Kizik brings legal dispute with Skechers to Europe

HandsFree Labs (HFL), the parent company of Kizik, has extended its legal dispute with Skechers USA to Europe, where it has now filed a trademark infringement complaint with the Unified Patent Court in Munich, Germany. In the complaint, issued by Fast IP, LLC – the intellectual property (IP) holding company of HFL – and seen by WWD, a disputed amount of one million euros was cited. The number serves as a preliminary estimate used to get the lawsuit filed, the media outlet noted. HFL has named the German, Swiss, Belgian, Italian and French arms of Skechers operations in the suit, which bears resemblance to the complaint already underway in the US. As such, HFL is once again targeting Skechers' Hands Free Slip-Ins line, the products of which it claims infringe on a number of its utility and design patents Akin to its US filing, HFL has called for Skechers to be banned from selling its hands-free shoes in 18 European countries, and is seeking to recall products placed on the market since July 9. HFL is also requesting provisional damages amounting to 200,000 euros, as well as other monetary damages. HFL had initially launched its legal quarrel with Skechers in July. According to its filing with a court in Texas, the company believes Skechers had 'knowingly and willfully' infringed on its patents that protect 'ornamental innovations'. Gareth Hosford, HFL's CEO, said the company was 'forced to defend' its hands-free technology 'against a company that chose to imitate rather than innovate'. Skechers later publicly responded to the lawsuit, calling HFL's claims 'baseless' and stating that it intended to 'aggressively challenge both the validity of the patents and the infringement claims'. In its statement, the footwear giant said it had 'obtained more than 140 utility and design patents worldwide, including in the US'. It also expressed suspicion at the timing of the lawsuit, which came shortly after the announcement that the brand was to be taken over by 3G Capital in a 9.42 billion dollar merger. In regards to this latest complaint, a Skechers spokesperson told WWD that the company had 'no further comment'.

Aldi shoppers warned to check receipts over mystery charge after till glitch

Customers were baffled over being charged an added 'deposit' for certain products CHARGED UP Aldi shoppers warned to check receipts over mystery charge after till glitch Click to share on X/Twitter (Opens in new window) Click to share on Facebook (Opens in new window) ALDI has urged shoppers to check their receipts as they may be owed refunds over mystery charges that appeared following a till glitch. Dozens of baffled shoppers took to social media this week to complain about being charged a "deposit" of up to 25p on bottled drinks. Sign up for Scottish Sun newsletter Sign up 1 One Aldi shopper from Park Road in Castleford shared a picture of their receipt to Facebook showing the deposit charges (Credit: Aldi UK Shoppers) The supermarket confirmed to The Sun that customers in some stores were "incorrectly" charged, adding that the error has since been corrected. It said any customers who were overcharged should take their receipt to their nearest Aldi store for a refund. Aldi's Castleford store in Yorkshire was one of the branches hit by the till glitch. One of the store's customers posted a picture of their receipt to Facebook, revealing they had been charged a 15p deposit on each of the two 2L bottles of Diet Cola they had purchased. Another customer at Aldi in Rothwell, Leeds, also posted to Facebook that they had been charged 15p on a 2l bottle of Vive. Aldi's Hindley Green branch in Manchester also appears to have been impacted, with one customer claiming they were charged a 15p deposit for two bottles of orange juice. Other customers claimed to have been charged 25p deposits on some drinks purchases. Aldi shoppers in Ireland are charged deposits of 15p or 25p on plastic bottles or aluminium cans, which can be reclaimed once the empty items are returned to vending machines, as part of the government's Deposit Return Scheme. However, the Aldi did not confirm if the charging errors at UK tills were related to this. An Aldi spokesperson told The Sun: 'A minor pricing change was incorrectly applied to a small number of products in some of our stores. The error has now been corrected, and the products are on sale as normal. Aldi urgently recalls £3.29 freezer essential over dangerous disease that affects 1 in 100 of Brits 'We apologise for any inconvenience this has caused and would encourage anyone that believes they were overcharged to take their receipt to their nearest Aldi store for a refund.' The German discounter is planning to open more than 20 new stores in the UK before the end of the year as part of a £650million expansion. It recently confirmed the locations of 11 of its new openings, which includes branches in East Sussex, Durham and Chesterfield. However, it's pulling up the shutters on branches in Deeside, Market Harborough and London over the coming months. In May, it revealed another list of 10 locations where it wants to open stores this summer, including in Yorkshire, Derbyshire and Norfolk. The budget chain has injected £55million into its capital city stores alone, with four of the new branches being in London. The company opened Braeside Bond 12 months ago, with both investors and collectors quickly attracted to the merits of the 20,000 sq. ft. bond overlooking the River Tay. Distillers, cask owners and importers from around the globe use the warehouse, which has capacity to securely house around 14,000 casks. Safely handling the casks is paramount, and Spiritfilled recently took further steps to bring additional security to its operations with an equipment investment, including its first electric forklift truck. Advertisement Hide Ad Advertisement Hide Ad The German-made 5-tonne Jungheinrich counterbalance forklift has a 7,500mm lift height / 3,300mm closed height mast and comes with an enhanced gas detection and control solution, which checks the atmosphere around the truck for vapours before allowing it to power on. Secure: New machinery. Spiritfilled has also added a cask rotator and a cask tilter, with both pieces of hydraulic equipment - manufactured by McGowan Engineering of Cambuslang - able to attach to the carriage plate on the forklift truck itself. The rotator allows the safe and efficient palletising of filled casks, while the tilter is needed for stowing and de-stowing in the recently installed state-of-the-art racking system, housing both barrels (typically 200L) and hogsheads (typically 250L) - the two most commonly traded cask formats in the private whisky investment market. Braeside Bond operations manager Torin Currie said: 'The electric forklift has great benefits from an environmental perspective and also operationally. Advertisement Hide Ad Advertisement Hide Ad 'The cask handling attachments are innovative pieces of machinery which will bring many benefits for clients and reinforce investors' confidence in how we protect their assets. Safe handling: Forklift. 'It reduces the wear and damage to assets in long-term maturation, which is key, while also demonstrating our premium handling standards to future buyers and brokers. 'It enables transparent storage practices for audit or resale events and, importantly, aligns with HMRC warehouse compliance for bonded storage procedures.' The upgrade comes after the company's recent six-figure investment in its advanced racking system.
