GM wins victory as appeals court decertifies transmission lawsuits

General Motors
persuaded a federal appeals court on Friday to decertify a
class action
seeking to hold the automaker liable for knowingly selling about 800,000 cars, trucks and SUVs with
faulty transmissions
.
In a 9-7 vote, the 6th US Circuit Court of Appeals in Cincinnati found too many differences among
vehicle owners
to justify having one judge oversee the litigation, including 26 statewide subclasses and 59 state law claims.
Class actions can result in greater recoveries at lower cost than if plaintiffs were forced to sue individually.
Neither GM nor lawyers for the vehicle owners immediately responded to requests for comment.
The case covered
Chevrolet
and
GMC
vehicles equipped with 8L45 or 8L90 eight-speed automatic transmissions, and sold in the 2015 through 2019 model years.
Drivers said the vehicles shuddered and shook in higher gears, and hesitated and lurched in lower gears, even after repair attempts.
The vehicles included the
Cadillac
CTS, CT6 and Escalade; Chevrolet Camaro, Colorado, Corvette and Silverado; and GMC Canyon, Sierra and Yukon, among others. The decision reversed an August 2024 ruling by Circuit Judge Karen Nelson Moore for a three-judge panel.
Moore dissented on Friday, accusing the new majority of trying to erect "insurmountable barriers to certification for plaintiffs who file class-action complaints against national manufacturers."
Republican presidents appointed the nine judges in Friday's majority, while Democratic presidents appointed the seven dissenting judges.
The appeals court sent the litigation back to US District Judge David Lawson in Detroit for further review, which could lead to certification of smaller subclasses.
The case is Speerly et al v. General Motors LLC, 6th US Circuit Court of Appeals, No. 23-1940.

The 2026 Formula 1 season will see the grid swell up to eleven teams for the first time in ten years, with the inclusion of General Motors-backed Cadillac F1 team. A twelfth entrant also could be a possibility after Kuwaiti investor Saad Kassis-Mohamed announced his intention to revive the dormant Caterham F1 team as SKM Racing, subject to approval from the FIA and rights holder Liberty Media. SKM Capital, of which Kassis-Mohamed is the board director, aims to secure an entry ahead of the 2027 season. The team will function out of a technical base in Silverstone and will have a race operations unit in Munich. 'F1 now operates with clearer financial guardrails and stable technical frameworks, making the category investable. We like the intersection of elite engineering, a global platform, and predictable cost governance,' Kassis-Mohamed told Sportstar. Caterham was part of the F1 grid for three seasons (2012-2014), during which it failed to score a single point. An eleventh-place finish for Vitaly Petrov in the 2012 Brazilian Grand Prix was the team's best result. After entering administration in October 2014, the team returned for a final race in Abu Dhabi that year, managing to raise enough money via crowdfunding. With the administrators failing to find a new investor, the team folded at the end of the year, with its remaining assets auctioned off in March 2015. 'Caterham has strong recall and no current grid presence. A brand licence shortens the marketing ramp without reviving the defunct corporate entity or its liabilities,' the Kuwaiti entrepreneur said, outlining the reason for not marketing the team as a new entry. The road to FIA approval is still quite far, with the FIA yet to announce the reopening of its Expressions of Interest process since its previous notification in early 2023. Cadillac's confirmed F1 entry was also far from smooth. Michael Andretti's initial attempts to form an eleventh team were met with reluctance from Liberty Media. It was only after the onboarding of an Original Equipment Manufacturer (OEM) in the form of General Motors that the team was welcomed to the grid. Despite the perceived importance of OEM support, Kassis-Mohamed said the team will apply as a customer team, hoping to strike a deal with the existing 2026 power unit suppliers. 'We respect the thresholds set by FIA/ F1. Our plan involves two options: a change of control transaction in an existing entrant or applying in the next FIA process as a compact, well-funded customer team with long-term PU supply,' he said. Despite the short turnaround time, Kassis-Mohamed is confident of setting up the infrastructure and leadership group before 2025 comes to a close, ahead of focusing on chassis systems and race operations the following year. 'Kavach' – the indigenously developed Automatic Train Protection (ATP) system has been sanctioned across SCR – South Central Railway, for 4,655 Rkm which is more than 70% of the network. This includes tenders for upgrading Kavach version 3.2 to 4.0 over 1,400 Rkm and new installations on 1,618 Rkm, informed General Manager Sanjay Kumar Srivastava on Friday. The GM said that to ensure safety and increase sectional capacity, commissioning of Automatic Block Signalling (ABS) too is moving fast between April and July of the current fiscal year with 81 Rkm commissioned in various sections. For additional safety at level crossing gates, interlocking systems are being installed at all manned ones where vehicular movement exceeds 10,000 per day. Three manned LCs were eliminated, and four road overbridges and nine underbridges were built during this period. The 'collective' vigilance and adherence to safety protocols ensured that not a single consequential accident has been recorded so far this year, he pointed out. About 283 km of track renewal was completed, sectional speeds were raised to 130 kmph across 364 km and 19 permanent speed restrictions were relaxed or removed after addressing critical bottlenecks — the highest progress among all zonal railways. Around 800 children were rescued by RPF personnel. It has been decided to install CCTV cameras in MMTS coaches to enhance security, especially for women passengers, said Mr. Sirvastava. A special focus has been laid down for last mile connectivity and it is targeted to complete major ongoing doubling or tripling projects such as Kazipet – Vijayawada, Kazipet – Balharshah and Vijayawada – Gudur tripling projects by the end of this financial year. New projects such as Errupalem – Namburu line, Nadikudi – Srikalahasthi line, Guntur – Guntakal doubling, Mudkhed – Dhone doubling, and Guntur – Bibinagar doubling, are in different stages of execution, he said. The GM further informed that the gross originating revenue has been ₹6,960 crore, exceeding the ₹6,894 crore achieved in the same period last year. Freight loading reached 49 million tonnes with revenue at ₹4,601 crore, while the passenger segment generated ₹1,990 crore, with 96 million passengers carried during this period. About 1,117 special train services were operated and 128 extra coaches attached to the existing train services providing additional travel facility. Solar rooftop plants of 1,158 KWP have been commissioned taking the total solar plants to 14.5 MWP capacity with 16 trains shifted to electric traction resulting in saving of 24.70 crore per annum. Another 65 'Green Locomotives' have been commissioned and with this, the electric loco holding of the zone has reached 1,332.

General Motors unveiled two Chevrolet Corvette concept vehicles August 15 at The Quail automotive event in Carmel, California. The all-electric Corvette CX and hybrid CX.R Vision Gran Turismo represent the company's vision for future high-performance vehicles . The concepts mark the conclusion of GM's 2024 Corvette concept series, following earlier reveals from the company's UK studio in March and Pasadena, California studio in July. Both previous concepts featured electric powertrains. Corvette concept design inspired by fighter jets and gaming The CX concepts originated from Chevrolet's Performance Studio in Warren, Michigan, with designs drawing inspiration from fighter aircraft and video games. GM characterized the styling as "aggressively futuristic." "They will influence where we go forward," said Phil Zak, executive design director at Chevrolet. The concepts represent Corvette's first design studies since 2009. Electric Corvette CX features unique canopy entry system The Corvette CX's most distinctive feature is its sculpted canopy opening system. The front section swings upward and forward, resembling the motion of tipping a fedora hat. The vehicle eliminates traditional doors, requiring occupants to vault over the sides for entry. The electric all-wheel-drive supercar utilizes four motors, one per wheel, generating over 2,000 horsepower. Engineers positioned the 90-kWh lithium-ion battery within the chassis to achieve optimal weight distribution and a low center of gravity. Hybrid Corvette CX.R targets Gran Turismo 7 gaming integration The CX.R hybrid will appear in Gran Turismo 7 racing game later this month. The concept combines a midmounted 2.0-liter, dual-overhead-cam, twin-turbo V8 engine producing 900 horsepower at 15,000 rpm with three electric motors. The V8 engine powers the rear wheels while electric motors drive each front wheel, with a third motor integrated into the 8-speed transmission. Total system output reaches 2,000 horsepower. No production timeline announced for Corvette concepts General Motors has not announced production plans for either Corvette concept vehicle. The company indicated the designs will inform future development direction for the brand. GM's global design network includes studios in Michigan, Southern California, China, South Korea, and the United Kingdom. The Warren, Michigan facility serves as the primary location for Chevrolet performance vehicle development.
