[UPDATED] Immigration officer charged over nearly RM1mil in bribes
Nas Suffian Nasrun, 41, entered his plea after the charges were read out to him before judge Datuk Mohd Nasir Nordin.
Clad in a blue shirt, Nas Suffian listened to each charge attentively before pleading not guilty while his family members sat at the public gallery during the proceedings.
He looked calm throughout the proceedings, telling the court he understood each charge, the penalties and consequences of his plea.
His family members looked visibly sad and some had their heads bowed as the charges were being read out.
On the first count, was accused of being directly involved in transactions worth RM224,840 of proceeds from illegal activities from a special pass agent's bank account to his mother's bank account through 29 online transactions.
On the second count, he was alleged to have received RM297,600 of illegal proceeds in his bank account through 29 transactions from the same agent.
On the third to fifth count, he was accused of having transferred RM113,375, RM209,080 and RM88,400 from his own bank account to his accomplice, who is also an immigration officer, his mother and a company through 104 transactions.
He allegedly committed the offences at two banks in Kajang and Kota Damansara between July 29, 2022 and Sept 23, 2024.
The charges were framed under Section 4(1)(a) and Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act.
Each charge carries a jail term not exceeding 15-years and a fine not less than five times the amount of bribe or RM5 million, whichever is higher, upon conviction.
Deputy public prosecutor Siti Amirah Muhammad Ali did not offer bail as the offences are non-bailable.
Howevever, she said the court should set RM800,000 with one surety if it wanted to use its discretion to grant bail.
She also urged the court to order the accused the surrender his passport to the court, report to the Malaysian Anti-Corruption Commission (MACC) in Johor monthly and not harass prosecution witnesses if he was granted bail.
"Although he is a civil servant, he is a flight risk. He is an immigration officer and we believe he is well versed with the country's borders," she said.
Lawyer Muhammad Zaim Rosli pleaded for a bail of between RM10,000 and RM15,000 for each charge and said his client had been with the Immigration Department for 19 years.
"My client's wife is also a senior immigration officer and they have five children aged between 7 and 15.
"He has a clean work record and never had disciplinary action taken against him. But, he faces the risk of being suspended after being charged today.
"He cooperated during investigations. The issue of him absconding does not arise and he has pledged to attend all court proceedings," he said.
Zaim said his client will also be hauled to the Kuala Lumpur Court Complex to face similar charges on Thursday (July 24).
After hearing the submissions, Nasir set bail at RM100,000 with one surety.
He ordered Nas Suffian to surrender his passport to the court, report to the MACC office monthly and not harass prosecution witnesses.
The court set Sept 12 for mention.

Immigration busts illegal settlement, detains 33 construction workers in Kajang
KUALA LUMPUR: The Immigration Department detained 33 foreign workers for allegedly committing various immigration offences during a raid on a construction site in Bandar Bukit Mahkota, Kajang yesterday. Acting on public complaints and intelligence gathered over almost two weeks, a team from the Putrajaya Immigration Department raided the site and found it had been turned into an illegal settlement, also used for storing various construction materials. In a statement shared on its Facebook page yesterday, the department said the raiding party inspected 150 people, comprising 146 foreigners and four locals, during the 2am raid. "Following the checks, 33 foreigners, aged between 29 and 42, were detained during the raid. "They included individuals from Bangladesh, Indonesia, Pakistan and Nepal." The department added that the foreigners were arrested for various immigration offences, including lacking valid travel documents, overstaying, and violating pass conditions. The offences fall under Section 6(1)(c) and Section 15(1)(c) of the Immigration Act 1959/63, as well as Regulation 39(b) of the Immigration Regulations 1963. "We also issued a witness summons (Form 29) to a local woman who had been living in the settlement." The department said the group's modus operandi was to blend in with legitimate workers in the construction sector, some of whom possessed valid Temporary Employment Visit Passes. All those arrested during the raid have been sent to the Kuala Lumpur International Airport (KLIA) Immigration Detention Depot for further investigation and action.

Museum owner fined RM300,000 for possessing wildlife parts including orangutan skull, elephant tusks
KUALA LUMPUR, July 26 — An art museum owner was fined RM300,000 by the Sessions Court here yesterday for possessing various protected wildlife parts without a licence or special permit last year. Judge Mohd Zaki Mohd Salleh sentenced Yiu Shoou Rang, 66, after he pleaded guilty to eight amended charges. The court also ordered nine months' imprisonment in default of payment. Yiu subsequently paid the fine. Yiu was charged with four counts of possessing, without a special permit, protected wildlife parts, including an orangutan skull, two estuarine crocodile (Crocodylus porosus) skulls, and seven elephant tusks, all of which are fully protected species under the Second Schedule of the Wildlife Conservation Act 2010 (Act 716). The offences were committed at a business premises in Central Market, Jalan Hang Kasturi, around 3.20pm on January 8, 2024. He was charged under Section 68(1)(b) of the Wildlife Conservation Act 2010, which carries a fine of between RM50,000 and RM500,000, or imprisonment for up to three years, or both. Yiu also faced four additional charges of possessing other wildlife parts without a valid licence at the same time and location. These included 150 parts of wild boar (Sus scrofa), 10 porcupine quills and six parts of sambar deer. These charges were brought under Section 60(1)(a) of the Wildlife Conservation Act 2010 (Act 716), which provides for a maximum fine of RM50,000, imprisonment for up to three years, or both, upon conviction. However, five additional charges previously brought against Yiu were taken into consideration by the court under Section 171A of the Criminal Procedure Code. Deputy public prosecutor Suhaila Rashid urged the court to impose a sentence commensurate with the severity of the offence to serve as a deterrent. In mitigation, defence counsel Teh See Khoon pleaded for a lenient sentence, submitting that the items in question were part of an Orang Asli collection intended for museum display. — Bernama

SANDAKAN: An Indonesian illegal immigrant was jailed a total of 34 years plus 14 strokes of the cane on three counts of raping and sexually assaulting his stepbrother's 14-year-old daughter, early this month. The 25-year-old pleaded guilty before Sessions Court Judge Mohd Zaini Fishir @ Fisal to committing the offences. On the first and second count, the man was sentenced to 13 years' jail and seven lashes of the cane each for raping the minor on July 8, at 11m, and July 9, at 3am, in a living room of a plantation workers' house, here. The charges are framed under Section 376(1) of the Penal Code, read with Sections 16(1) and 26(1) of the Sexual Offences against Children Act 2017. On the third count, the man was handed eight years' jail for committing physical sexual offences against the same victim on July 7, at 11am, at the same place. The charge under Section 14(a), read with Section 16(1) of the Sexual Offences against Children Act 2017, is punishable under Section 14 read with Sections 16(1) and 26(1) of the same Act. The court ordered the man to serve the sentences from the date of his arrest. The man was also sentenced to four months' jail for illegal entry and was ordered to serve the sentence concurrently with the sentence of his third case and to be referred to the Immigration Department thereafter.
