SC to hear plea on Prez Rule in Bengal over Waqf violence

The Supreme Court on Monday agreed to hear an application seeking imposition of President's Rule in West Bengal in the context of recent violence in the state over the Waqf Amendment Bill, even as it spoke for the first time on the criticism of judicial overreach in recent judgments.
A bench headed by justice Bhushan R Gavai was hearing a fresh application filed by West Bengal-based social worker Devdutta Maji and advocate Mani Munjal who sought President's Rule after clashes in Murshidabad since April 13 left three dead and 18 policemen injured.
Responding to lawyer Vishnu Shankar Jain's request for considering imposition of President's Rule, the bench, also comprising justice AG Masih, said, 'You want us to issue a writ of mandamus to impose President's Rule. As it is, we are being blamed for encroaching upon the legislative and executive functions.' The petition will be heard on Tuesday.
In a parallel proceeding, a separate bench of the top court -- comprising justices Surya Kant and N Kotiswar Singh -- heard two petitions demanding an independent probe into the Murshidabad violence case. The court permitted the two petitioners – advocates Vishal Tiwari and Shashank Shekhar Jha -- to withdraw their petitions, as the court found the pleadings to be based on media reports, lacking the decency and standards expected in a matter to be filed before the top court, and for not naming the government officials as parties against whom allegations of inaction is alleged.
The violence triggered a political battle with the Bharatiya Janata Party targeting the Mamata Banerjee government for permitting violence triggered by protests against the Waqf Amendment Act 2025. Following the incident, as NH-2 remained blocked, situation in Murshidabad and some neighbouring districts became tense as shops were looted and police came under attack. The Calcutta high court on April 13 ordered central forces to be deployed in violence-affected areas. The police later swung into action and claimed to have arrested 118 people in connection with the arson and violence.
The application on President's Rule filed was mentioned by advocate Vishnu Shankar Jain, to be heard along with a pending petition filed by Ranjana Agnihotri and others who asked for President's Rule in the context of post-poll violence in West Bengal in 2021.
The bench allowed the application to be listed after Jain said, 'In the 2021 matter, court has already issued notice and the same is under consideration. Through this application we have brought recent incidents of violence. All we seek is a report under Article 355 of the Constitution by the Centre from the state.'
Article 355 deals with the Union's duty to protect states against external aggression and internal disturbance, which is a ground to impose President's Rule. This provision requires Centre to ensure that states run in accordance with the provisions of the Constitution.
The application by Maji and Munjal pointed out incidents of violence targeting Hindus in the state from 2022 till April 2025, and sought a three-member judicial committee headed by a former Supreme Court judge and two former high court judges to inquire into the incidents, particularly the violence in Murshidabad. The applicants also sought directions to the Centre to deploy central forces in the violence-affected areas and the state government to ensure the life, liberty and dignity of citizens.
In 2022, after violence on the eve of Lakshmi Puja in the Mominpur area of Kolkata, the Calcutta high court had ordered the state government to form a special investigation team (SIT) to probe the incident. However, the application said that SIT made no progress in booking the culprits.
Plea for SIT withdrawn
Another bench of justices Surya Kant and N Kotiswar Singh heard petitions filed by Vishal Tiwari and Shashank Shekhar Jha demanding a special investigation team (SIT) to be set up to probe the failure of the state administration and police to control the violence that took place on April 12. Jha even demanded compensation and rehabilitation for the victims.
But the court differed. 'In an Article 32 petition, we look for interesting questions of law. Look at your petition. We should maintain dignity and decorum of this institution while filing any petition,' it said.
Jha cited the matter related to President's Rule in West Bengal being heard by another bench on Tuesday, and requested his matter to be tagged with the other case. 'Never be in a hurry to file such petitions,' the bench said, adding, 'If you are alleging failure of administration in the state, the basic rule is that you will first cite what are the responsibilities of authorities and how they failed in performing their duties.'
The court further stated, 'They are not party before us. Do you think we can examine their role in such a situation? If you make allegations against someone, are they not to be made party. Help us in being the voice of the voiceless but do it in a proper way.'
The court permitted both petitions to be withdrawn, granting them the liberty to approach the court with a better, comprehensive petition.

The Nagaland government will hold a cabinet-level meeting on Wednesday (July 30, 2025) to deliberate on the Centre's directive to resolve pending issues related to the demand for creation of Frontier Nagaland Territory, Deputy Chief Minister Yanthungo Patton said. The development follows the third Tripartite High-Level Committee meeting held on July 23 in New Delhi, attended by officials from the Ministry of Home Affairs (MHA), the Nagaland government, and representatives of the Eastern Nagaland People's Organisation (ENPO), which has been demanding separate statehood since 2010. 'We have a cabinet meeting tomorrow, and we will discuss the matter there. We shall also discuss with the ENPO leaders tomorrow,' Mr. Patton told reporters here on the sidelines of an official programme. During the New Delhi meeting, several contentious issues were reportedly resolved, barring a few pending ones from the Nagaland government side, ENPO had said in a statement on July 25. The Centre subsequently directed the state government to resolve the pending issues within a fortnight, it said. ENPO, the apex organisation representing eight tribes across six districts – Mon, Tuensang, Longleng, Kiphire, Noklak, and Shamator – has been demanding separate statehood since 2010, citing 'decades of neglect in governance and development'. In April, the organisation had announced a temporary suspension of its statehood demand and agreed to the Centre's proposal for a certain degree of autonomy under the Frontier Nagaland Territory (FNT) framework.

Agency: Bhubaneswar, Jul 29 (PTI) The Odisha government on Tuesday urged the Centre for early sanction of Rs 3,069 crore under the Revamped Distribution Sector Scheme (RDSS). Deputy Chief Minister K V Singh Deo has raised this demand before Union Power Minister Manohar Lal during his meeting in New Delhi, an official statement said. The Centre had launched the RDSS with an aim to reduce the aggregate technical and commercial (AT&C) losses to pan-India levels. Under the scheme, financial assistance to power distribution companies is provided for upgradation of the distribution infrastructure and for prepaid smart consumer metering and system metering based on meeting pre-qualifying criteria and achieving basic minimum benchmark in reforms, officials said. As Odisha frequently faces natural disasters like cyclones and floods, the Coalition for Disaster Resilient Infrastructure (CDRI) has proposed the creation of disaster-resilient power infrastructure with selective underground cabling, especially 30 km from the coastline, the statement said. Therefore, Odisha urgently needs central financial assistance for disaster-resilient power infrastructure, Singh Deo said. Considering the rising demand for power, he urged Lal for the allocation of 800 megawatt (MW) power from NLC Talabira Phase-II project in addition to the 400 MW already allocated in Phase-I to Odisha. It would bring the total share to 1,200 MW from 3,200 MW total project capacity, the statement said. New Delhi: Launching a volley of attacks on the Centre during the debate on Operation Sindoor in the Rajya Sabha, Congress President Mallikarjun Kharge on Tuesday said "factories of lies" have been set up and demanded that accountability be fixed for repeated intelligence failures. Extending his condolences to the families of those killed in the Pahalgam attack on April 22, the Leader of the Opposition in the Rajya Sabha said members of the treasury benches, in their speeches, have tried to deflect attention from the issues at hand. "Our history is a long one. The history of the Congress is a long one. Our contribution to nation-building has been immense. There is not one Public Sector Unit that you have set up. You have only set up factories of lies. Then you talk about HAL (Hindustan Aeronautics Limited) and other PSUs that we have created," Mr Kharge said in Hindi. The Congress President said Amit Shah visited Jammu and Kashmir on April 7 and 8 and said that the terrorist ecosystem had been crippled under Prime Minister Narendra Modi's government. "If it was crippled, how was the Pahalgam attack carried out? You keep saying so many things that are so far from the truth. Just three days before the attack, PM Modi cancelled his scheduled visit to J&K... This is an issue I have raised before as well and I have got no answers. Did the Centre suspect that an attack was about to be carried out? If so, why were the tourists and pilgrims not stopped from going?" Mr Kharge asked. At this point, BJP President and leader of the House JP Nadda intervened and called for some remarks to be expunged. 'Arrogance' Continuing his attack, the Congress president said he and Leader of the Opposition in the Lok Sabha, Rahul Gandhi, wrote letters demanding a special session of Parliament to discuss the Pahalgam attack and Operation Sindoor, but got no response. "Our letters seem to end up in the waste bin. They don't even look at them. This much arrogance is not good. You don't have time to write a couple of sentences and reply? During the 1962 India-China War, then PM Jawaharlal Nehru had agreed to a special session and said nothing should be hidden from the people. We also asked for the truth to be told in all-party meetings at least. We attended those meetings, where was PM Modi? Why was he not there?" he questioned. 'Who Is Responsible?' Pointing to the 2016 Uri and Pathankot terrorist attacks, the Pulwama attack in 2019 and Pahalgam this year, Mr Kharge alleged that the government has to admit there have been repeated intelligence failures. "I want to ask the Home Minister, who is responsible for this? If he is responsible, accountability should be fixed... There have been five attacks in Pahalgam alone since the BJP government came to power. Mistakes may have happened, but what did you do to fix them? If the Home Minister is responsible, he should resign. If he is not, the Prime Minister should decide what action needs to be taken," the Leader of the Opposition in the Rajya Sabha said. "Even the Jammu and Kashmir Lieutenant Governor Manoj Sinha said there was a security lapse in the Pahalgam terror attack," Mr Kharge said and, when someone from the treasury benches began shouting, added, "You keep talking about what we have done. Under Indira Gandhi, we split Pakistan into two and ensured Bangladesh got Independence," he added. The Congress President said Home Minister Shah has said three terrorists involved in the Pahalgam attack have been killed. "But what about the others? Where are they hiding? Why haven't you been able to find them?" he asked. Stating that the Opposition had extended all possible support to the government in the aftermath of the Pahalgam attack, Mr Kharge said that did not stop the Centre from attacking the Congress and other parties for electoral gains. The Congress president also said at least 27 people, including five children, were killed in Pakistani firing during Operation Sindoor and asked why they were not moved to safer places.
