Andhra Pradesh govt may refund ₹2,500 crore as HC strikes down hike in industrial power duty

Time of India2 days ago
The cash-strapped N Chandrababu
Naidu government
may have to foot a bill of about ₹2,500 crore as the Andhra Pradesh High Court has struck down an electricity duty levied on industrial and commercial establishments by the previous
YSRCP government
.
The issue pertains to a duty levied on the sale of each unit of electricity. Under the Andhra Pradesh Electricity Duty (Amendment) Act, 1994, the state had levied 6 paise per unit of "electricity duty" on all consumers, except on power sold to the Centre and the railways. In 2022, the then Jagan Mohan Reddy-led YSRCP government increased this levy to ₹1 for industrial and commercial users through a government order. Andhra Pradesh's textile and ferro alloys industries challenged this order in the court, terming it "discriminatory" to industry as these two industries are heavy consumers of power, which accounts for 50 per cent of their input costs.
A bench of Andhra Pradesh chief justice Dhiraj Singh Thakur and justice R Raghunandan Rao on Friday scrapped the government order through which electricity duty was enhanced. The order reads: "GOMs No 7, dated 08.04.2022 is struck down. However, the government is entitled to collect duty at the rate of 6 paise per unit, throughout the period from the date when Act of 2021 was published in the Gazette till such time as the rate of duty is modified, in accordance with law."
Since the government order has been struck down, it will need to refund 94 paise per unit collected in excess from industrial and commercial consumers.
A government source, who did not wish to be identified, told ET: "Industrial consumption of electricity is about 1,539 crore units per year. We will be calculating the dues per user. It will be about ₹2,500 crore." The government is weighing options, including appealing in the Supreme Court and adjusting future bills of consumers.
Sri Anantha Laxmi Spinning Mills executive director
Paani Kumar Samineni
told ET: "The government collected 94 paise excess electricity duty for 18 months till different associations got a stay order from court. This order will help consumers in recovering these dues running into hundreds of crores." The enhanced duty was collected till October 2023.

Express RTI: Uttarakhand finance dept questioned Beatles ashram revamp by Bimal Patel firm, state govt gave go-ahead

The Uttarakhand Finance department had flagged the selection of Bimal Patel-led and Ahmedabad-based HCP Design, Planning and Management Pvt Ltd by the state Tourism department for the revamp of Chaurasi Kutiya ashram, popularly known as The Beatles ashram, without a tender, reveal documents obtained under the RTI Act. The documents, reviewed by The Indian Express, show that the Tourism department justified the selection of HCP through single-source procurement by pointing to the complexity of the heritage cum eco-tourism project, and the expertise of the 'world-class' company, which had executed major projects such as the Kashi Vishwanath Corridor and the Central Vista redevelopment near Parliament. While the Finance department did come around to clearing the project, it recommended obtaining a priori the approval of the Forest department, and asked the Tourism department to ensure the rate reasonableness and the fees paid to the company, the documents showed. Following rounds of discussion, the Uttarakhand Cabinet approved hiring HCP as the consultant on August 3, 2023. The Beatles ashram is situated inside the Rajaji National Park in Rishikesh and was visited by the British band in 1968. While the cost of the consultancy is Rs 1.9 crore for the master plan lump sum and a fee of 4.75 per cent of the actual cost of the project for supervision support, Rs 15 lakh was levied for a one-day workshop, site visit, and broad design framework report. This was borne by the Tourism department, while the cost for the actual project will be borne by the Forest department. The complex has nearly 25 buildings, of which 12 will be revamped in the upcoming project. The actual project cost is over Rs 98 crore. The project will primarily involve the retrofitting of structures by strengthening the reinforced concrete beams and slabs. When contacted, Anand Patel, who helms the project at HCP, said that they received a request from the Tourism department in late 2021. 'We declined it then because the architectural intent was unclear. We visited the site twice or thrice, and in 2023 again, they requested and we submitted a proposal,' Patel said. On the conditions set by the Finance department, Patel said he was unaware. 'The conditions by the Forest department were factored in, and our agenda is to make the buildings safe and improve awareness on yoga, art, forest, and wildlife of the area,' he said. The bone of contention between the Finance and Tourism departments was over Rule 59 of Chapter 4 of the Uttarakhand Procurement Rules, 2017. This rule states that services from a single-source consultant can be obtained only after due justification is recorded and approval is obtained from the competent authority. For projects exceeding Rs 25 lakh, approvals from the administrative department and the finance department are mandatory. In giving the approval, then finance secretary, Dilip Jawalkar, said in his June 20, 2023, letter that the consultancy fees should be justified on the basis of the firm's agreements with other governments, wherein the same firm has secured the work through a competitive process. He also said that the department should justify the rate reasonableness based on a market survey and after comparison with the rates discovered through a bidding process for similar or comparable assignments for the Uttarakhand government. 'The department should get a formal consent from the Forest department before taking the proposal before the Cabinet, since the general impression is that the Forest department keeps changing its decisions and fails to honour its commitments,' he said. One of the officers in charge of the consultancy process, Satish Bahuguna, said that the Uttarakhand Tourism Development Board was not aware of the 'opinion' of the finance department on the matter, and whether the market survey suggested was conducted. 'This is the opinion of the department. If it goes to the cabinet and approval is given, the decision stands over any suggestions,' he said. Jawalkar told The Indian Express that their responsibility is to 'give advice on the file of the department'. 'What department does subsequently is not in our purview,' he said. The then tourism secretary, Sachin Kurve, did not respond to calls and messages seeking a comment. Aiswarya Raj is a correspondent with The Indian Express who covers South Haryana. Mohali court extends Majithia's VB custody by 4 days in DA case

The Mohali district court on Wednesday extended the vigilance remand of Shiromani Akali Dal (SAD) leader and former Punjab minister Bikram Singh Majithia by four days in a disproportionate assets (DA) case, allegedly involving the laundering of ₹ 540 crore of 'drug money'. Majithia,50, was produced in the court amid tight security after his seven-day vigilance remand ended on Wednesday. (HT File) Majithia,50, was produced in the court amid tight security after his seven-day vigilance remand ended on Wednesday. During the hearing, which lasted close to four hours, the prosecution accused Majithia of not cooperating with the probe agency. The prosecution informed the court that further remand was necessary to investigate Majithia's alleged benami property spread across 400 hectares in Shimla adding that he was not cooperating with the investigation. The prosecution also submitted relevant documents pertaining to the Shimla property in court to support the remand request. Speaking to the media after the hearing, public prosecutors Ferry Sofat and Preet Inder Pal Singh said the remand was extended after the VB filed an application seeking additional custodial interrogation. Majithia was arrested on June 25 in the case allegedly involving the laundering of ₹ 540 crore of 'drug money'. A detailed seven-page FIR, registered in VB (flying squad) police station, Mohali, by AIG Swarandeep Singh is based on the SIT's investigation into the 2021 drug-trafficking case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act registered against Majithia under the Congress government. The FIR outlines an extensive money trail linking shell companies, suspicious foreign transactions and unexplained asset accumulation. The action was taken on the basis of a 2018 report of the anti-drug Special Task Force. Majithia's defence team, led by advocates Arshdeep Singh Kaler and HS Dhanoa, opposed the plea, arguing that no new evidence had been presented. 'The prosecution merely repeated the same allegations already addressed in earlier hearings,' Kaler said, adding, 'All these arguments have been placed before the Supreme Court (by the government). The investigating agency found nothing during raids conducted at Majithia's residences in Himachal Pradesh, Majitha, and Chandigarh.' Majithia was arrested by the Vigilance Bureau on June 25 from his residence in Amritsar's Green Avenue. He was initially remanded to seven days' custody on June 26. With that term ending on Wednesday, he was brought to the court under tight security at 10:15 am, and the court announced its decision at 2:45 pm following detailed arguments from both sides. The defence also objected to the vigilance bureau's latest request to take Majithia to Gorakhpur, stating that the Saraya Group of Industries, mentioned by the prosecution, had no active association with him. 'Majithia resigned from the company before entering politics. He holds only an 11% share and hasn't visited Gorakhpur in the past 16 years,' Kaler claimed. Kaler further alleged that the Aam Aadmi Party (AAP) government was misusing its powers by placing Akali Dal leaders and supporters under house arrest. 'This case is politically motivated, and the government has gained nothing from it,' he added. Majithia has also approached the Punjab and Haryana high court, challenging the seven-day remand. The petition is scheduled to be heard on Thursday. Majithia spent more than five months in Patiala jail and walked out of prison in August 2022 after the Punjab and Haryana high court granted him bail.
