HC allows to close criminal case against Mungantiwar, others

MUMBAI: The Bombay high court last week allowed the state government to close a criminal case against BJP leader Sudhir Mungantiwar and 21 others for rioting and causing damage to public property while protesting against Western Coalfields Limited in Nagpur, way back in June 2012.
According to the police, on June 26, 2012, an agitation was organised in front of the Western Coalfields Limited headquarters in Nagpur, to protest the alleged pollution and environmental damage on account of the mining operations of the public sector undertaking. It was further alleged that on the pretext of submitting representation, the accused barged into the office of the company and damaged property worth around ₹1.50 lakh.
The state government had filed an application in the high court, seeking permission to withdraw the prosecution, stating that a proposal to that effect was recently put up before the state-appointed committee. The proposal was backed by a report from the public prosecutor, stating that the incident arose out of social agitation and, in his opinion, prosecution deserved to be withdrawn. Based on this report, the committee had decided to withdraw the prosecution.
A division bench of chief justice Alok Aradhe and justice NJ Jamadar accepted the reasoning given by the public prosecutor and the committee's decision to withdraw the prosecution, and allowed the criminal case against the former minister and others to be dropped.
'Prima facie, it appears that the genesis of the alleged offences is in an agitation over the ill effects of mining and the resultant environmental damage,' said the bench. 'The Committee has noted that there is no loss of life and damage to public property in excess of ₹5 lakh - the parameters stipulated under the Government Resolution for withdrawal of prosecution in cases arising out of social and political issues,' it added.
The judges observed that the decision of the committee to withdraw the prosecution appeared to be guided by considerations for withdrawal of prosecutions arising out of social and political agitations. 'It does not appear that the prosecution is being withdrawn for an extraneous consideration,' the court said.

Ajay's funeral was held today, and a heart-wrenching video showed his younger brother, Ramesh Vishwas Kumar, carrying his mortal remains on his shoulders to the cremation ground. Ramesh, who sustained burn injuries as the Air India plane crashed into a hostel on June 2, was discharged from the Civil Hospital after he showed signs of recovery. The bodies of seven other victims from the crash were also brought to Diu for their final rites, it was known. At least 190 victims of the Air India plane crash in Ahmedabad have so far been identified through DNA matching, and 159 bodies have been handed over to their families, an official told news agency PTI on Wednesday. The London-bound Air India flight AI-171 carrying 242 passengers and crew members crashed in Ahmedabad on June 12. All but one on board the plane died along with nearly 29 on the ground when the aircraft smashed into a medical complex. Those deceased also included Gujarat's former Chief Minister Vijay Rupani, who was cremated with full state honours by his family, in the presence of BJP leaders, including Union Home Minister Amit Shah. On Tuesday, the last rites of Captain Sumeet Sabharwal, pilot in command of the ill-fated Air India plane, senior crew member Aparna Mahadik, and crew member Maithili Patil were also conducted in their respective hometowns. While the mortal remains of Captain Sabharwal were cremated at an electric crematorium in suburban Chakala, Mumbai, Maithili Patil was cremated in Raigad district. Mahadik's last rites were conducted in suburban Goregaon, in Mumbai.

On a phone call on Wednesday on the sidelines of the G7 Summit in Canada, PM Modi told Trump that India neither requested mediation nor discussed trade with the US during 'Operation Sindoor' against Pakistan's terror sites. This comes as a clear rejection of Washington's claim that it ended a four-day conflict between New Delhi and Islamabad by leveraging trade. However, the opposition demands more details. Congress leader Jairam Ramesh, expressing discontent, noted, 'There is a world of a difference between what is in our note and what is in Trump's note. You are saying this, he said that… then why not call an all-party meeting?" BJP leader Amit Malviya rebutted Ramesh's claims on a US note, calling him a 'congenital liar — much like Rahul Gandhi." The Trump-Modi phone call strongly countered many allegations made by Congress, and to some extent, by the TMC. Following the call, the BJP asserted, 'Every lie of the Congress has been busted. Congress must apologise for this." Despite this strong response, the opposition is unlikely to be silenced. There appears to be some unity within the INDIA bloc concerning Operation Sindoor. However, it is ironic that some members of the opposition who participated in delegation-level talks are now showing a softer stance towards the government. For instance, Shiv Sena leader Priyanka Chaturvedi, instead of condemning the government over the Munir-Trump lunch, chose to criticise Trump for dining with a terror promoter. Congress is expected to continue demanding an all-party meeting with the PM in attendance, as well as a response from the PM in parliament during the monsoon session. Nonetheless, cracks are beginning to show within the INDIA bloc. Both Congress and the TMC remain resolute in challenging the PM on various issues, such as the potential American mediation and the whereabouts of the terrorists. The strong response from the PM will not deter the opposition, despite the embarrassment they face.
