Miley Cyrus Denied in Attempt to Dismiss Copyright Lawsuit Over ‘Flowers'
A judge has denied Miley Cyrus' request to dismiss the copyright lawsuit claiming that her 2023 smash 'Flowers' was copying Bruno Mars' 'When I Was Your Man.' Cyrus was initially sued in Sept. 2024 by Tempo Music Investments, a company that purchased the catalog rights of 'When I Was Your Man' co-writer Philip Lawrence. Neither Mars nor Lawrence are named as plaintiffs in the case, which Cyrus filed to dismiss in November. That Should've Been My Song' But in a ruling yesterday, reviewed by Variety, the judge cleared the path towards a trial by stating that Cyrus and her legal team had a 'misunderstanding' of the legal precedent regarding copyrights. Cyrus' team was arguing that Tempo had no right to sue because it acquired Lawrence's rights to 'When I Was Your Man' without the consent of the other songwriters, therefore undercutting their right to sue. But the judge stated that this argument is 'incorrect,' noting that Tempo has an 'exclusive right' to the copyright that should not be conflated with 'exclusive ownership.' 'By transferring all of that interest, Tempo now steps into Lawrence's shoes and is a co‐owner of the exclusive rights of the copyright,' reads the ruling. 'Because Lawrence as a co‐owner could sue for infringement, Tempo as co‐owner, in lieu of Lawrence, can sue for infringement without joining the other co‐owners of the copyright.' In a statement to Variety, a lawyer for Tempo celebrated the ruling for the case to proceed. 'We are thrilled but not the least surprised by the ruling,' said attorney Alex Weingarten. 'Our client is looking forward to having this case proceed to be resolved on its merits and are extremely confident in prevailing.' Legal reps for Cyrus did not immediately respond to Variety's request for comment. Following its release in Jan. 2023, 'Flowers' was a massive hit for Cyrus, spending eight weeks atop the Billboard Hot 100 and winning record of the year at the 2024 Grammys. Fans were quick to note the similarities between 'Flowers' and 'When I Was Your Man' from the start, with social media users comparing apparent similarities in lyrics. 'Emilia Pérez' Star Karla Sofía Gascón Wins Best Song Prize at Critics Choice Awards amid Controversy
Karla Sofía Gascón was among the winners recognized in the best song category at the 2025 Critics Choice Awards amid her recent backlash. Gascón, Zoe Saldaña and Camille won for the song "El Mal" from Emilia Pérez on Friday, Feb. 7. The track beat out five other songs for the prize: 'Beautiful That Way' by Miley Cyrus (The Last Showgirl), "Compress/Repress" by Trent Reznor and Atticus Ross (Challengers), 'Harper and Will Go West' by Kristen Wiig (Will & Harper), "Kiss the Sky" by Maren Morris (The Wild Robot), and "Mi Camino" by Selena Gomez (Emilia Pérez). Gascon, who did not attend the event, was also nominated at the Critics Choice Awards for best actress, though that win went to Demi Moore for The Substance. The best song win comes after Gascón, 52, apologized for the controversies surrounding her offensive resurfaced social media posts, which have since been deleted as she also deactivated her X account. In a message on Instagram this week, the Oscar-nominated actress wrote that she 'sincerely" apologizes to "everyone who has been hurt along the way' in a message on her Instagram, vowing to be silent and 'let the work talk for itself.' Related: Zoe Saldaña Is 'Disappointed' by Costar Karla Sofía Gascón's Offensive Tweets but Still 'Proud' of Emilia Pérez Her post was in response to Emilia Pérez director Jacques Audiard's interview with Deadline, in which he called Gascón's resurfaced posts 'inexcusable' and said he hadn't spoken to her. 'She is in a self-destructive approach that I can't interfere in, and I really don't understand why she's continuing,' said the French filmmaker, 72, adding that she is 'harming people who were very close to her,' including the Emilia Pérez cast and crew. 'I'm not getting in touch with her because right now she needs space to reflect and take accountability for her actions.' Composer Clément Ducol and singer-songwriter Camille teamed up to write the songs in Emilia Pérez, a musical thriller sung largely in Spanish despite the fact that both artists are French. The duo co-wrote 'El Mal,' Saldaña's indictment of corrupt members of society, with Audiard. Ducol and Camille won the Golden Globe for the track in January, and they made sure to give a shoutout to stars Saldaña and Gascón at the time. "'El Mal' wouldn't be what it is without your performance," Camille told the pair. "You just should shake the house, and shake our souls. Salud." Why Pamela Anderson Was Miley Cyrus's Role Model Growing Up
Miley Cyrus has always been anything but ordinary. When children often list their parents, doctors, of firefighters as the people that they look up to, Cyrus had a completely different concept of who she wanted to idolize, and looked none other than to Pamela Anderson for inspiration when she was older. "Ever since I was little, it was only Pam when people would ask me what I wanted to be when I grow up, I would say you," the former Disney Channel star said while in conversation with The Last Showgirl actress. "And the whole thing. The tattoos, the hair, all of it. That's all I wanted to do, I wanted to be a showgirl!' I love watching you evolve because it's been inspiring me so much." Much like how Anderson has had a style and career rebirth in recent years, Cyrus said that she could also relate to being in different stages of her life. 'I've had so many different pivots and evolutions and—one might say—detours within my path,' the pop star, who sings "Beautiful That Way" in Anderson's latest movie, said. 'But it always ends up coming back around to make the next stage of who we are. Something that's more potent, something that's more real.' Anderson explained that she sometimes wishes she could erase all the bad things from her life. When the Baywatch actress told this to a friend, he suggested that she take all the negative experiences in her life with her and use it to live authentically. Cyrus could relate, especially as she's had a few faux pas of her own. 'Funnily enough when I look back, all the mistakes, anything I was unsure of or I didn't understand, I am so proud of every moment and now every stage of my life,' Cyrus reflected. 'I would not go back and change anything. Except a couple things I was wearing!' Read the original article on InStyle
