Supreme Court upholds equal inheritance rights for tribal women
In the absence of a specific law governing intestate succession among Scheduled Tribes, Justices Sanjay Karol and Joymalya Bagchi invoked the principle of 'justice, equity and good conscience', extending the provisions of the Central Provinces Laws Act, 1875 to the case and set aside the July 1, 2022 judgement of the Chhattisgarh HC, which had upheld the lower court order denying her the inheritance rights.
The appellants, who approached the SC challenging the HC order, were legal heirs of one Dhaiya, a woman from a Scheduled Tribe. Their mother was one of the six children — five sons and one daughter, of Bhajju alias Bhanjan Gond. They sought partition of a property belonging to their maternal grandfather, stating that their mother is entitled to an equal share in the scheduled property.
The court noted that the parties not being covered by any other inheritance law, the 1875 Act would apply. Though an argument was raised that the 1875 Act has been repealed in 2018. the bench pointed out that it has a clause which protects transactions before the repeal date.
'So, the right having been accrued in favour of the appellant-plaintiffs' mother upon the death of her father, which was approximately 30 years before the filing of the plaint became crystallised and would not be affected by the fact that the Act was no longer in the statute book,' Justice Karol said writing for the Bench.

Bhubaneswar: Odisha Deputy Chief Minister Pravati Parida on Wednesday urged working women to fearlessly raise their voice against sexual harassment at workplaces and fight for their rights. Speaking at an orientation programme on POSH Act (2013) at the State secretariat, Lok Seva Bhawan, Parida said, 'Sexual harassment is not a stigma or taboo. If we remain silent, we empower the harasser. Saying 'no' is your right—use it. The government stands firmly with victims.' Parida, the only woman minister in the Mohan Charan Majhi-led BJP government, also heads the Women and Child Development department. She addressed over 600 government employees, both men and women, at the session designed to raise awareness on Prevention of Sexual Harassment of Women at Workplace (POSH) Act. Emphasising institutional accountability, she said, 'Strict directives have been issued to set up Internal Committees in all institutions and colleges to ensure proper implementation of the Act. Action will be taken against both offenders and those making false accusations.' Parida has been the target of the Opposition BJD and Congress over a brutal attack on a 15-year-old girl in Balanga, under her Nimapara constituency, who was set ablaze by unidentified assailants. Taking aim at the previous BJD regime, Parida said the POSH Act had been neglected since its introduction in 2013. The orientation programme was attended by renowned lawyer Manasi Padhi, who delivered a detailed presentation on the POSH Act during two dedicated sessions. She explained the provisions, rights, responsibilities and redressal mechanisms under the Act in depth. Opposition BJD spokesperson Lenin Mohanty, however, in an X post said, 'The Deputy Chief Minister must ensure that when a victim speaks, it is not met with institutional silence from the government or her party. Justice should not end with video messages, it must be delivered in action.' He cited the case of a student from FM College, Balasore, who reportedly faced harassment but failed to get justice due to delays and inaction by the college ICC, police and political leaders. 'The common people, along with Opposition parties, are now fighting for justice for our sister. Meanwhile, a minor girl from the area represented by Madam Pravati Parida, was set ablaze and is now fighting for her life,' Mohanty said in the social media post, adding that across Odisha, incidents of sexual harassment are being reported almost daily due to the breakdown of law and order under the BJP government. Meanwhile, in a post on X, Parida, who flew to Delhi after addressing the programme, said: 'I met the victim from Balanga, who is undergoing treatment at Delhi AIIMS. She hails from my constituency. I spoke to her family and relatives. During this visit, I discussed her health condition and treatment with the medical team and specialists providing her care. I pray to the Almighty that she recovers quickly.'

Two more OISF battalions to be created
Bhubaneswar: Chief Minister Mohan Charan Majhi has sanctioned 2,080 posts for the creation of two more battalions of Odisha Industrial Security Force (OISF), an official notification issued by the Home department said on Wednesday. This has been done because of the growing industrial activities in the State, official sources said. Of the new 2,080 posts, 1,944 will be regular, while 136 will be outsourced, the notification said, adding that with this decision, the OISF will have four battalions. The new battalions will be known as 3rd and 4th battalions, it said, adding that the total number of posts under the OISF will be 4,927. 'The State government is taking steps to focus on industrial growth in the industrialisation process in the State has accelerated after the Excellence Odisha-Make in Odisha 2025,' a CMO release said on Wednesday. Noting that the creation of an industrial atmosphere and peaceful industrial activities in the State is essential, Majhi sanctioned two more battalions under OISF, the CMO statement said. The State government, in the last eight months, has created as many as 21,000 new posts under the Odisha Police. The Home department said all positions in the new battalions will be filled through a transparent recruitment process. The process will adhere to relevant recruitment rules and the provisions of the ORV (Odisha Reservation of Vacancies) Act. Salaries will be based on the ORSP Rules, 2017, with other allowances sanctioned by the government. These will be effective from the date the posts are filled, it said. Various services for the new proposed battalions will be outsourced through service provider agencies. These services include cooks, sweepers, barbers and dhobis. An indicative manpower of 136 individuals is projected for these outsourced services across both new battalions, it said. In a related development, the State government has decided to establish 56 new courts across Odisha, a notification issued by the Law department said. Chief Minister Majhi has approved creation of 840 posts for the new courts. The sanctioned posts include 56 civil judges and other supporting staff.

Officials indicated that the government does not want to sit on the issue and may urge the presiding officers to start the impeachment process by appointing a committee of jurists to look into the allegations against the high court judge, from whose Delhi residence a wad of cash was allegedly recovered in March, give a report to Parliament. The developments come amid a debate around whether former Vice President Jagdeep Dhankhar had admitted the Opposition-sponsored notice or not. Just hours before resigning from the post on Monday evening, Dhankhar had told the Rajya Sabha: 'I need to inform you that I have received notice of motion under Article 217(1)(B) read with Article 218 and Article 124…to constitute a statutory committee for removal of Justice Yashwant Varma. This has been received by me today. It was signed by more than 50 members of the Council of States.' He then went on to read out the procedure of impeachment, as described in the Judges (Inquiry) Act. Earlier that day, a total of 145 Lok Sabha lawmakers, from various parties, submitted to Speaker Birla a notice to initiate impeachment process against Justice Varma in connection with the cash discovery row. Talking to HT, former Lok Sabha secretary PDT Achary said the government can simply ignore the notice in the Rajya Sabha as the same has not been admitted. 'The Speaker has admitted the notice. But in the Rajya Sabha, the chair informed the House that he had received it. In this case, the Lok Sabha will have preference,' Achary added. According to the Judges (Inquiry) Act: 'Provided that where notices of a motion referred to in sub-section (1) are given on the same day in both Houses of Parliament, no Committee shall be constituted unless the motion has been admitted in both Houses and where such motion has been admitted in both Houses, the Committee shall be constituted jointly by the Speaker and the Chairman.' Though both notices were given on the same day, there is a debate whether Dhankhar had admitted it or not. Opposition leaders insist that the notice was admitted as Dhankhar had mentioned it in the House. 'While admitting the notice, he also informed the House that he had asked the secretary general to find out if a similar notice had been admitted or not and then read out the legal provisions if notices are admitted on the same day in both House,' an opposition leader said. A senior Lok Sabha functionary said that with Dhankhar now gone, Harivansh is unlikely to emphasise on the notice. A section of the Lok Sabha officials sounded confident that the impeachment debate will start from the Lower House. A senior government functionary said the government would prefer to proceed for impeachment with the notice served in the Lok Sabha as it has signatures of more than 10 parties, including the BJP. 'The government is in no mood to take up the Opposition-sponsored notice,' the functionary added.
