Shiv Sena (UBT) defends Emergency, calls it ‘constitutionally valid'

The Shiv Sena (UBT) has defended the Emergency, calling it constitutional and acknowledged that the undivided Shiv Sena Chief, Bal Thackeray, had openly supported the Emergency. Sena (UBT) MP Sanjay Raut stated on Wednesday (June 25, 2025) that according to the Indian Constitution, if there is an internal security threat, the Prime Minister can impose an Emergency.
Mr. Raut's statement comes after Prime Minister Narendra Modi called the Emergency Samvidhan Hatya Diwas. In a scathing attack, Mr. Raut remarked, 'BJP can celebrate and politicise anything.'
'How can it be celebrated as Samvidhan Hatya Diwas when the Constitution enables the Prime Minister, with the approval of the president, to impose an Emergency if the country is facing any threat?'
Mr. Raut called 11 years of Mr. Modi's administration 'an unannounced emergency' as during this time, the police were found using bulldozers to raze poor people's homes based on their religion and caste, nearly every day.
Reflecting on the similarities, Mr. Raut said, 'Indiraji called BJP leaders Atalji and Advanji in jail regularly when they were detained, while the BJP got the sitting Chief Minister arrested. So, celebrate these 11 years as Samvidhan Hatya Diwas.'
Former Prime Minister Indira Gandhi imposed the Emergency in India on June 25, 1975, making it 50 years since that day.
Constitutional sanction
Mr. Raut defended Ms. Gandhi, saying that she imposed an Emergency, staying within the confines of the Constitution. 'She confronted people and cited reasons for imposing the Emergency. After 22 months, she also fought in the election. Emergency has constitutional recognition. She could have won the election by wrong means, but she accepted her defeat, which makes her chowkidar (protector) of democracy,' he adds.
Meanwhile, Shiv Sena Chief and Deputy Chief Minister Eknath Shinde on Wednesday (June 25, 2025) dismissed the claims of Bal Thackeray backing the Emergency. Mr. Shinde called it a 'half-truth' and referred to an interview by Bal Thackeray, wherein he stated, 'I condemn the decision of Emergency if it was to save the Prime Ministership.' Mr Shinde said, 'Bal Thackeray never straightforwardly backed the Emergency, and he said several times, 'I am with the Emergency, only it was taken for the country's welfare. Under the name of Emergency, we won't accept dictatorship'.'
Chief Minister Devendra Fadnavis also wrote an article criticising the Emergency and recalled bitter memories of the period. He condemned the Congress party's actions as a destruction of the Constitution, constitutional institutions, and democracy. 'It's been 50 years since the Congress party wrote this dark chapter in history,' he wrote.

Calling the Emergency the darkest chapter in India's democratic journey, CM Gupta criticised the actions of then Prime Minister Indira Gandhi's government as cruel and dictatorial. 'Lakhs were jailed without cause. There was no appeal, no hearing—only fear,' she said. She also took aim at the Congress party, accusing its leaders of hypocrisy: 'Today they carry the Constitution in their pockets, yet they were the ones who violated it.' Gupta concluded with a pledge that India would never again tolerate such authoritarianism, and praised the present government for its commitment to democratic values. Delhi minister of art and culture Kapil Mishra, was also present at the event, said the documents provided 'clear evidence of the murder of democracy,' and noted this was the first time many had been made public. Delhi BJP president Virendra Sachdeva, several cabinet ministers, and senior officials also attended the event.

In a media briefing, Union Minister Ashwini Vaishnaw said the Cabinet, at a meeting chaired by Prime Minister Narendra Modi, observed a two-minute silence as a tribute to the victims of the excesses committed during the Emergency. The Union Cabinet paid tribute to their exemplary courage and valiant resistance to the Emergency's excesses. 'The year 2025 marks 50 years of the Samvidhan Hatya Diwas, an unforgettable chapter in the history of India where the Constitution was subverted and the republic and democratic spirit of India were attacked. Federalism was undermined, and fundamental rights, human liberty, and dignity were suspended,' he said. 'The Union Cabinet reaffirmed that the people of India continue to repose unflinching faith in the Indian Constitution and the resilience of the country's democratic ethos. It is as important for the young as it is for the old to draw inspiration from those who resisted dictatorial tendencies and stood firm to defend our Constitution and its democratic fabric. India, as the mother of democracy, stands as an example of preserving, protecting and safeguarding constitutional values. Let us as a nation renew our resolve to uphold our Constitution and its democratic and federal spirit," the minister added. Earlier in the day, Modi called the imposition of Emergency "one of the darkest chapters in India's history" and said the values enshrined in the Constitution were set aside as the Congress "placed democracy under arrest."

THIRUVANANTHAPURAM: The display of an image of Bharat Mata holding a saffron flag at an event attended by Governor Rajendra Arlekar in Kerala University (KU) triggered massive protests by SFI and KSU activists on Wednesday, leading to a tense situation for nearly two hours at the varsity's senate house campus. The trouble began when the image, allegedly used by the RSS in its functions, was spotted at the Senate Hall, the venue of the event organised to mark the 50th anniversary of the Emergency. The programme, scheduled to begin at 5.30pm, was organised by Sree Padmanaba Seva Samithi, a pro-right wing organisation and attended by BJP leaders, party workers and supporters. On being informed, KU Registrar K S Anil Kumar told the organisers that religious symbols could not be used in a programme held at the varsity. As organisers were reluctant to call off the programme, Anil told them in writing that the event had been cancelled for violating the terms and conditions for using the hall. By then, SFI workers gathered outside the hall in huge numbers, shouting slogans. Pro-left Syndicate members joined in. KSU workers also marched to the varsity and some attempted to enter the hall, leading to arguments and eventually fist fights with BJP supporters who were in the audience. The police soon intervened. Meanwhile, Arlekar informed the registrar he would be attending the event. Amid tight security, he arrived around 6.25pm and offered floral tributes before the image of Bharat Mata.
