
Dangerous to reduce age of consent for sex below 18: Centre in Supreme Court
Arguing against any proposal to reduce the age of consent or create legal exceptions, the Centre stated such a move would be"not only legally unsound but also dangerous", according to a PTI report.It further said that relaxing the law would "provide a defence mechanism even to those abusers who exploit a child's emotional dependence or silence".NEED TO PREVENT MISUSE OF CONSENT: GOVTAccording to the Centre, strict and uniform enforcement of the existing law is necessary to prevent the misuse of "consent" as a defence in cases involving minors."Any departure from this standard, even in the name of reform or adolescent autonomy, would amount to rolling back decades of progress in child protection law, and undermine the deterrent character of statutes like the Pocso (the Protection of Children from Sexual Offences) Act, 2012 and the BNS (Bharatiya Nyaya Sanhita)," the Centre argued.The government also made it clear that any discretion in applying the law must remain with the judiciary on a case-by-case basis, and should not be introduced into the statute as a general rule or diluted standard, according to the PTI report.It warned that "introducing a legislative close-in-age exception or reducing the age of consent would irrevocably dilute the statutory presumption of vulnerability that lies at the heart of child protection law. A diluted law risks opening the floodgates to trafficking and other forms of child abuse under the garb of consent."It reiterated that lowering the age of consent would open the "floodgates" to various forms of abuse masked as consensual relationships, especially in a social context marked by inequality and power imbalance.In the case currently before the top court, the issue at hand concerns the legal treatment of adolescent relationships.AGE OF 18 FOR CONSENT NOT ARBITRARY: GOVTadvertisementDefending the existing law, the Centre said, "The legislative determination to fix the age of consent at eighteen (18) years, and to treat all sexual activities with a person below that age as an offence irrespective of purported consent, is a product of a deliberate, well-considered, and coherent statutory policy."The Centre explained that the 18-year threshold is not arbitrary but stems from a "constitutional and legislative recognition of a minor's vulnerability, especially in a socio-economic context marked by deep inequalities and power imbalances."In particular, it pointed out that a child's inability to resist or report abuse becomes even more complex when the abuser is a parent or a close relative."In such cases, presenting 'consent' as a defence only victimises the child, shifts the blame onto them, and undermines the very object of Pocso to protect children from exploitation regardless of whether they were 'willing'," it said.According to the Centre, retaining the current age of consent is essential to "give full effect to the legislative intent, protect the bodily integrity of children, and uphold the constitutional and statutory safeguards accorded to them.""The Supreme Court, along with high courts across the country, have always maintained the sanctity of legal age of consent as 18 years of age. This statutory yardstick has been upheld on numerous occasions, keeping in view the legislative intent and the pre-eminent constitutional mandate of protecting young children," it noted.The submission comes in response to arguments made earlier by Indira Jaising, who had urged the Court to read down the age of consent from 18 to 16 years. Senior Advocates not permitted to mention cases before CJI's Court from August 11
No Senior Advocate will be permitted to mention cases for urgent listing and hearing before the court of Chief Justice of India B.R. Gavai from Monday (August 10, 2025). "As directed, designated senior counsels are not permitted to mention any case/s before the court of the Chief Justice of India with effect from Monday, August 11, 2025," a notice issued by the Supreme Court said. On August 6, the CJI had said that from August 11, no Senior Advocate will be permitted to mention cases for urgent listing and hearing in his court so that juniors get an opportunity to do it. CJI Gavai, who was sworn in on May 14, had reverted to the practice of oral mentioning of cases for urgent listing and hearing by lawyers and discontinued the practice adopted by his predecessor Justice Sanjiv Khanna. Justice Khanna discontinued the practice of oral submissions for urgent listing and hearing of cases by lawyers and asked them to either send emails or written letters instead. "There is a great demand that no matters should be mentioned by senior counsel(s)," CJI Gavai had said on August 6. He had asked the court staff to put out a notice that no senior lawyer will be permitted to mention cases for urgent listing and hearing in his court from Monday. "From Monday, no senior counsel, I mean designated senior counsel, will be allowed to mention matters. Let juniors get an opportunity to do it," the CJI had said. "This will be practised at least in my court," the CJI had said, adding that it was up to other apex court judges to adopt the practice. Usually lawyers mention their cases before the CJI-led bench at the outset of the day's proceedings for out-of-turn listings and hearing of cases on grounds of urgency.

He said the state government requested Prime Minister Narendra Modi to inaugurate the Yellow Line of Bengaluru Metro Rail from RV Road to the Electronic City out of respect for him. "Today Yellow Line has been inaugurated. 80 per cent of the project cost has been contributed by the State government and 20 per cent was borne by the BJP government at the Centre. In some places, the Centre has spent only 11 per cent," Shivakumar told reporters as Prime Minister Narendra Modi inaugurated Yellow Line of Bengaluru Metro at RV Road Metro Station."Centre has fully neglected Karnataka, but to respect Prime Minister Narendra Modi, we requested him to inaugurate the Metro Yellow Line," Shivakumar said. According to him, Karnataka state government gave money for the land acquisition and infrastructure. The Centre was supposed to shoulder 50 per cent of the project cost but it did not give money. "However, for the honour of Karnataka's state capital Bengaluru, which generates huge tax for the Centre, where every year nearly 1 lakh to 1.5 lakh new job creation happens and techies from across the country come here seeking job and also for the convenience of techies, we built metro rail till the electronic city," Shivakumar said. The Deputy CM said that the flyover in the Electronic City was constructed during Manmohan Singh's tenure. He also thanked Infosys, Biocon, Delta and others who donated money to build Metro stations."Some BJP people are projecting that the Metro Rail was a Central government project but the Centre has done nothing. No MP gave a penny or any cooperation for the Metro Rail project in Bengaluru. It is a matter of shame for all the MPs of Karnataka," he claimed that the Centre did not help Karnataka get funds under the Mahatma Gandhi National Rural Employment Guarantee Scheme. Alleging that the Centre did not give sufficient funds for the city's infrastructure, the Deputy CM appealed to Modi to give Rs 1 lakh crore for Bengaluru as has been given to the national capital Delhi "because this is the second highest tax-generating city in the country"."I am going to give a representation to him (Modi). I am requesting him not to ignore Bengaluru. Treat it like the national capital," Shivakumar claimed that the Centre has contributed 20 per cent share in Ahmedabad infrastructure project but in Bengaluru, it has given only 10 per cent, which is a well-documented fact."I don't want to indulge in politics and there is no need for it but I am bringing this to his (Modi's) notice. MPs must set aside politics and bring central grants to serve people," the Deputy CM a swipe at the Bengaluru MPs, he said this is not a service to just post things in the social media with photographs and get coverage in the newspapers. "Your conscience should permit. You should work like that," Shivakumar asked about BJP claiming that Modi gifted Metro Rail to Bengaluru, Shivakumar said no one has any role in claimed that the Metro Rail project was started by former Congress Chief Minister late S M Krishna when late Atal Bihari Vajpayee was the Prime Minister of the country."Let them (BJP leaders) release their statistics to show how much money did they give for the metro project and I will also reveal our data," he said. The ruling Congress and opposition BJP in Karnataka have locked horns over the Metro Yellow line. Congress is claiming that the state government made the project happen, while the BJP said the Centre has contributed to the Metro Line.
