Miley Cyrus Denied in Attempt to Dismiss Copyright Lawsuit Over ‘Flowers'

A judge has denied Miley Cyrus' request to dismiss the copyright lawsuit claiming that her 2023 smash 'Flowers' was copying Bruno Mars' 'When I Was Your Man.'
Cyrus was initially sued in Sept. 2024 by Tempo Music Investments, a company that purchased the catalog rights of 'When I Was Your Man' co-writer Philip Lawrence. Neither Mars nor Lawrence are named as plaintiffs in the case, which Cyrus filed to dismiss in November.

But in a ruling yesterday, reviewed by Variety, the judge cleared the path towards a trial by stating that Cyrus and her legal team had a 'misunderstanding' of the legal precedent regarding copyrights. Cyrus' team was arguing that Tempo had no right to sue because it acquired Lawrence's rights to 'When I Was Your Man' without the consent of the other songwriters, therefore undercutting their right to sue. But the judge stated that this argument is 'incorrect,' noting that Tempo has an 'exclusive right' to the copyright that should not be conflated with 'exclusive ownership.'
'By transferring all of that interest, Tempo now steps into Lawrence's shoes and is a co‐owner of the exclusive rights of the copyright,' reads the ruling. 'Because Lawrence as a co‐owner could sue for infringement, Tempo as co‐owner, in lieu of Lawrence, can sue for infringement without joining the other co‐owners of the copyright.'
In a statement to Variety, a lawyer for Tempo celebrated the ruling for the case to proceed. 'We are thrilled but not the least surprised by the ruling,' said attorney Alex Weingarten. 'Our client is looking forward to having this case proceed to be resolved on its merits and are extremely confident in prevailing.'
Legal reps for Cyrus did not immediately respond to Variety's request for comment.
Following its release in Jan. 2023, 'Flowers' was a massive hit for Cyrus, spending eight weeks atop the Billboard Hot 100 and winning record of the year at the 2024 Grammys. Fans were quick to note the similarities between 'Flowers' and 'When I Was Your Man' from the start, with social media users comparing apparent similarities in lyrics.

Miley Cyrus can't quit Hannah Montana. The singer who rose to fame playing the teen who secretly moonlighted as pop star Montana on the show that debuted on the Disney Channel on March 24, 2006, told SiriusXM's TikTok Radio recently that she's working on something 'really, really special' to commemorate the series' 20th anniversary. 'I want to design something really, really special for it because it really was the beginning of all of this that now sits here today,' Cyrus said to host Chris Olsen about the show's March 2026 anniversary. 'Without Hannah, there really wouldn't be this kind of… this me. It's so crazy to think, too, that I started as a character that I thought was going to be impossible to shed. And now that's something that when I walk into a space, it's looked at as this sense of nostalgia or something that you have from your childhood, but I've now been as kind of integrated into everyone's life as the character itself. So that's exciting to get to celebrate that.' In addition to the series, Cyrus appeared as both herself and Montana in the 2008 concert movie Hannah Montana & Miley Cyrus: Best of Both Worlds Concert. Everything's coming up billions for Miley Cyrus. The singer is celebrating the news that her fifth video has crossed the one billion views mark on YouTube. The latest track to reach that hallowed height is Miley's 2013 lead Bangerz single 'We Can't Stop,' the party-starting anthem written and produced by Mike Will Made It, P-Nasty and R. City, with additional lyrics from the singer and a sample of Doug E. Fresh's hip -hop classic 'La Di Da Di.' The turn-up tune topped out at No. 2 on the Billboard Hot 100 at the time of release, notably blocked from No. 1 by Robin Thicke's 'Blurred Lines' — Cyrus and Thicke would perform a legendarily raunchy, suggestive medley of their respective hit songs at the 2013 MTV Video Music Awards. From scenes of Miley in a fishnet bathing suit making out with a doll wearing a similar outfit to the singer smashing a giant beer bottle piñata filled with hot dogs and winking drug references to 'dancing with Molly', the loud and proud debauchery finds its thesis statement in the refrain, 'And we can't stop/ And we won't stop/ We run things they don't run we/ Don't take nothing from nobody.' Cyrus had previously crossed the one-billion views mark with 2013's Billboard Hot 100 No. 1 'Wrecking Ball,' as well as 2009's 'Party in the U.S.A.,' 2013's '23' with Mike WiLL Made-It, Wiz Khalifa and Juicy J and her other No. 1 hit, 2023's 'Flowers.'
