Tulsi Gabbard, Mr Jaishankar said that the duo had a "good exchange" with her on the global situation and bilateral cooperation. On Tuesday (local time), Mr Jaishankar held a meeting with US Energy Secretary Chris Wright in Washington, DC and spoke about the energy transformation underway in India. The two leaders discussed opportunities for a deeper energy partnership between the two nations. The External Affairs Minister also held discussions with US Secretary of Defence Pete Hegseth and held discussion on advancing defence partnership between two nations, building on growing convergences of interests, capabilities and responsibilities. Before arriving in Washington, DC, Mr Jaishankar was in New York, where he inaugurated an exhibition at the United Nations on 'The Human Cost of Terrorism,' highlighting the need to expose state sponsorship of terrorism.

Pakistan was receiving real-time intelligence from China about India's important military deployments during Operation Sindoor, a senior Indian Army officer said on Friday. The comment was made by Lieutenant General Rahul R Singh, the deputy Army chief (capability development and sustenance), at an event organised by the Federation of Indian Chambers of Commerce and Industry. ANI quoted the deputy army chief as saying: 'When the DGMO [director general of military operations]-level talks were going on, Pakistan actually was mentioning that 'we know that your such and such important sort is primed and it is ready for action...I would request you to perhaps pull it back'. So he was getting live inputs from China.' 'That is one place we really need to move fast and take appropriate action', he added. Singh added that India was effectively up against three adversaries during the four-day conflict: with Pakistan leading the front, China offering extensive support and Turkey playing an important role by providing drones 'along with trained individuals who were there', ANI reported. 'In the last five years, 81% of the military hardware that Pakistan is getting is Chinese,' Singh said. '[China] is able to test his weapons against various other weapon systems that are there, so it's like a live lab available to them.'
