
Ex-teacher gets back RM58,000 docked from gratuity over alleged misconduct
PUTRAJAYA : The government must return approximately RM58,000 to a former secondary school teacher, the amount that was deducted from his gratuity after he was alleged to have been absent from school for 192 days while in service.
This follows the Court of Appeal's unanimous decision today to dismiss the government's final appeal, ruling that N James Arulchelvam had not committed misconduct as defined in a circular and under the Public Officers (Conduct and Discipline) Regulations 1993.
A three-member bench chaired by Justice Supang Lian said the High Court had not erred in ruling in Arulchelvam's favour.
'We find the respondent had not been served a show cause to respond to the alleged misconduct,' she said, ordering the government to also pay RM10,000 in costs.
Justices Lim Chong Fong and Alwi Abdul Wahab also sat on the panel.
Arulchelvam, 64, whose last posting was at SM Engku Husain in Semenyih, Selangor, was diagnosed with a medical condition and categorised as a special case due to his illness.
In early 2017, he was assigned only six teaching periods over two or three days a week, meaning he was required to be in school only on those days.
Arulchelvam then decided to go on optional retirement in late 2018.
However, a new principal at the school later initiated disciplinary proceedings against him for allegedly being absent from school for 192 days – 108 days in 2016 and 84 days in 2017.
The government, through the education ministry, subsequently deducted RM58,004.90 from his gratuity for the days he was said to be absent.
In his suit filed in January 2019, Arulchelvam said he had been present at school during the relevant period but had not clocked in.
The sessions court dismissed his suit, but the High Court later allowed his appeal and awarded him the deducted sum.
Lawyers Walter Pereira and Naveen Chandra Bose represented Arulchelvam, while senior federal counsels Nur Aifaa Che Abdullah, Noor Fadzila Ishak and Sheryn Yong appeared for the government.

Akmal previously threatened to protest at the shop if the owner was not charged by Thursday, saying he would personally 'teach this 'Ah Pek' (uncle) how to put up a flag properly'. Civil society group Projek Sama subsequently urged Prime Minister Anwar Ibrahim to intervene and rein in Akmal, to stop the Umno man's 'witch-hunt', especially if the shop owner was not charged over the issue. Terengganu Umno Youth also apologised for an error in a graphic of the Jalur Gemilang posted on the wing's social media account, saying it was an unintentional mistake by the graphic designer. Akmal, however, urged the police to act, even though the person involved was from his own party.

According to Rafizi, the attack occurred at about 1.45pm as his son and wife were getting into the car. He said that checks of CCTV footage showed that two men, dressed in black with helmets fully covering their faces, had followed his wife's car on a motorcycle before the incident. 'They had waited earlier and rushed to attack my son at the right moment,' he said in a statement. 'My son was immediately taken to Universiti Putra Malaysia Hospital for treatment.' Rafizi said he and his family have provided statements to the authorities, and he also expressed his gratitude to the police and hospital staff for their assistance. The Pandan MP described the attack as unprecedented in his political career, and said he believed it was a warning for him not to speak out on certain issues. 'God willing, while I will take follow-up measures to enhance security, I will not yield to any threats and will continue to perform my duties as usual,' he said. Malaysiakini earlier reported that Rafizi's son was attacked in a mall car park in Putrajaya, with Sepang police confirming the incident. In a Facebook post, Anwar said he had contacted home minister Saifuddin Nasution Ismail to ensure that a transparent and speedy investigation is carried out into the incident. 'We have yet to recover from the issue of bullying in schools, and now, another deeply regrettable act has occurred … a vile and treacherous attack on the son of our brother Rafizi. 'I am praying for the wellbeing of Rafizi and his family,' he said. Earlier today, the Pandan MP said his 12-year-old son was dragged and stabbed with a syringe by an assailant at about 1.45pm as his son and wife were getting into their car.
