Karnataka HC quashes gag order on online media channel over Dharmasthala case reports

The Karnataka High Court on Friday quashed a gag order on Mangaluru-based online media channel Kudla Rampage related to its reports on the Dharmasthala 'secret burials' case.
'The concerned court, at the threshold and without the benefit of adversarial hearing, has ventured to grant a sweeping mandatory injunction, a relief which ordinarily ought to await the culmination of the trial,' Justice M Nagaprasanna said, remanding the matter to the lower court to be heard afresh.
The court also came down strongly on some of the reasoning in the gag order. 'The impugned order though spanning multiple pages, conspicuously lacks the foundational reason……the order may span pages, but spanning pages has not depicted application of mind. It is application of mind that is required, in a reasoned order, and not application of ink,' Justice Nagaprasanna added.
The Additional City Civil and Sessions Court in Bengaluru had on July 18 granted an ex parte injunction to delete 8,812 links related to the Dharmasthala burials case. The injunction was based on a petition filed by Harshendra Kumar D, brother of BJP MP D Veerendra Heggade and secretary of the Shri Dharmasthala Manjunatheshwara Educational Society.
The channel's counsel, A Velan, had argued that an injunction, which was doubtful at the closing stages of the case, had been granted in the interlocutory stage itself, and said that this was violative of the Civil Procedure Code (CPC).
Arguing that it was a case of restraint on freedom of speech, he further pointed out that there was no reasoning behind passing a 'John Doe' order in this case. John Doe orders are orders where a defendant is unknown. Velan also asserted that the order, in a matter of public importance, was creating a perpetual gag order on future speakers.
Representing Harshendra Kumar, senior advocate Udaya Holla argued that the petition by Kudla Rampage was not permissible under Article 227 of the Constitution, as the petitioner had not availed the remedy under the CPC to vacate the order. He also stated that the high court had twice directed the channel to be banned, stating that in a case which was being investigated, it was producing defamatory content projecting Kumar to be guilty and creating defamatory content.
The bench stated that the injunction at this stage had the character of a final order, explaining, 'The impugned order…while ostensibly couched as an interim measure, in truth and effect, partakes the character of a final determination.'
The bench also pointed out multiple Supreme Court precedents with regard to the type of reasoning required for passing an ex parte order or interim injunction in such cases.
The court also clarified that 'John Doe' or 'Ashok Kumar orders', as they are known in India, ought to be granted only with great caution, observing that the current order was wide enough that any voice against Kumar, his family or the location of the incident would be caught in it.
The court added, 'The order speaks of prohibition of defamatory statements. Not one word of what kind of statements are defamatory for the Court to pass the aforequoted order is found in the order.'
The court then quashed the ex parte order as far as it pertains to Kudla Rampage.

He referred to another defamation case involving comments by the Congress leader about V.D. Savarkar. 'We all know that the commission-hungry Congress failed to procure Rafale jets for 10 years. Prime Minister Narendra Modi made sure that the Air Force received these aircraft. Displaying similar immaturity, Rahul Gandhi used inappropriate language for the Prime Minister. Subsequently, the Supreme Court's decision affirmed that the addition of Rafale jets strengthened the Air Force and was in India's national interest,' Mr. Bhatia added.

New Delhi, Aug 4 (UNI) The Supreme Court today dismissed an appeal filed by Karnataka Minister Shivananda S. Patil, challenging a Karnataka High Court decision that had quashed his defamation case against BJP MLA Basanagouda R. Patil Yatnal. Patil's counsel sought to contest the High Court's order dated September 28, 2024, which had set aside the proceedings, citing non-compliance with the mandatory procedure under the Bharatiya Nyaya Suraksha Sanhita (BNSS). It was alleged that Yatnal made defamatory remarks against Patil during a rally ahead of the 2023 Karnataka Assembly elections, tarnishing his image despite his Cabinet status. At the outset, Chief Justice of India B.R. Gavai, sitting with Justice K. Vinod Chandran, made his stance clear and said, 'Fight political battles outside the court, not here.' When the lawyer tried to press the appeal, the CJI responded curtly, 'So what?' and imposed a cost of Rs 25,000, which he later escalated to Rs 1 crore. However, the cost was waived after the lawyer requested withdrawal of the appeal. The Karnataka High Court had ruled that the magistrate failed to follow due process under Section 223 of the BNSS. According to the provision, a magistrate must first examine the complainant and any witnesses under oath and provide an opportunity for the accused to be heard before taking cognisance. The High Court found these steps were skipped, invalidating the trial process. The Gujarat High Court on Monday granted relief to an Ahmedabad-based news anchor in a case of defamation and atrocity, filed by Congress leader Dr Tushar Chaudhary, based on the assurance of the Additional Public Prosecutor that the journalist will be served a notice of 15 days in case the investigating officer deems it appropriate to arrest her. Justice Nirzar Desai was hearing the petition by Gopi Maniar-Ghanghar, anchor of Ahmedabad-based Nirbhay News Channel, for quashing and setting aside the FIR lodged at Tapi District, based on Chaudhary's complaint under Section 356 (Defamation) of the Bharatiya Nyaya Sanhita (BNS) and various sections of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Chaudhary is the newly appointed Congress Legislature Party (CLP) leader in Gujarat Assembly. The court order stated, 'Public Prosecutor Hardik Dave has made a statement before this Court upon instructions received by the Nikita Shiroya (SC/ST Cell Tapi Vyara) that… the investigation is at very initial stage and therefore, it would serve the end of justice if this Court records the statement of learned Public Prosecutor that in case, during the course of investigation, if the investigating officer deems it appropriate to arrest the present applicant, she will be given a clear notice of fifteen days and upon receipt of the notice…' The court further said, 'The applicant would be at liberty to avail appropriate remedy so as to take remedial measure to seek relief against her proposed arrest. Such a period would start from the date of receipt of the notice by the present applicant.' Chaudhary's complaint is also against Jagdish Mehta, group editor of Rajkot-based Headlines News channel. Chaudhary has alleged that the journalists had defamed him and his deceased father, former Gujarat Chief Minister Amarsinh Chaudhary. In the FIR, the Congress MLA from Khedbrahma has alleged that in a show aired on July 22 on Nirbhay News, Ghanghar made an objectionable statement against him. He said Mehta consented to the statements, which were 'defamatory for him and the entire tribal community'. Ghanghar's advocate Utkarsh Dave said, '…Ghanghar… was the interviewer, who does not have control over what the other person is going to say… We will proceed with legal remedy in case the notice for arrest is issued.'
