Days after interim stay, contempt plea in HC over ‘OBC list' in college portal

The Calcutta High Court on Thursday allowed a contempt petition to be filed against the West Bengal government for allegedly violating the stay on the interim Other Backward Classes (OBC) list in undergraduate college admissions in the state.
Petitioner Purabi Das approached the Division Bench of Justice Tapabrata Chakraborty and Justice Ritobrata Kumar Mitra, alleging that despite the High Court's interim stay on the new OBC list, the state-run college admission portal continues to display reservation under the OBC-A and OBC-B categories.
'We stated that in the recent college admissions portal, the Tuesday's order of the High Court is not being followed. Thus, it is a contempt of court. We have made the chief secretary and secretary, Education Department, a party in the matter,' counsel Bikram Banerjee said.
On Wednesday, the college admission process for undergraduates began through the government's centralised portal for over nine lakh seats across 7,229 undergraduate courses in 460 state and state-aided colleges.
A day earlier, at the launch of the portal, State Education Minister Bratya Basu had said the interim stay on the new OBC list would not affect the admission process.
'Should agricultural work stop because of predictions of drought or heavy rain? We will continue our work. If there is any instruction, we will take emergency measures,' the minister had said.
On Tuesday, the Division bench of Justice Tapabrata Chakraborty and Rajasekhar Mantha, while putting a stay on reservations to 140 subsections under OBC-A and OBC-B categories till July 31, had said that OBC certificates issued before 2010 under the 1993 law would remain valid for employment and education.

HC revokes transfer of judge hearing the north-east Delhi riots ‘larger conspiracy' case

The Delhi High Court on Wednesday revoked the transfer of Additional Sessions Judge Sameer Bajpai, who was hearing the north-east Delhi riots 'larger conspiracy' case. The High Court had on May 30 transferred ASJ Bajpai, who had been hearing arguments on the framing of charges in the February 2020 communal violence 'larger conspiracy' case in a Karkardooma court on a daily basis since September last year, to the Saket courts complex as part of a routine transfer process. He was replaced by ASJ Lalit Kumar, who, on June 2, had ordered fresh hearings in the matter. The development is likely to speed up one of Delhi's most high-profile trials in connection with the violence in several parts of north-east Delhi, which left 53 people dead and over 700 injured. The transfer of ASJ Bajpai had drawn criticism from lawyers who felt that the move would cause the trial, which has already been delayed due to pending investigations and judicial transfers, to further slow down. 'The pace at which the case is moving can be gauged by the fact that of the 18 accused booked under the Unlawful Activities (Prevention) Act, 1967, among other charges, most have been in jail for over four years,' said a lawyer on condition of anonymity. The 'larger conspiracy' case is among the many pertaining to the riots and is so named because Delhi Police, which is probing the matter, has claimed that the violence was part of a 'deep-rooted conspiracy'. Key accused in the case include former Delhi councillor Tahir Hussain, student activists Umar Khalid, Khalid Saifi, Ishrat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha, Athar Khan, Safoora Zargar, Sharjeel Imam, and Natasha Narwal. 2,500 arrested so far In the months following the riots, the police arrested over 2,500 people in various cases based on CCTV footage and testimonies of victims and eyewitnesses. During the four years of trials, the city courts gave bail to more than 2,000 people. Several trial courts also made adverse comments about the police's 'shoddy' investigations. The arguments over the framing of charges began in 2024, a year after the filing of the chargesheet.

MP high court issues notices over petition challenging section 12.4 of school teachers recruitment rules 2024

Bhopal/Jabalpur: The MP high court issued notices to the state govt and other respondents in response to a petition challenging the legality of Section 12.4 of the Primary and Middle School Teachers' Recruitment Rules-2024. Appearing for the petitioner, Dinesh Garg, Advocate Aryan Urmalia said that Section 12.4 is not only against the MP Teachers' Recruitment Rules-2018 but is also in violation of Articles 14 and 16 of the Constitution, which guarantee equality and equal opportunities to all citizens. The rule stipulates that a candidate from any of the reserved classes, on securing less than 90 marks in the eligibility test, will only be eligible to appear in the teachers' recruitment test from his reserved category and not as a general candidate. This is against the Supreme Court guidelines, which clearly state that any candidate from a reserved category would be eligible for selection from the general category if he scores marks at par with the marks of meritorious candidates from the general category. This rule doesn't allow candidates from EWS, OBC, SC, and ST sections to be selected as general candidates despite scoring higher marks than the cut-off marks of the general candidates. Following initial arguments, the court of Justice Vivek Jain issued notices to respondents, including the state govt, seeking a response.
