SHAH ALAM – The daughter of former prime minister Datuk Seri Najib Razak, Nooryana Najwa, expressed her gratitude after the Federal Court rejected the Attorney General's appeal in the case involving the alleged Royal Addendum.
Following the court's decision, she posted a message on Instagram dedicated to her father.
She shared words of encouragement and wrote, 'We live to fight another day and for that, Alhamdulillah, I am grateful.'
The Attorney General's appeal had sought to reverse an earlier decision that permitted Najib to pursue a judicial review.
The review seeks confirmation from the government or six named parties regarding the existence of the Royal Addendum.
With the dismissal, the judicial review will now proceed at the Kuala Lumpur High Court on the scheduled dates.
The ruling was delivered unanimously by a three-judge panel led by Chief Judge of Malaya, Tan Sri Hasnah Mohammed Hashim, sitting alongside Federal Court judges Datuk Zabariah Mohd Yusof and Datuk Hanipah Farikullah.
The case timeline is as follows: On Jan 6, the Court of Appeal had granted Najib permission to initiate judicial review proceedings. He sought a directive requiring the government or six others to confirm the validity of the document, which is dated January of the previous year.
In the application, Najib named the Home Minister, the Commissioner General of Prisons, the Attorney General, the Pardons Board for the Federal Territories, the Minister in the Prime Minister's Department (Law and Institutional Reform), the Director-General of the Legal Affairs Division, and the Government of Malaysia as respondents.
Among the reliefs requested was a copy of the royal decree from the 16th Yang di-Pertuan Agong relating to a reduction of his prison sentence and fine. He also sought an order that, if the Addendum was found to exist, one of the respondents would be obligated to enforce it by transferring him from Kajang Prison to his home in Kuala Lumpur to serve the remainder of his sentence under house arrest.
Najib had been serving his sentence in Kajang Prison since August 23, 2022, after being convicted for misappropriating RM42 million from SRC International Sdn Bhd. He filed a petition for a royal pardon on September 2, 2022, which later resulted in the Pardons Board reducing his sentence from 12 years to six, and lowering the fine from RM210 million to RM50 million.
On July 3 of the previous year, the High Court had rejected Najib's initial bid to commence the judicial review. The High Court had ruled that the four affidavits submitted in support of Najib's claims were hearsay and inadmissible as evidence, and that decision had been challenged at the Court of Appeal.

Johor MCA raises concerns over education access, healthcare and economic issues

PETALING JAYA: Johor MCA has voiced concern over several pressing national issues, including education access, healthcare, and economic issues, while pledging to continue defending the rights of the people. MCA president Datuk Seri Dr Wee Ka Siong, who chaired the 11th state executive committee meeting in Johor Baru, said the committee was particularly alarmed by the growing trend of public universities recruiting students through direct admission channels at high fees. 'One of the issues we discussed was public universities recruiting both local and international students through direct admission channels at exorbitant fees which reduce the opportunities for locals to enter these universities. 'Thankful for Johor MCA for their support in voicing our concerns for the people, especially those from middle and low-income groups, in defending their right to tertiary education,' he said on Facebook on Saturday (Aug 16). Dr Wee said the committee also discussed several national issues of public concern, including the 13th Malaysia Plan, the tragic death of 13-year-old Zara Qairina Mahathir in Sabah, the assault on the son of former economy minister Datuk Seri Rafizi Ramli, and the Federal Court's decision to allow former premier Datuk Seri Najib Razak to seek a judicial review over the royal addendum order that could see him serve his sentence under house arrest. On internal party matters, Dr Wee said preparations were underway for the upcoming Johor MCA state convention. "The meeting also deliberated on ongoing construction works by DBKL in front of Wisma MCA, the controversial Health Ministry Rakan scheme that allows wealthier patients to skip queues for treatment, the impact of the expanded sales and service tax (SST) on consumers, and developments in the Sabah state election. 'I am grateful that MCA leaders at all levels continue to give me their full support in raising issues that matter to the people. "MCA will remain committed to defending the rights and interests of the rakyat,' added Dr Wee.

Earlier, he presented a mock cheque to the surau management. Mohd Naim also visited Ma'ahad An-Noer, a centre for higher Islamic and Al-Quran studies founded by Syeikh Muhammad Nuruddin Marbu Al-Banjari Al-Makki. Chief Justice hails Sri Ram as 'force of legal brilliance'

KUALA LUMPUR: Chief Justice Datuk Wan Ahmad Farid Wan Salleh paid a heartfelt tribute to the late Datuk Seri Gopal Sri Ram, hailing the former Federal Court judge as a towering figure in Malaysia's legal landscape. He said Sri Ram was a man of sharp intellect, unwavering principle and fearless independence, whose contributions to the judiciary and the rule of law remain unparalleled. "On a personal note, to me, he was not just a judge. He was my friend, my teacher. And to the legal fraternity, he was a force of legal brilliance, integrity and courage. "His judgments were masterclasses in reasoning, his words carried the weight of justice, and his unwavering commitment to the rule of law sets a standard that continues to inspire. "Whether in constitutional matters, commercial disputes, or ground-breaking public interest cases, his contributions have left an indelible mark on Malaysia's legal landscape, shaping Malaysia's jurisprudence for generations,' he said in his speech at the launch of the book "Quintessential Gopal Sri Ram' at a hotel here on Saturday (Aug 16). The event coincided with Sri Ram's 82nd birth anniversary. He died on Jan 29, 2023. Wan Ahmad Farid, who was appointed as the 17th Chief Justice of Malaysia last month, recalled a personal encounter with Sri Ram in 1994, when he was practising in Kuala Terengganu. He said his client insisted on a good team and specifically mentioned Sri Ram. "Of course, that, in effect, meant that I was not good enough. I then took the liberty to call his office and speak to him, explaining that my firm was the solicitors on record and of my client's desire to engage him as a senior counsel. "To my surprise, he told me: 'I have heard about you, Farid. I'll see you and your client in Kuala Terengganu tomorrow',' said the top judge. Wan Ahmad Farid said they went on to have an excellent strategic discussion, during which his client suddenly asked: "Encik Sri Ram, with this amount of fees that I am paying you, could you guarantee success?' "Came the crisp reply: 'I am not an insurance company in the business of guaranteeing anything',' said Wan Ahmad Farid. Speaking about the book, he said this publication by Thomson Reuters is more than just a compilation of his judgments; it is a testament to his enduring influence. He said for young lawyers, the book is an essential guide to judicial reasoning at its finest, while for seasoned practitioners, it is a reminder of the heights the profession can achieve when guided by wisdom and principle. "And for the judiciary, it stands as a beacon of the values we must uphold,' he said.- Bernama
