Use Of Social Media For Disseminating Radical Ideology Falls Within Ambit Of UAPA: Delhi HC

Denying bail to an accused in a terror case, the Delhi High Court on Tuesday observed that using social media for disseminating radical information and ideology can attract charges under the UAPA.
The court refused bail to an alleged operative of the terror outfit, 'The Resistance Front', charged under the Unlawful Activities (Prevention) Act, or UAPA. It underlined his 'influence" and a high possibility of tampering with the evidence, while also saying that the dissemination need not necessarily be a physical activity.
Analysing a section of the UAPA, which deals with punishment for conspiracy, attempt, advocacy, abetment or incitement of terrorist acts, a bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar found sufficient material against accused Arsalan Feroze Ahenger. The bench said Ahenger, stated to be in his early 20s, posted photos of terrorists and incited people to commit terrorist acts.
'The said provision is framed in such a broader way that even the usage of social media or any digital activity for the purpose of disseminating radical information and ideology falls within its ambit and it is not necessary that the same is to be a physical activity," the court observed.
It said: 'It cannot be said that there is no evidence against the appellant (Ahenger) that he was closely associated with slain terrorist Mehran Yaseen Shalla or that he has actively participated in the terrorist activities himself."
As a result, Ahenger's appeal against a trial court order from September 2024 denying him bail in the case was dismissed. He was arrested on December 30, 2021.

Bhubaneswar: Following the self-immolation of a college student in Balasore, the school and mass education department on Thursday issued a directive to all district education officers (DEO)s to strictly implement measures ensuring the safety of women employees at workplaces and to create a secure environment for students in schools. The department instructed that helpline numbers related to women's safety be prominently displayed in all schools, hostels, and govt offices. These include the women helpline – 181, child helpline – 1098, police emergency response – 112, and school student helpline – 18003456722. "It is imperative that a safe environment is created in schools for all students, particularly for girl students, to support their physical, mental, and socio-emotional well-being," said school and mass education secretary Shalini Pandit in a letter to the DEOs. The department also directed DEOs to ensure compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. DEOs were instructed to not only review the implementation of the Act across all eligible establishments but also ensure the timely constitution and reconstitution of internal complaints committees (ICC)s. Already part of the social studies curriculum, the programme is designed to promote gender positive attitudes and behaviours among students, teachers, and parents, and to eliminate gender-based violence. The department warned that any delay or deviation in executing these instructions would be viewed seriously.

A 15-year-old tribal girl with a learning disability was allegedly sexually assaulted by a 40-year-old man at a village in Pune district, police said. The accused, who was booked on July 14, was allegedly beaten up by the girl's family members after the incident and has been hospitalised with fractures on his hands, the Pune Rural police said. The incident took place in a village in Pune district on the evening of July 14. Police said that the victim girl belongs to the Katkari community and she has a learning disability . 'The accused and the girl are from the same village. At the time of the incident, the victim was with another girl from her neighbourhood, standing near their houses. As the accused approached the two girls, the other girl escaped. The accused then sexually assaulted the 15-year-old girl. The accused also thrashed and threatened her,' said an officer from Pune Rural police. 'As the incident came to light, the family members and uncles of the victims beat up the accused. He has sustained fractures on both hands and is currently hospitalised. He will be placed under arrest after his discharge from the hospital,' the officer said. The accused has been booked under Bharatiya Nyaya Sanhita section 74 (Assault or use of criminal force to a woman with intent to outrage her modesty), 115 (Voluntarily causing hurt), 351 (criminal intimidation) and 352 (intentional insult with intent to provoke breach of peace). Police have also invoked provisions of the Protection of Children from Sexual Offfences Act (POCSO), including sections 8 (Punishment for sexual assault), 10 (punishment for aggravated sexual assault) and 12 (punishment for sexual harassment) along with sectionsof Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act.

Shimla: Taking serious note of a PIL claiming rave parties are being organised in the name of tourism in Kasol, Jibhi, Manali and some other parts of Kullu and Mandi districts, Himachal Pradesh HC has directed state govt to file a detailed report.
