Delhi court rejects Satyender Jain's defamation case against BJP MP Bansuri Swaraj

A Sessions Court in Delhi on Thursday dismissed a revision petition filed by Aam Aadmi Party leader Satyender Jain against a trial court order that had declined to take cognizance of his defamation complaint lodged against BJP MP Bansuri Swaraj.
'In light of the foregoing analysis, this court finds itself in full concurrence with the conclusions arrived at by the Ld. Trial Court, to the effect that sufficient ground does not exist to justify the invocation of jurisdiction for taking cognizance of the offence as defined and punishable under Section 356 of Bharatiya Nyaya Sanhita (BNS) (criminal defamation). Accordingly, the instant revision petition is dismissed,' said Special Judge Jitendra Singh of Rouse Avenue Court in his order dated July 31.
The case pertains to the alleged defamatory statements by Swaraj against Jain, based on Enforcement Directorate (ED) raids at the latter's house and subsequent seizure of Rs 3 crore in cash and 1.8 kg of gold, along with 133 gold coins. The agency itself had posted the details of the seizure on its X handle.
The statements by Swaraj were aired on news channels in October 2023. Judge Singh also said that it was incumbent upon an investigative agency such as the ED to act 'impartially and uphold the principles of fairness and due process'. Any dissemination of information by them must be accurate and free from sensationalism, he added.
The court said that the statement in question is based on an official communication issued by a government agency (ED) through its verified social media handle. 'Hence, any official tweet is rather what comes from the horse's mouth itself,' it said.
'Upon consideration of the material on record, it is evident that the statement attributed to the proposed accused is a verbatim reiteration of a tweet published by the ED through its official social media handle,' the court said.

Eighteen people, including two women, were arrested on Friday for allegedly duping United States nationalsby sending a bug on their laptops via email, said police, adding that investigation is going on to assess the number of people duped. The suspects were operating from a rented accommodation in Noida, Sector 65, said police officials. A police officer involved in the investigation said the call center had been operating in the rented accommodation for the past two months. (Archive) Police said they received a tip-off that a call center involved in duping US citizens was operating in Noida. 'Upon receiving the information, a team was formed, and eighteen people were arrested,' said central Noida deputy commissioner of police (DCP), Shakti Mohan Avasthy. A police officer involved in the investigation said the call center had been operating in the rented accommodation for the past two months. 'It was revealed that they used to change locations every two to three months to avoid arrest,' he said, adding that the employees were hired by the gang leaders through Telegram and other social media platforms for salaries ranging between ₹25,000 to ₹40,000. Explaining their modus operandi, police said the gang leaders used to buy data of US citizens from US locals selling personal information, and employees hired by them were tasked with sending a bug via email, where they included their customer support number. After receiving the email, the target's laptop processor would slow down. After this, the victims would call the customer support number provided by the scammers and talk to them via voice-over-internet calls. 'Posing as customer support from an MNC, they gained access to the victims' laptop screens and threatened them that their bank credentials might leak due to bugs in their laptops,' said DCP Avasthy, adding that, under the pretext of providing help, they charged $250 to $300 from the victims. Police said the suspects have been identified as Dhruv Arora, 26, who was leading the call center, a resident of South Delhi; Akash Kumar, 27; Mayvo, 26; Saurabh Chandra, 26; Mohammad Fazul, 28, all residents of Delhi; Tarun Sharma, 36; Guruvindar Singh, 32; Pratyuman Sharma, 27; Gaurav Jasrotiya, 30; Kunal Rajvanshi, 29; Divyansh Bhadala, 28; Apurv Singh, 25; Ritu Rajput, 24; Sukrati Singh, 24; Mayur Nayak, 28, all residents of Noida; and Akash Tiwari, 25; Asmit Singh, 27; Harman Preet, 29, all residents of Faridabad. Twenty-three laptops, twenty-five headphones, and other electronic gadgets were recovered from their possession, said police adding that a case under sections of cheating (318) and cheating by personation(319) of BNS was registered at Phase 3 police station and further investigation is underway. .

As of July 14, the Municipal Corporation of Delhi (MCD), as part of its annual survey across its 12 zones in the Capital, has declared 22 houses as 'dangerous' and 320 'in need of repair'. However, despite being issued evacuation notices, residents of several such 'dangerous' houses continue to stay on, refusing to vacate the premises. These 'dangerous' structures are located in areas like Kotla Mubarakpur, Okhla village, Sahyog Vihar, Seelampur, Dariba Kalan, Rohini, Burari, and Jahangirpuri, among others. The Indian Express visited a few such houses, where many residents have refused to leave. At Keshavpuram Zone in Shalimar Bagh in Northwest Delhi, four lower-income group flats in a building constructed by the Delhi Development Authority in BB Block have been declared dangerous by the MCD. All four flats are occupied, with one resident claiming he has a 'stability certificate' issued by a 'structural engineer'. Visible cracks run along the pillars of the building — which has 18 flats — while swollen walls do not allow any door to be shut. A resident of one of the four flats said that several parts of the building have been constructed illegally. 'Two years ago, I had written to various authorities stating that the house has developed cracks… the ceiling of rooms and washrooms has fallen multiple times. They conducted a survey and said either to vacate the house or demolish the illegal parts.' The last evacuation notice was received by the resident on May 22, asking him to vacate the premises within 24 hours. 'But since then, no one has come here to check… We are ready to demolish unauthorised constructions but not vacate the flat,' he added. A resident who stays in a flat on the first floor — also in the list of four dangerous houses — said he had taken the flat on rent in 2009. 'After the building was declared dangerous, we got a survey done by structural engineers, who said the building is safe. Now, we will go and meet the authorities.' Over 17 km away, a narrow road covered with silt and flooded with rainwater leads to an old red-coloured building with visible cracks in the plaster. Located near Piayaao Chowk in Garhi village in East of Kailash, houses, along with shops in the building, have been declared dangerous. The ground floor houses three shops – a pharmacy, a mobile store, and a shop selling bags. Residents live on the above three floors. The pharmacy owner said he did not know that the building had been categorised as dangerous. However, tenants, who have been staying on the second floor for over a year and paying a rent of Rs 10,000, said the notice came two to three months ago. Following this, they were told by the owner that the building had been repaired, they claimed. The owner of the building could not be contacted for a comment. At 766, Chabi Ganj in Kashmere Gate, a two-storey building — housing six-seven flats — stands with half-demolished walls, mattresses and toilet seats buried under the debris. According to the residents, they were issued a notice of evacuation on June 2. Two weeks later, the houses were demolished. Local residents claimed most of the occupants were either given money or land by the builder to vacate the premises. One of the residents, Bharat Kumar, claimed that the building had not been surveyed by the civic authorities. The MCD study, being conducted for over five months now, has surveyed 98.35% or 30,93,678 houses that fall under the civic body's limits. While nine zones have been examined, surveys at Shahdara (North), City-SP, and Karol zones are yet to be completed, said officials. An official from MCD said that once a house is declared dangerous after a survey conducted by a local junior engineer (JE), a 'vacation notice' is served to the occupants as well as the local police. 'The police have to ensure that the building is vacated,' the official said, adding that this should usually happen within a day or sometimes within a week. The official further said that if residents of a 'dangerous' building ask for time to get the premises repaired, the JE has to take a call on this. 'If permission is granted, repair work has to start within a few hours… following which a structure engineer will survey the work and submit a report to the MCD for approval.'

The incident occurred on the night of July 29. According to the police, Jaskirat was returning home in his Scorpio SUV when the attackers intercepted him near his village. They forced him to stop. The assailants then poured petrol on the vehicle and set it ablaze. As Jaskirat tried to escape from the burning SUV, he was mercilessly attacked with iron rods before the assailants fled. The victim was rushed to a hospital in Ludhiana, he later succumbed to his injuries. The case was registered on July 30 at the Jagraon city police station on the statement of Jaskirat's father Jagdev Singh who named Ramandeep Singh and another accused, Kuljit Singh, along with seven unidentified persons. The police booked the accused under Sections 103, 190, 191(3), and 324(4) of the Bharatiya Nyaya Sanhita (BNS). During the investigation, cops recovered a .45-bore pistol and its magazine—which belonged to the deceased—from Ramandeep's possession. They also seized a vehicle (Tata Xenon) used by the accused to flee the scene, a petrol bottle from inside the vehicle and a mobile phone believed to be linked to the case. Police sources revealed that Ramandeep Singh had publicly posted a video on social media, confessing to the murder of Jaskirat Singh. In the video, Ramandeep reportedly claimed he wanted to kill Jaskirat for a long time. He also alleged that both he and his brother Kuljit were irritated by Jaskirat's habit of flaunting his licensed firearm and frequently parking his SUV in front of their shop. Deceased Jaskirat was an emerging trader in the share market while Ramandeep was involved in the scrap resale business. The SSP said Ramandeep was taken into three-day police custody for further interrogation. 'We are investigating the exact motive and trying to identify the remaining accused. Ramandeep is being questioned to determine who else was involved and how the entire incident was planned,' said SSP Gupta.
