After Bharti Airtel's demand, experts call for checks in equity conversion of statutory dues

NEW DELHI: With the government saying that rules around equity conversion of statutory dues apply to all licensees and both spectrum as well as adjusted gross revenue (AGR) dues will be considered, industry executives and experts have called for some checks and balances.Otherwise, the move could open a virtual Pandora's box of requests from different players including internet service providers (ISPs), VSAT firms and profitable telcos, who can potentially seek to convert thousands of crores of all their statutory dues into equity. "And if agreed to, this could lead to the government holding stakes in several private companies, which won't be an ideal situation," said an industry expert asking not to be named.

AGR dues
into equity. Airtel's demand came as a surprise as so far, the telco was not inclined to give equity to the government, given its strong financial health in contrast to Vodafone Idea, which ran out of options and was forced to give up its stake to survive.
But the demand from Airtel, experts say, can lead to others also seeking the same treatment. For example,

too can seek to convert its spectrum dues into equity as the company doesn't have legacy AGR dues and was not affected by the Supreme Court judgement of 2019, pointed out an industry expert, asking not to be named.
Apart from the telecom firms, there are various ISPs and VSAT players that are saddled with thousands of crores of AGR dues. In case, the government does not provide relief or waiver for such firms, they too can seek equity conversion to clear the dues, the expert said. "The equity conversion for Vodafone Idea was done as the company was struggling financially...if the conversion had not happened, the firm might have gone bust. But the situation for Airtel is different and there should be some checks and balances for applying the equity conversion policy for its AGR dues," Rohan Dhamija, head, India and the Middle East, Analysys Mason.
While seeking a conversion, Airtel has said that it was entitled to convert its over Rs 53,000 crore worth of spectrum dues into equity as dues beyond the moratorium period - which ends later this year - are also being converted into equity. The spectrum dues of Airtel relate to the 2022 5G auction as the company has already cleared its dues before 2021 auctions.
DoT officials, however, refused to clarify if dues beyond 2021 telecom reforms can also be converted into equity. But industry executives said the policy of conversion applies to all dues, including those after 2021. "As per the policy, all companies can offer equity to the government in lieu of their spectrum and AGR dues," said an executive.

Jyotiraditya Scindia
had previously told ET that rules around equity conversion apply to all, and that the department would decide on such requests. "In general, for telecom and other sectors, the government has to frame the policy on equity conversion by private players in lieu of statutory dues with proper safeguards as otherwise it could disrupt the business environment and government finances," Dhamija added.

The feelings were mixed when it came to coughing up Rs 120 for the ride from Ranaghat to Sealdah. While some seemed sensitive about paying Rs 100 more for a journey that otherwise costs Rs 20 in non-AC rakes, others said the cool comfort and the superior travel justified the fare. A monthly ticket costs Rs 2,430. The one-way fare ranges from Rs 35 to Rs 120 depending on the distance travelled. The train was flagged off with much fanfare from Sealdah on Sunday. Commercial services started at 8.29 am on Monday. The inaugural commercial service was fairly crowded, with several passengers standing. But there was enough legroom, unlike the non-AC local trains. Ranaghat resident Dilip Ghosh, who works in Khadi Bhavan on CR Avenue, was smiling as he looked around the ICF-made rake, from the AC vent over the seat, noting the time as the automatic doors closed and the train chugged out of Ranaghat station. "This is like travelling on a metro train. We are covering 90 km in AC comfort and saving time as well. CM lays stones for six road projects worth Rs 766.73 cr in city

Patna: CM Nitish Kumar on Monday laid the foundation stones for six projects worth Rs 766.73 crore to provide road connectivity in the western Patna. The projects were announced during his Pragati Yatra in the Patna district conducted earlier this year. The six projects include four roads, a flyover and an underground drain-cum-road. Three separate functions were held to lay the foundation stones. The first function was held near Patna AIIMS roundabout, the second one near Kothwan Rupaspur canal and the third one on Nehru Path below the Patli road. "The roads, whose foundation stones have been laid, are not only meant to ease the traffic movement in the western Patna that is developing fast, but also provide smooth movement of traffic from J P Setu, Patliputra station, Danapur, Gola Road, Saguna Mor, Naubatpur, Khagaul and Patna AIIMS localities towards Biharsharif," the CM said on the occasion. "They will also give a boost to economic activities and social development in the entire area, as it has been developing fast," he added, and asked the officials to ensure that the projects were completed in time. Among those who accompanied the CM on the occasion were deputy CM Samrat Choudhary and MLC Rabindra Kumar Singh, as well as CM's principal secretary Deepak Kumar, development commissioner Pratyaya Amrit, CM's secretary Kumar Ravi, road construction department secretary Sandeep Kumar R Pudukalkatti, Patna division commissioner Chandrashekhar Singh, Patna DM Thyagarajan SM and SSP Kartikeya K Sharma, among others. The foundation stone for a flyover to be constructed at Naubatpur Lakh with an investment of Rs 73.06 crore was also laid. At the second function held on Kathwan Rupaspur canal, the CM laid the foundation stone for the construction of 6.9 km four-lane road to provide a link to the Khagaul-Nehru Path, Ashok Rajpath and Rupaspur canal road. It would involve an expenditure of Rs 71.48 crore. The third function was held below Patli Path. From here, the CM laid the foundation stones for a group of three projects. One of them is the construction of a link road to connect Digha-AIIMS-Patli road with Nehru Path on the side of Danapur, which will be completed with an investment of Rs 148.86 crore. The second is construction of an underground drainage facility-cum-road on both the sides of 2.7 km from Rupaspur canal and Saguna Mor up to Nehru Path, whose completion would require an investment of Rs 318.51 crore. The third project related to widening and strengthening of the 2.20 km road between Nehru Path and Gola road will be completed at an expenditure of Rs 21.35 crore.
