Creecy's new Rail Bill promises reform measured in six key numbers

South Africa's logistics infrastructure is under construction and Transport Minister Barbara Creecy has laid out an overhaul plan with six hard numbers and a new Rail Bill.
In a rare moment of relatability from the GNU member with the most 'tannie energy', Barbara Creecy said that being transport minister is the worst and best job she's had. 'The best because there's so much to contribute, the worst because there are lots of things that are wrong, and fixing them is very complicated.'
'Complicated' is generous. The logistics bottlenecks in South Africa's rail infrastructure are bleeding billions per day from the economy.
But Creecy said her department is moving to tackle the mess with a soon-to-be tabled bill and what she describes as 'overwhelming appetite' from the private sector.
Six numbers to shape a sector
The minister's 'six numbers' sit at the centre of her department's overhaul masterplan:
Ambitious targets, however, don't build tracks. What's needed is a structure to support them.
Laying down the law
A first-of-its-kind Rail Bill is set to be introduced later this year, according to Creecy, in an effort to move rail reform into legislation.
'This bill aims to legislate reforms intended to transform the freight and passenger rail sectors,' the Department of Transport told Daily Maverick. 'The department believes that this Rail Bill will offer legal clarity regarding future policy directions.'
Creecy stressed that the underlying infrastructure will remain in state hands, managed by the Transnet Infrastructure Manager.
Private sector appetite
The Department of Transport issued a Request for Information (RFI) in March this year – 162 submissions were brought, along with 11,600 visits to the site, which signalled interest across major freight corridors, especially that of ports, Creecy said.
'It's going to mean that future proposals will be responsive,' she said. 'We have seen situations where proposals that have been put out by state-owned entities have not been appetising to the market.'
Some companies have already approached the department with funding offers for urgent fixes, Creecy detailed.
In the meantime, Transnet has launched funding requests with National Treasury's Budget Facility for Infrastructure for short-term, urgent repairs and long-term revitalisation.

Can the state afford it?
According to Creecy, the state needs to be investing about R15-billion to R20-billion a year to have the network functioning effectively.
'It is plausible,' said transport economist Dr Johann van Rensburg, but only if this number also takes into account maintenance and future upgrades.
Council for Scientific and Industrial Research transport economist Shaun Mhlanga also believes this investment to be possible, pointing to hybrid models that blend government guarantees, private investment and multilateral funding.
Mhlanga added that the recent approval of a R51-billion government guarantee and the African Development Bank's R18.8-billion loan to Transnet, show that this is feasible.
Dr Alex Malapane, an independent economic analyst, says this estimate is 'fiscally unrealistic, yet politically seductive'.
With debt service costs exceeding R380-billion annually, Malapane argues that relying on the public purse alone would be irresponsible. 'True reform means handing over operational control. Anything less continues the cycle of underdelivery and overpromising.'
Weak bones, long returns
The transformation plan stems from an unavoidable reality: the network is ancient. 'Our existing network has not been developed since the 1970s, with the exception of the Gautrain,' Creecy said, adding that the country still uses narrow-gauge tracks and outdated control systems.
The return on this investment won't come quickly. Mhlanga estimates five to 15 years for most major upgrades to show results.
Malapane confirmed this, but said that it's not a cause for delaying action.
'Reducing turnaround times at Durban port or unblocking key freight corridors would improve export volumes in under 36 months. The idea that infrastructure only pays off in the long term ignores the multiplier effect that high-impact upgrades can have,' he said.
Van Rensburg said the payoff begins the moment new infrastructure opens. If the infrastructure is in better condition, maintenance costs drop, operational efficiency rises and user costs fall, but only if the benefits of the upgrades are not inflated, he said.
Transnet's reinvention by necessity
Transnet's debt structure is a major concern, according to Creecy, and is thus being restructured into a state-owned infrastructure provider.
Private operators will be able to run trains on key routes, pay access fees and offer niche services, such as agricultural and tourism lines.
Creecy acknowledges that although South Africa is about 20 years behind the curve, we can learn from the mistakes of other countries with more advanced systems.

At their press conference yesterday, the DA openly admitted to being at odds with their coalition partner, the ANC, on virtually every element of their supposed plan to'save' South Africa's economy. 'Instead of working for the people, the GNU's coalition partners are working against each other,' said Beesley. Unemployment The official unemployment rate increased by 0.3 percentage points from 32.9% in Q1 2025 to 33.2% in Q2 2025. 'This means that one in every three active jobseekers cannot find work. MKP rejects ANC's invitation to join the Government of National Unity

Image: Itumeleng English / Independent Newspapers Some opposition parties prefer to remain on the opposition bench as they flatly rejected the ANC's suggestion to invite them into the Government of National Unity (GNU). The uMkhonto weSizwe Party (MKP) was unwilling to be part of the Cabinet that involved the DA and President Cyril Ramaphosa. However, the MKP said it was willing to hold discussions with the EFF and the ANC, without Ramaphosa's involvement, for the formation of the pro-black government. MKP national spokesperson Nhlamulo Ndhlela said this in reaction to the ANC's suggestion of adding more parties to the GNU. The ANC, whose spokesperson Mahlengi Bhengu-Motsiri is yet to respond to request for comment, announced in a statement released on August 6, that its National Executive Committee's ordinary meeting held between August 1 and 4 resolved to engage with its current GNU partners to broaden participation, 'strengthen the functioning of the GNU, and give full effect to the Statement of Intent'. However, the ANC cautioned that it would not allow opportunistic forces, which it did not name, to manipulate this GNU platform for narrow partisan ends. When asked if the MKP was considering ANC's suggestion, Ndhlela said: 'Do you see us being mad?' 'We cannot join the racists,' he said. He did not think that the ANC would dare to invite the MKP to join the GNU. 'Do you think we would join Steenhuisen and Helen Zille, who have told them (ANC) categorically that they would never be a GNU with MKP and EFF? So, where would they begin to bring us in?' he asked. He said his party was not interested in joining the GNU. While being part of the GNU, the DA has strongly opposed several recently passed policies, such as the Basic Education Laws Amendment Act (BELA)'s language and school admission clauses, the National Health Insurance Act, and the Land Expropriation Act. DA leader John Steenhuisen, the Agriculture minister, said this week that he did not believe expansion of the parties in the GNU would take the country forward. Ndhlela said that while the DA was part of the government, it was also playing the opposition role in Parliament and Cabinet. He suggested that predominantly black parties should form the government. 'We need the ANC, without Ramaphosa, the EFF, and MKP to sit and talk because if you look at the policy perspective, we are all aligned in terms of what we want for black people,' said Ndhlela. The MKP placed the condition that it should have an upper hand in the government. 'On top of that, there is no way that the president of the country, if there were to be those kinds of conversations, would not come from the ANC, never, it cannot be. 'Not with the rot that is there. The president of the country must come from the MKP in those discussions, if they were to happen. 'There is no way that the ANC in its current state can lead the country as it has lost public trust,' said Ndhlela. He was emphatic that his party would never join the GNU. 'We cannot have a conversation with the ANC while it is part of the GNU; we cannot have a conversation with the ANC while Ramaphosa is still the president. 'We are willing to sit across the table with them and listen to them. Those are the natural key conditions. Then they will be worthy of an ear,' said Ndhlela. ActionSA leader Herman Mashaba said the ANC was trying to neutralise the opposition bench and that there was no significant role that his party would play in the already blotted Cabinet. He said ActionSA first rejected the ANC's invitation into the GNU after the general elections and during the heated debate over Finance Minister Enoch Godongwana's attempt to increase VAT. He said he was happy that the ANC had not invited his party to the GNU, as it had already been calling for the trimming of the Cabinet. 'We said to the ANC that as long as they got 70% representation in the GNU, they don't need us. 'We don't want to be neutralised because (by joining the GNU) we will be compromising ourselves as we want to remain a constructive opposition in parliament,' he said. He said the GNU would take away ActionSA's independence. 'They (ANC) want us to shield them in their infighting with the DA. 'Let them continue fighting with the DA and leave us alone as an effective constructive opposition,' said Mashaba. The DA and Freedom Front Plus were opposed to the expansion of the GNU. 'I think it is going to complicate things even further, (as) we already have 10 parties in the GNU,' said Steenhuisen. However, the United Democratic Movement leader Bantu Holomisa, the Defence and Military Veterans deputy minister, told the media on Tuesday morning that his party supported the expansion. 'There was no winner in the elections; the people mandated all political parties to find a way to run South Africa, hence the GNU today.

The party claims the move mirrors previous controversial appointments to SETA boards, which it says led to the removal of former Minister of Higher Education, Dr Nobuhle Nkabane. The MK Party accuses Transport Minister Barbara Creecy of recycling ANC loyalists and political allies into cushy board positions following the ANC's electoral losses in the May 2024 general election. It pointed to the recent appointment of individuals such as Kenneth Brown, Richard Dyantyi, and Neeshan Balton to the interim board of the Road Accident Fund (RAF) as proof of a political reward system at play. 'These appointments advance the very agenda we have consistently warned against,' said MK Party spokesperson Nhlamulo Ndhlela. 'The board is now overrun with individuals seemingly handpicked to return the RAF to the control of corrupt lawyers and exploitative medical aid schemes like Discovery, which openly pressured the Minister and her Deputy to remove Collins Letsoalo.' The MK Party argues the appointments were not based on merit or compliance with the Companies Act, but rather on political favouritism and loyalty to President Cyril Ramaphosa. The party questioned the qualifications and motives behind the appointments of Brown, Dyantyi, and Balton, asking: 'What skills, experience or expertise do Kenneth Brown, Richard Dyantyi and Neeshan Balton bring, aside from being rewarded for attacking President Zuma and other black professionals?' Ndhlela added: 'We demand full transparency from the Minister regarding the process used to assess the suitability of the appointed candidates. ''What criteria were applied, and was this process in accordance with the Companies Act? Or were these appointments influenced by their favourite, deeply compromised Judge Zondo, the very same judge who advised the President on how board appointments should be made?' He further accused Creecy of disregarding the findings of the State Capture Commission led by Chief Justice Raymond Zondo, calling Zondo 'nothing more than a political tool used by Mr Ramaphosa to target his opponents.' 'The so-called 'State Capture' recommendations he issued have clearly been discarded by Ramaphosa himself and ignored entirely by his Ministers,'' he said. The party also criticised the composition of the new RAF Board, which it claims is 'packed with Ramaphosa loyalists' and is aimed at reversing reforms introduced by former CEO Collins Letsoalo. 'This interim political board has one clear goal: eliminate Letsoalo and reverse the reforms he led,' Ndhlela said. The MK Party condemned the reappointment of ANC-linked individuals who failed to return to Parliament, such as former Deputy Minister of Transport Lisa Mangcu, now on the SAA Board, and Richard Dyantyi, who it says led the 'witch-hunt' against former Public Protector Busisiwe Mkhwebane. 'The MK Party strongly condemns the abuse of SOEs and public entities, which are now being used as rewards to personal friends of Ministers,' said Ndhlela. The party said it has submitted a parliamentary question demanding details on how the RAF Board members were identified and is calling for their appointments to be reversed. 'If the Minister fails to act, we will follow through with legal action in the coming weeks,' Ndhlela said.
