Decriminalise consensual relationship under Pocso, form sex education policy, SC advises govt

The Supreme Court has asked the Centre to consider decriminalising consensual relationships between teenagers so they are not jailed under the strict Pocso law. It also suggested creating a policy on sexual and reproductive health education.
A bench of Justices Abhay S Oka and Ujjal Bhuyan issued a notice to the Centre, asking the Ministry of Women and Child Development to set up an expert panel to study the issue and submit a report by July 25. The court said it will issue further directions after reviewing the report.

‘Fake' certicate for job: Surat court rejects anticipatory bail application of dismissed cop
An anticipatory bail application of a dismissed police officer, who had allegedly obtained a fake caste certificate to land a job, was on Wednesday rejected by the Surat District Court. The officer served as the Assistant Commissioner of Police in the Surat city police before his services were terminated. B M Chaudhary was dismissed from service as per an order by the state home department, dated May 20. A week later, on May 25, he was booked under Section 12(1)(A), 12(1)(B) of the Gujarat Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Issuance and Verification of Caste Certificate) Act, 2018. Chaudhary then filed an anticipatory bail application with Surat District Court of 14th Additional Session Judge B M Govani a few days ago. The order passed by the court on Wednesday stated: 'Investigating Officer is hereby directed to strictly comply with the provisions of Section 35(2) of BNSS (the arrest of a person without a warrant when a complaint, credible information, or reasonable suspicion exists that they are involved in a non-cognizable offense) and the ratio laid down by Supreme Court in the case of Arneshkumar Vs. State of Bihar in their true letter and spirit.' As per the details of the case, Chaduhary's late father Motiram Chaudhary had allegedly obtained a fake ST certificate, issued to him on July 19, 1990. Chaudhary then allegedly landed a job using the certificate. He was recruited as a sub-inspector in 1990, and later was promoted to the posts of a police inspector and then an assistant commissioner of police. Chaudhary had been posted as the ACP, K division, Surat city police, since 2022. The case was filed against Chaudhary based on a letter by Praveen Parghi, president of Adijati Vikas Trust, Godhra, on October 7 last year. Parghi claimed that Chaudhary had used a fake ST certificate to get his job and promotions. The State Vigilance Department ordered the Gujarat Police's vigilance cell to launch a probe. According to the FIR, the commission had written to Chaudhary '15 times' in 2024 seeking documents, but he delayed the process, seeking more time. The State Vigilance Department subsequently ordered registration of an offence against him, it stated. Additional Public Prosecutor Dighant Tevar said, 'The accused police officer had obtained a tribal certificate to get a job in the police department. The investigation agency had reminded him 15 times to appear for statements, but he failed to turn up.' Defence lawyer M A Patel did not respond to calls till the press time.

Mounting debt: MP takes fresh Rs 4500 cr loan
Bhopal: The state govt on Tuesday initiated formalities for a fresh loan of Rs 4,500 crore from the Centre, its second borrowing this financial year, officials in know of the development said. The move pushed the state's total debt past Rs 4.30 lakh crore, well beyond its annual budget of Rs 4,21,032 crore. The total debt of the MP govt was Rs 421740.27 cr as on March 31. The MP govt accepts it to take frequent loans. The govt stated the loans taken by the govt are utilised for financing productive development programmes and projects to be implemented in the state. It mainly bears the cost of development schemes. Consent of central govt has been obtained to the floatation of this loan as required by Article 293 (3) of the constitution of India. Loans taken from the central govt and from other sources were mainly utilized for development of the state and for the creation of remunerative assets such as construction of irrigation dams, improvement of transport services, grant of loans to third parties like cultivators, local bodies, loan to power generation, power transmission among others, states the state govt while taking a loan. Despite the rising loan burden, the govt has not hesitated in buying a state plane, new cars for ministers and renovation of ministers' bungalows. On July 10 last year, the state govt cleared a proposal to buy a jet plane worth over Rs 230 cr. Among the major financial responsibilities of the govt is the Ladli Behna scheme, which needs over Rs 1,550 cr every month.

Pollution control body clears construction of Radio Club jetty near Gateway of India
A week after the Supreme Court refused to stall the construction of a passenger jetty at Radio Club near Gateway of India, the Maharashtra Pollution Control Board (MPCB) on Wednesday granted approval for its construction The MPCB conveyed this in its letter to the Maharashtra Maritime Board (MMB). State's Ports Minister Nitesh Rane said, 'The government is taking firm and definitive steps towards the completion of the project.' The Rs 229-crore project to develop a passenger jetty and a terminal building at Radio Club near the Gateway of India in Mumbai has drawn flak from Colaba residents who cited damage to the heritage precinct and the increased traffic congestion. According to the local residents, illegal parking is already rampant, with parking along both sides of the Prem Ramchandani Marg between Radio Club and Gateway of India. With the increase in hawkers and vehicular flow in the precinct, residents have aired concerns over the likelihood of heavier traffic jams and inaccessibility to tourists. Opposing the project, several residents had approached the Bombay High Court. Last month, the court had refused to grant an interim stay on construction. While refusing to entertain a plea seeking a stay on the construction, the Supreme Court, too, on May 27, noted that the matter is pending before the Bombay High Court. 'We are not inclined to entertain the matter since the HC has already fixed it for hearing on June 16. However, we would request the HC to take up the matter and decide the same as expeditiously as possible, preferably prior to the end of monsoon 2025,' the order stated. In a bid to uplift the existing facilities at Gateway of India, which is a hub for significant boat traffic, the MMB is slated to develop a new passenger jetty and a terminal near the iconic landmark in Colaba. Expected to be completed within 30 months, the new jetty is expected to reroute all boat traffic from the Gateway of India, in what is pegged to reduce existing congestion as well as upgrade the old facilities. The new jetty will have the capacity to accommodate up to 20 boats at a time, allowing for smoother and more organised operations. Meanwhile, the terminal building will span 80 square metres and will have a 350-person capacity amphitheatre, a berthing jetty, an approach jetty, a fire safety system, and CCTV, besides gardening and beautification works.
