Public outcry and media coverage do not lessen the seriousness of an offence, the Delhi High Court has said while denying bail to a man accused of raping and murdering his eight-year-old cousin. (HT Archive)
The man was booked under various provisions of Indian Penal Code including murder, kidnapping, and Section 6 (penetrative sexual assault) of Protection of Children from Sexual Offences (Pocso) Act, 2012.
The FIR, filed in 2016, was based on a complaint by the victim's father, who reported that his daughter had been abducted while playing outside their home. Police learned that the accused had raped the girl, strangled her, concealed her body in a plastic bag, and buried it in a pit.
In his bail petition, the man said he was falsely implicated in the case under public pressure and glare of media trial. He said he had already spent more than nine years in jail and there was no likelihood of the trial to conclude in the near future.
The Delhi police, represented by additional public prosecutor Amit Ahlawat, said there had been no delay in trial and four out of 20 witnesses had supported prosecution's case. The complainant's lawyer opposed the bail asserting that the accused's family members had been threatening him.
Rejecting the man's contention, justice Girish Kathpalia in his ruling delivered on Friday, said , 'The broad picture recorded above shows the gruesome manner in which an eight-year-old girl was raped and killed, that too by her own cousin. Merely because there was public outcry and media coverage of the incident, gravity of offence does not get diminished.'
In its five-page ruling, the judge said the man exploited the relationship of trust between the cousins in a 'brutal manner.' 'One also cannot ignore that a relationship of trust between the cousins was exploited by the accused/applicant and in such a brutal manner,' the court said.

"Later when we went for a DNA test, we realised the claim was false," the complainant claimed. Based on her complaint, Gopalapuram police named Dr Vidyulatha as an accused and nabbed her. "She had come to Hyderabad for some property transaction. We tracked her down and caught her from the RGI Airport while she was planning to return to Visakhapatnam," said a police official. Dr Vidyulatha is currently being interrogated by Gopalapuram police. Dr Vidyulatha along with four others including Dr Namratha and Kalyani were charged under BNS & Surrogacy (Regulation) Act, 2021.

New Delhi: A Delhi court recently directed the father of a student at a private school in south Delhi to pay a pending fee of Rs 1.2 lakh with 10% interest. The court of civil judge Yashu Khurana observed that the father of the student did not appear to contest the suit filed by the school, and it remained uncontroverted and unrebutted. The judge was hearing a suit filed by the defendant, Bluebells School International, against Virender Rana for the recovery of the amount of over Rs 1.2 lakh, which was due as school fees for his ward. The school approached the court, stating that it is entirely dependent on the fees paid by the parents to meet its expenses and maintain high standards of education. The school presented evidence before the court, stating that the father did not pay the fees for four years: 2017-18, 2018-19, 2019-20 and 2020-21. The child left the school in 2022 while he was in the Class VII. In its plea, the school said that Rana, "under the shield of the directorate of education order dated Aug 1, 2018, regarding the fee structure of the school for the year 2017-18 and in the guise of the fact that the issue regarding the same was sub judice before Delhi High Court, long delayed the payment of the dues." The court, noting the school's submission that the delay in payment jeopardised its financial situation, said, "Perusal of the record shows that the present suit was filed on Oct 16, 2024, whereas the cause of action last arose upon the plaintiff on Feb 7, 2024, when the defendant made the last payment against the outstanding amount."

Agency: PTI Last Updated: Mumbai, Aug 4 (PTI) After a five-month gap, the trial against sacked RPF constable Chetansinh Chaudhary, accused of shooting dead four people on a moving express train in 2023, recommenced on Monday, with a sessions court deeming the accused mentally fit. Chaudhary had earlier claimed that he was mentally unfit to stand trial. The sessions court on Monday resumed trial with the deposition of the sixth witness, a former RPF head constable, in the case. On July 31, 2023, Chaudhary allegedly shot dead four persons — three passengers and one of his senior colleagues, an RPF Assistant Sub-Inspector, Tikaram Meena — on the Jaipur-Mumbai Central Express near Palghar station in Maharashtra. Eyewitness and dismissed RPF head constable Narendra Parmar (60) told the court that one of the victims, Asghar Shaikh, pleaded for mercy with Chaudhary moments before he was shot twice in the chest in S6 compartment of the Jaipur-Mumbai Superfast Express in 2023. 'Shaikh said Mai aam mulazim hoon. Main bhi bhagwan ko manta hoon'¦ Bhagwan and Allah ek hai'¦" (I am just an ordinary employee. I also believe in God. God and Allah are one)", Parmar said. Parmar was dismissed along with RPF constable Amey Acharya for failure to discharge their duties. Parmar told the court that Chaudhary was visibly stressed. He wanted to stop Chaudhary but feared that the attempt to restrain him could result in more passengers getting shot. Chaudhary has been charged under Indian Penal Code (IPC) sections 302 (murder), 153-A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc) and others, as well as relevant provisions of the Railways Act.
