SC observations vindicate State's stand on V-C appointments: Bindu

The Hindua day ago
Higher Education Minister R. Bindu has said that the Supreme Court's observations on Vice-Chancellor (V-C) appointments affirm the State government's position that all authorities must act within the bounds of the law.
The Minister, while addressing media persons here on Wednesday, said the apex court's remarks have clearly upheld the constitutional role and authority of the State government in the process.
'The Supreme Court has explicitly referenced key statutory provisions, including Section 13(7) of the APJ Abdul Kalam Technological University Act and Section 11(10) of Kerala University of Digital Sciences, Innovation and Technology Act, which mandate that V-C appointments must be made in consultation with or on the recommendation of the State government. Despite the courts having pointed this out repeatedly, those in charge have challenged the framework and acted unilaterally,' she said, taking a swipe at Governor Rajendra Vishwanath Arlekar.
Dr. Bindu, however, declined to comment on the State's response to the Supreme Court's directive to submit names for the search-cum-selection committee that will be tasked with recommending candidates for the V-C posts at the two universities.
She maintained that the move is not an interim verdict, but rather a procedural step, and that the final ruling is yet to come. The government will present its views before the court when the case is taken up for hearing on Thursday, the Minister added.

SC order on Bihar voter roll revision vindicates concerns: CPI(ML) leader Dipankar Bhattacharya

Patna, CPI Liberation general secretary Dipankar Bhattacharya on Thursday said the Supreme Court's interim order on the ongoing Special Intensive Revision of electoral rolls in Bihar has "vindicated" the concerns raised by civil society and opposition parties since the controversial drive began. SC order on Bihar voter roll revision vindicates concerns: CPI(ML) leader Dipankar Bhattacharya In a statement issued after the SC order, Bhattacharya said, "Finally, we have an interim order from the apex court in Bihar's SIR case. The order rejects the EC's stubborn refusal to heed the suggestions already made by the Supreme Court and addresses three core concerns about the practical implementation of the drive. This interim order vindicates some of the basic objections and apprehensions raised from day one since the sudden launch of the SIR". Earlier in the day, a bench comprising Justices Surya Kant and Joymalya Bagchi directed the EC to publish the names of the 65 lakh voters deleted from the list, along with reasons for deletion, to ensure transparency. The bench passed the order while hearing pleas challenging the June 24 EC decision to conduct the SIR of the electoral rolls in Bihar. "The issue of legality of SIR is yet to be determined by the Supreme Court. The interim order asks the EC to come clean about all the deletions with specific assigned reasons, make the information public and accessible to all electors, not routed through Booth Level Agents of political parties, and accept Aadhaar as a valid supporting document", Bhattacharya said Bhattacharya is one of the petitioners who moved the top court, seeking direction for quashing the EC order. "What happens to the 3.5 million migrant workers whose names have been removed? For people like Mintu Paswan, declared dead by the SIR, this could be a second lease of electoral life," he added. He called for the EC to take responsibility for correcting its errors, suggesting the establishment of grievance redressal camps at booth and block levels. "The scale of exclusion is massive, time is short, and most electors have been penalised without fault. "The onus of correction should also be put on the perpetrators of error. That is the principle of fairness, natural justice and transparency that the EC had invoked as guiding tenets for the SIR in its counter affidavit filed before the SC on July 21", he said. Violence marks ‘Partition horrors day'

Following Governor Rajendra Vishwanath Arlekar's directive to universities, the Akhil Bharatiya Vidyarthi Parishad (ABVP), the student wing of the Bharatiya Janata Party, organised 'Partition horror day' on Thursday on a few campuses in Kerala, leading to clashes with the Students' Federation of India (SFI), the student wing of the CPI(M), in some places. The State government had on Wednesday issued a directive to the universities and colleges against organising any events related to the day on campuses citing the possibility of disturbance of communal harmony. The ABVP organised events at the Central University of Kerala (CUK) in Kasaragod, Government College, Kasaragod, Govinda Pai Memorial Government College, Manjeswaram, on the Calicut University campus at Tenhipalam, and at VTM NSS College at Dhanuvachapuram in Thiruvananthapuram. While the event held at the VTM NSS College went peacefully, SFI activists turned up in big numbers to resist the event organised at the Government College at Kasaragod. The SFI activists tore down the posters put up by ABVP, leading to clashes between the two groups, before the police intervened to stop them. The SFI also burned the Governor in effigy outside the college campus. Later, the ABVP attempted to again put up the posters on the college campus, when activists of the Muslim Students Federation (MSF), the student outfit of the Indian Union Muslim League (IUML), attempted to resist the move. On the Calicut University campus, the pro-Sangh Calicut University Employees' Centre attempted to hold an event to mark the day. However, activists of the SFI, Kerala Students Union (KSU), and the MSF tried to prevent them. This led to clashes and raising of slogans between the two groups. A large posse of police personnel, who were present on the campus, removed the student activists from the place to avert further trouble. At the Government Law College, Kozhikode, it was the ABVP which tried to conduct a programme outside the campus. However, since they had not taken permission to hold the event outside, the police took the activists into custody. Activists of the SFI, KSU and the MSF, meanwhile, raised slogans against them. Skirmishes were also reported from the CUK in Kasaragod. The ABVP, in a statement, claimed to have organised related events at the Institute of Human Resources Development (IHRD) College at Kumbala and the Chendayad MG College in Kannur. At the Cochin University of Science and Technology (Cusat), an online seminar was held as part of the observance of the day with G. Gopakumar, former Vice-Chancellor of the CUK, delivering an address. Cusat Vice-Chancellor M. Junaid Bushiri attended. SFI State secretary said the very fact that it was organised in a surreptitious manner exposes the fact that the organisers were convinced that the event was unacceptable to society and would have invited stiff opposition. Declared dead by EC, Bihar man visits CEO's office to say he is alive

Patna, Aug 14 (PTI) A resident of Bhojpur district in Bihar on Thursday called on the Chief Electoral Officer of the state to plead that he was alive. Mintu Paswan, who was earlier this week produced before the Supreme Court, was taken to the CEO's office by a delegation of CPI(ML) Liberation. 'I don't know whether I was seen as an apparition by the officials. The fact remains that I have been distraught to learn that I have been declared dead in the special intensive revision (SIR)," Paswan told reporters here. He alleged that no booth level officer (BLO) had visited his home. CPI(ML)-L secretary Kunal, who was present on the occasion, said, 'Anomalies of this type are the very reason behind our general secretary Dipankar Bhattacharya opposing SIR in the Supreme Court. Mintu is being asked to fill up Form 06, meant for registration of new voters, even though he has voted in the past". The CEO has asked him to hand over the form to the BLO concerned, who already stands exposed for a goof-up, the Left leader asserted. 'He (the BLO) has confessed to his mistake and told the CEO that Mintu's name got struck off instead of another person," said Kunal. Replying to a query from journalists, he said, 'We have identified altogether 21 people, so far, who have been wrongfully declared dead, leading to deletion of their names. Of them, 10 were produced before the Supreme Court. He added that the apex court was convinced of the mistake in only two instances – one was of Mintu and the other was that of a woman in Raghopur. Incidentally, Raghopur is the assembly seat of the leader of the opposition Tejashwi Yadav, whose party RJD is an alliance partner of the Left. 'We do not know how effective the intervention by the Supreme Court is going to be. The Election Commission has been brazening it out, falsely claiming that political parties are not coming up with any claims or objections. We shall keep helping as many people as possible in getting their names included in the voters' list," Kunal said.
