Delhi govt to review 20 years of arbitration cases exceeding Rs 1 crore
This comprehensive audit aims to assess the extent of financial losses arising from legal disputes and bring transparency to how public funds were spent or lost in the last two decades, said officials.
This comes a day after Chief Minister Rekha Gupta directed the Anti-Corruption Branch (ACB) to probe irreugularities in the construction of the Barapullah Phase III corridor and the arbitration case that arose due to delays.
Accusing the then AAP government of corruption, Gupta had highlighted that the project, scheduled for completion in October 2017, was repeatedly delayed and eventually ran into arbitration. 'The ruling favoured the contractor with an award of Rs 120 crore. When the payment was withheld, the company approached the High Court, which, in May 2023, ordered the PWD to pay Rs 175 crore, including interest and GST. The sum was subsequently paid during the tenure of then-PWD Minister Atishi,' read a statement from the CM's Office (CMO) issued on Monday.
The three departments, which manage roads and drains, have been asked to provide year-wise and award-wise data — including the total number of arbitration cases exceeding Rs 1 crore; cases decided against the government, along with brief descriptions; the amount paid or losses incurred in such cases; and the number of appeals filed before making payments.
'This audit comes amid mounting concerns over repeated legal setbacks in infrastructure and civil works, many of which have resulted in heavy payouts to private contractors,' said officials.
Earlier, PWD Minister Parvesh Sahib Singh had announced the removal of arbitration clauses from the department's new contract conditions. This means that any future disputes between the department and contractor will be settled exclusively in court.
'Public funds must be treated as sacred. For years, departments have settled claims through arbitration without exhausting legal options — this won't continue. We are auditing two decades of arbitration history to identify who was responsible and why legal battles were surrendered. Importantly, I have now removed the arbitration clause from PWD contracts. If there's a dispute, let it go to court. No easy money through arbitration anymore,' Singh said.
Officials said that this strategic shift is expected to act as a strong deterrent to frivolous claims and force all stakeholders — government and contractors alike — to approach project disputes with more seriousness and legal preparedness.
'With this 20-year review, the Delhi government aims to establish structural reforms in contract enforcement and legal strategy — preventing future financial haemorrhage and reinforcing public trust in governance,' said officials.

The irony was inescapable on Wednesday when ministers paid floral tributes at the mass grave of landslide victims in Puthumala, a village which is just 0.85km away from the tunnel road site. Puthumala itself saw a deadly landslide in 2019 that killed 17 people. Even as state govt moves ahead with the controversial Rs 2,134-cr tunnel road project, the plan is facing fresh scrutiny. It has now come to light that the approval process involved several procedural lapses—especially in how the environmental impact assessment (EIA) was handled by an agency linked to the state govt. There are also allegations that the project proponent withheld key information while seeking Stage-1 forest clearance. Questions have been raised about whether state level environment impact assessment authority (SEIAA) had the proper jurisdiction to assess the project. Despite warnings in the report that the tunnel route passes through landslide-prone terrain where major landslides occurred in 2019 and 2024, state-level expert appraisal committee granted environmental clearance (EC) in March. MoEFCC's expert appraisal committee (EAC) granted the final EC in May laying down 60 conditions—despite acknowledging that the tunnel would pass through vulnerable and landslide-prone terrain, reportedly relying on SEIAA's appraisal. Tired of too many ads? go ad free now Earlier, Wayanad Prakrithi Samrakshana Samiti had raised concerns with the Centre, arguing that the project falls within eco-sensitive area (ESA) villages and should have been treated as a Category-A project. According to EIA notification, any Category-B project located within 5km of an ESA must be treated as Category-A and appraised at the central level by EAC. Samiti said the project's ESA status was deliberately downplayed. It pointed out that while seeking approval to divert 17.2 hectares of forest land, PWD's executive engineer falsely declared in Form A that the project did not fall within any protected or ESA zones. However, the tunnel route clearly passes through ESA villages—specifically Thiruvambady in Kozhikode and Vellarimala in Wayanad—and should have been assessed by EAC, not at the state level. Director of Hume Centre for Ecology and Wildlife Biology CK Vishnudas said that the tunnel alignment passes through terrain marked as high landslide hazard zones by Kerala State Disaster Management Authority. "It's an ecologically fragile area and carries a high risk of future landslides, especially near the crown of the 2024 Mundakkai landslide," he said. Environmentalists have also questioned the credibility of EIA study. It was conducted by Konkan Railway Corp Ltd and KITCO—both institutions with strong links to Kerala govt. The state is a stakeholder in Konkan Railway, the project's special purpose vehicle and KITCO was founded by the state with IDBI and public sector banks. Their close ties to the govt raise serious concerns about the objectivity and independence of the EIA process. As govt pressed ahead with the project through a region repeatedly scarred by landslides, environmentalists cautioned that neglecting ecological safeguards and past lessons could lead to disastrous consequences. Bhopal-based Dilip Buildcon Ltd had bagged the tunnel construction contract.

49 more families added to list of beneficiaries
Kozhikode: State govt included an additional 49 families in the list of beneficiaries for rehabilitation of those affected by the Mundakkai-Chooralmala landslides. Revenue minister K Rajan announced this at the memorial meeting held for victims of the landslide at MSA auditorium, Meppadi, on the tragedy's first anniversary on Wednesday. State cabinet decided to include the 48 families recommended by DDMA and one case, which came up during hearing, in the list, he said. Rajan said hearings were held for 100 persons, who submitted applications for inclusion in the list, and physical examination as per guidelines would be held in Aug and a decision taken accordingly. The decision to include 49 persons will provide relief for families that complained of being excluded from the list citing technical reasons. Rajan said govt was working towards completing the construction of houses in the township by Dec 31. Cabinet decided to construct a memorial at 'July 30 Hridayabhoomi' burial site at Puthumala where many victims of the disaster are buried, he said. Govt approved a proposal worth Rs 99.93 lakh submitted by Nirmiti Kendra for memorial construction. He said Rs 6 crore was issued for follow-up treatment expenses of those injured in the landslide and the free treatment scheme was extended from Aug 31 to Dec 31. One hospital will be assigned as nodal hospital and treatment bills from private hospitals will be reimbursed, he said. Many landslide survivors complained of being forced to pay from their pockets for treatment at private hospitals. Cabinet also decided to provide compensation to entrepreneurs who lost their livelihood in the Chooralmala disaster. A committee comprising Wayanad collector and senior officials from local self-govt and industries departments will review and recommend the compensation amount and eligibility criteria. Cabinet instructed Wayanad collector to take urgent steps to grant record of rights (ROR) for land identified to rehabilitate 13 tribal families affected by the landslides. Steps will be taken to issue ROR for five hectares.

Moral education essential for developed India: Nayab Saini
Agency: PTI Last Updated: Chandigarh, Jul 30 (PTI) Haryana Chief Minister Nayab Singh Saini Wednesday said moral education for children is a must to make India a developed nation. He said that students from classes 10 to 12 in the state have been distributed five lakh tablets, nearly 40,000 classrooms have been equipped with digital boards, and 1,201 IT labs have been set up. Saini was addressing the Smart Class Expansion Programme, organised by the Sampark Foundation and the Education Department in Ladwa, Kurukshetra district. Earlier, Saini launched a Smart TV Education Project from Ladwa. The Sampark Foundation has provided Sampark TV Boxes in 7,000 state schools, he said. The package includes digital versions of Haryana board textbooks, videos, worksheets, and assessment modules. A total of 1,485 schools have been equipped with LED TVs, the chief minister said. As many as 132 schools of Ladwa and Babain blocks have been developed as 'smart classes' with such TVs, he said. Saini said that education is not just confined to bookish knowledge but is a powerful medium that shapes the future of individuals, society, and the nation. He said Atal Tinkering Labs have been set up in all 22 districts of the state, and more than 5,000 schools have been provided with Wi-Fi connectivity. Sampark Foundation founder Vineet Nayar said his foundation aims to create curiosity for learning among children and focus on the application of knowledge. At another event in Ladwa, Saini said the government has set a target to install solar panels on one lakh houses this year. He said a team of officers will visit every village for the project under the Pradhan Mantri Muft Bijli Yojana. Families with an annual income below Rs 1.80 lakh will be provided with a 2 kW solar panel under the scheme. Out of the total cost, Rs 70,000 will be borne by the central government and the remaining by the state government, he said. He also said households with solar panels will not have to pay any electricity bills. Saini also said a sum of Rs 1,334 crore has been transferred to the accounts of farmers who suffered damage to their crops due to the recent rain.
