
Overstaying: Jail and fine for 10 Pakistanis

Kota Kinabalu: Ten Pakistanis were jailed and fined for committing various immigration offences. They were Imad Ilyas, Taimoor Khan @ Khan Taimoor, Gul Saqib, Iqbal Hussain, Shah Syed Baliqh, Shah Bakht Biland, Dad Yaseen Khaistay, Dad Shafiq Shad Bakht, Ilyas Ali and Muhammad Shoaib Muhammad. All the Pakistanis pleaded guilty separately before Sessions Court Judge Hurman Hussain, to the charges against them. Imad, Taimoor, Gul, Iqbal, Shah Syed, Dad Yasen, Dad Shafiq, and Ilyas were fined RM10,000 each, in default six months and 12 months, for staying in the State after their documents, namely Special Passes and Social Visit Passes expired. They had overstayed in the State between fifteen days and two years. Dad Shafiq was also fined another RM500, or jailed three months for breaching the condition on his Social Visit Pass which only allowed him to be in West Malaysia but he went to Sabah and stayed. Meanwhile, Shah Bakht was jailed four months for entering the State illegally and jailed another six months for breaching the condition on his Social Visit Pass by entering the State in which the document only allowed him to be in West Malaysia. Muhammad Shoaib was fined RM3,000, or jailed four months for entering the State without valid document. All the Pakistanis paid the fine except Imad who then served the six months in default of paying the fine. They were arrested in different places in Penampang, Tuaran, Ranau, Membakut and the City between June 4 and 23 this year during operations carried out by the Immigration Department. In the same court, a 62-year-old man was fined a total of RM20,000 for allowing four illegal immigrants to stay in the place which is under his control. Yong Yick Thong admitted to permitting the four Filipinos who did not have any documents to be in a homestay construction site in Kundasang, Ranau at 12.20pm on Oct 19, 2023. The court ordered Yong to pay a fine of RM5,000 or four months in jail for each illegal immigrant involved. Vietnamese woman faces drug trafficking charges
JOHOR BARU: A Vietnamese woman was charged in the Magistrate's Court here with drug trafficking involving over five kilograms of drugs two weeks ago. Vo Thi Be Thu, 31, nodded to indicate understanding when the charge was read before Magistrate A. Shaarmini, but no plea was recorded as the case falls under the jurisdiction of the High Court. According to the charge sheet, she was accused of trafficking 3,4-Methylenedioxymethamphetamine (MDMA) weighing approximately 5.286kg at a condominium in Persiaran Sutera Danga, Johor Baru, at about 2 pm on July 25. For this offence, Vo Thi was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and is punishable under Section 39B(2) of the same Act, which carries the death penalty or life imprisonment. If not sentenced to death, she shall also be punished with not less than 15 strokes of the cane upon conviction. In the same court, the accused pleaded not guilty to two other charges of drug possession. She was charged with possessing 20g of MDMA and 9g of ketamine at the same apartment and location, date, and time. For these offences, she was charged under Section 39A(1) of the Dangerous Drugs Act 1952, which carries a maximum prison sentence of five years and not more than nine strokes of the cane, and under Section 12(2) of the same Act, which provides for a fine of up to RM100,000 or both, upon conviction. Meanwhile, before Magistrate Nur Fatin Mohamad Farid, the accused was also charged with possessing 11g of ketamine in another unit of the same apartment at around 3.20 pm on July 25. She pleaded not guilty and claimed trial under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 12(3) of the same Act, read together with Section 34 of the Penal Code. The prosecution was led by Deputy Public Prosecutors S. Manushri and Siti Aishah Latif. Both courts set October 7 for case mention while awaiting the chemistry report, and no bail was offered. At the same time, the accused is also facing two additional charges before Magistrate Nabilah Nizam. However, the proceedings were postponed to August 27 to allow time for a Vietnamese interpreter to be appointed. On August 3, former Johor Police Chief Datuk M. Kumar reported that a drug syndicate led by a Vietnamese woman had been busted following raids on two apartment units in a guarded and gated residence. During the crackdown, drugs worth over RM4.9mil were seized.

Stop spreading unverified info on Zara Qairina case, MCMC warns
KUALA LUMPUR: The Malaysian Communications and Multimedia Commission (MCMC) has warned the public against spreading unverified information about the death of a teenage girl, Zara Qairina Mahathir. Zara, a Form 1 student, died on July 17 after falling from her school hostel the previous day. Her death has sparked online debate amid allegations of bullying and a flawed initial investigation, including a lack of a post-mortem examination. In a statement, MCMC said the spread of unverified pictures, videos, or other information is harmful to the family and is unethical. It added that those who spread false information could face a fine of up to RM50,000, a maximum one-year jail term, or both. This is an offence under Section 233 of the Communications and Multimedia Act, which deals with improper use of network facilities or network services. The commission also said all parties should respect the authorities' ongoing investigation and avoid speculation that could cause confusion. Previously, Communications Minister Datuk Fahmi Fadzil and Inspector-General of Police Tan Sri Mohd Khalid Ismail have also warned the public against spreading unverified content related to the case. On Aug 1, Zara's family requested an inquest to be held to determine if any criminal elements were involved in her death. Among other requests, they called for her body to be exhumed.

Temple priest claims trial to charge of sexually abusing teenage boy
ALOR GAJAH: A 32-year-old temple priest claimed trial at the Sessions Court here to a charge of committing physical sexual abuse against a teenage boy. The accused, P. Deva, entered the plea before Judge Aiza Khairuddin on Thursday (August 7). According to the charge sheet, the accused allegedly committed oral sex abuse on a 13-year-old boy. The act was allegedly committed in a bedroom of a house in Taman Melaka Perdana, here, between 3pm and 4pm on July 4. If convicted, the accused may face up to 20 years' imprisonment and whipping under Section 14(b) of the Sexual Offences Against Children Act 2017. Earlier, Deputy Public Prosecutor Muhamad Ali Hussain proposed bail at RM30,000 with additional conditions, that the accused report to the police station monthly, surrender his passport to the court and refrain from contacting any prosecution witnesses until the case is concluded. The accused's lawyer, Datuk P. Aravindhakshan, appealed for a lower bail amount, stating that the accused comes from a poor family with no fixed income and relies solely on earnings from odd jobs. The court later set the bail at RM15,000 with the additional conditions requested by the prosecution. The next mention date is fixed on Sept 8.
