Judiciary's tolerance of anti-national acts fuelling their rise: Allahabad HC

Time of India19 hours ago
PRAYAGRAJ: Allahabad HC has refused bail to a 62-year-old man accused of sharing a "Pakistan Zindabad" post on Facebook, saying the judiciary's tolerance of anti-national acts is contributing to their rise.
"Commission of such offences is becoming a routine affair... because the courts are liberal and tolerant towards such acts of people with an anti-national bent of mind," Justice Siddharth said Thursday. "It is not a fit case for enlarging the applicant on bail at this stage."
HC held that Ansar Ahmad Siddique's act was "disrespectful to the Constitution and its ideals" and amounted to challenging the country's sovereignty.
"His irresponsible and anti-national conduct does not entitle him to seek protection of his right to liberty guaranteed under Article 21 of the Constitution," the court said.
Siddique faces charges under sections 197 (acts undermining national integration) and 152 (acts endangering sovereignty, unity, and integrity) of BNS, based on an FIR filed in Bulandshahar.
The applicant's counsel said Siddique had shared the controversial video on May 3. He cited his age and medical condition. The state opposed bail, contending the video was posted after the April 22 Pahalgam terrorist attack, proving Siddique supported
terrorism
on religious grounds.
Court emphasised that every citizen has a duty to respect the Constitution and uphold the country's sovereignty, unity, and integrity. Rejecting bail plea, it directed that trial be concluded expeditiously.

Terrorists behind pipe-bomb plot targeting L K Advani held after 30 years

Terrorist Abubacker Siddique, involved in the 2011 pipe-bomb planting attempt during former Deputy Prime Minister L K Advani's rath yatra in Madurai, was arrested from his hideout in Andhra Pradesh after 30 years, police said on Tuesday. He was involved in several bomb blasts in south India and was arrested by the Tamil Nadu's Anti Terrorism Squad from his hideout in Annamayya district, they said. The police have been searching for Siddique of Nagore for three decades and a reward of Rs 5 lakh was announced for anyone who finds him. Another fugitive Mohammed Ali alias Yunus alias Mansoor of Tirunelveli was also arrested along with the 60-year-old Siddique, police said in a statement here. "They were involved in multiple bomb blasts and communal murders and have been evading the police dragnet for three decades," the statement said. They were arrested following a tip-off and with the assistance from the central intelligence agencies that were tracking the terrorists for a long time. Abubacker was accused in several high-profile terror cases, including the 1995 bomb blast at the office of the Hindu Munnani, Chintadripet, here, parcel bomb explosion that killed T Muthukrishnan, a Hindu right-wing activist in Nagore, the same year, and the 1999 coordinated planting of bombs at the Chennai Police Commissioner's office, Egmore, here, and six other locations including Tiruchirappalli, Coimbatore and Kerala. He was suspected for his role in the 2011 pipe-bomb planting attempt in Madurai during the rath yatra of Advani, the 2012 murder of Dr Arvind Reddy in Vellore, and the 2013 bomb blast near the BJP office at Malleswaram in Bengaluru, police said. Mohammed Ali, his associate, has been on the run for 26 years, and was said to be involved in the 1999 multiple bomb planting in Tamil Nadu and Kerala. Both would be produced before a judicial magistrate and remanded, police said.

Censor board's ban on JSK an attack on creative freedom: Saji Cherian

Minister for Culture Saji Cherian has criticised the Central Board of Film Certifications' (CBFC) decision to deny screening permission for the film JSK-Janaki vs State of Kerala, starring Union Minister and actor Suresh Gopi, calling it a blatant infringement on freedom of expression. Interacting with mediapersons here on Tuesday, Mr. Cherian said, 'If this is the plight of a film featuring a Union Minister, what can common artists expect?' He said the government stands firmly with those in the film industry and creative fields and will extend all necessary support. 'A denial of certification merely based on a film's title is an unjustified overreach and cannot be accepted,' the Minister said. He drew parallels to the earlier censorship issues faced by Empuraan, directed by Prithviraj Sukumaran. Scenes from the film were removed and raids were conducted at the offices of the makers. 'But the people of Kerala wholeheartedly accepted the film,' he said. Mr. Cherian reaffirmed that the Constitution guarantees every citizen the democratic right to enjoy cinema, literature, music, and food choices. 'Any form of encroachment on these rights are unacceptable. We are committed to ensuring a supportive environment for artists to work freely,' he said. He said that the Kerala government will continue to uphold the spirit of artistic liberty and stand as a barrier against censorship and intolerance.
