
Pune advocate Asim Sarode cites SC ruling in Telangana MLAs' defection case, predicts ‘major political upheaval' in Maharashtra
'There are indications, including the one relating to the Supreme Court ruling in the Telangana MLAs' case, that Maharashtra is all set to witness a major political upheaval in September. The political scenario is going to turn upside down,' Sarode said.
The Supreme Court has asked the Speaker of the Telangana Assembly to decide petitions seeking the disqualification of 10 Bharat Rashtra Samithi MLAs who had defected to the ruling Congress expeditiously and not later than three months.
Shiv Sena (UBT) chief spokesperson Sanjay Raut concurred. 'There will be a major political upheaval, not just in Maharashtra, but in the country as well,' he said.
'The apex court has urged Parliament to reconsider whether the Assembly Speaker should be allowed to decide on the disqualification petition. The Supreme Court also asked Parliament to reconsider whether the authority given to Speaker to decide disqualification petitions was conducive to curbing political defections,' he said.
Sarode also pointed out that the Supreme Court had pointed out that the Speaker delayed issuing notice on the petitions seeking disqualification for almost seven months.
'This is exactly what happened in the case of Maharashtra. Because of the delayed decision in the case, the defected MLAs reaped the benefits so much so that the term of the Assembly got over and the MLAs escaped unscathed,' he added.
In 2022, a faction led by Eknath Shinde had split from the Shiv Sena after revolting against Thackeray. The rebellion had led to the fall of the Maha Vikas Aghadi coalition, paving the way for the BJP to form the government with the Shinde Sena.
'The apex court has said either we should take the Tenth Schedule [of the Constitution] seriously or it should be reconsidered if we do not want to follow it. The Supreme Court will have to keep the same view in the Maharashtra case as well. If it does, then [Eknath] Shinde's claim will fail,' he said.
Claiming that Assembly Speaker Rahul Narwekar was not 'eligible to decide the matter', Sarode pointed out that Chief Justice of India Bhushan Gavai had said that he would not take up any government post after retirement. 'This is significant as judges always look for some posting from the government after retirement. This means the CJI will not leave before delivering an unprecedented verdict,' he said.
Sarode also alleged that there was a visible panic in the Shinde camp. 'The number of trips he is making to Delhi reveals a lot,' he said, adding that the BJP does not seem to be in favour of Shinde now.
Sarode said the final hearing was likely after September 23. 'But if the Supreme Court decides to refer the matter to a larger bench, there will be a delay again,' he said.

Sena factions launch verbal duel after Worli koliwada skirmish
MUMBAI: The Shiv Sena (UBT) and Shiv Sena engaged in a sharp verbal duel on Saturday, a day after workers of both Sena factions clashed at the Worli Koliwada. The skirmish, involving hundreds of party workers, broke out as they assembled to greet their respective leaders, Aaditya Thackeray and deputy chief minister Eknath Shinde, who happened to arrive there simultaneously. Both leaders were there to participate in a Narali Poornima function of the Koli community. Siddhesh Shinde The Sena camp alleged that Siddhesh Shinde, son of Sena (UBT) legislator Sunil Shinde, had assaulted local Sena leader Pooja Bariya, who was admitted to KEM Hospital. However, Thackeray ridiculed the allegation. After the party workers clashed at the koliwada, police were called in to restore order. But the crowd was too large and jostling was inevitable. Later, Sena leaders alleged that Siddhesh Shinde had assaulted Bariya. A complaint was also lodged with the police. Sena MP Naresh Mhaske along with other party leaders went to KEM hospital to visit Bariya. Upping the ante, Mhaske told Bariya, 'The entire Shiv Sena stands with you and there is no reason to be afraid of such attacks.' He condemned the alleged attack on Bariya and said, 'The Shiv Sena will not tolerate such attacks on its workers. We are in constant touch with the police administration regarding this attack. Strict legal action will be taken against the culprits.' Reacting to the allegations against Siddhesh Shinde, Thackeray said the Sena was merely crying foul and Eknath Shinde should stop making 'fake complaints'. He said, 'There were police to control the crowd but the situation was chaotic, and people were pushing each other. (Eknath) Shinde should stop making fake complaints. Top court forms panel to manage Mathura's Banke Bihari temple, stays UP's plan
The Supreme Court has formed an interim committee to oversee the management of Vrindavan's Shri Banke Bihari temple. Headed by retired Allahabad High Court judge Justice Ashok Kumar, the panel will function until the Allahabad High Court rules on the UP government's ordinance on temple court stayed the provision of the ordinance, allowing the state to form a trust for the temple. Justice Kumar will receive Rs 2 lakh per month, and committee member retired judge Mukesh Mishra will get Rs 1 lakh per month, both from temple panel will operate from Mathura, with office space provided free of cost by the district administration. Lull before storm? Pawar hints Shinde may chart a new path
1 2 3 Nagpur: NCP founder Sharad Pawar on Saturday hinted that Maharashtra deputy chief minister Eknath Shinde might be preparing for a big political move. Responding to a media query on Shinde's double-header trips to Delhi and his meeting with Union home minister Amit Shah, Pawar did not rule out the possibility of friction within the ruling Mahayuti comprising BJP , Shinde-Sena and NCP (Ajit). "We all know Shinde Saheb very well. He has a habit of keeping quiet. What path he chooses in future, will be known to us very soon," said Pawar.
